Signing of the Japan-Paraguay Investment Agreement

On 5 December, the “Agreement between Japan and the Republic of Paraguay for the Promotion and Protection of Investment” (Japan-Paraguay Investment Agreement) was signed in Asunción by H.E. Mr. ITAGAKI Katsumi, Ambassador Extraordinary and Plenipotentiary of Japan to the Republic of Paraguay and H.E. Mr. Rubén Darío RAMÍREZ LEZCANO, Minister of Foreign Affairs of the Republic of Paraguay.
- This Agreement aims to further protect and promote investment between the Contracting Parties. It stipulates the treatments accorded to investment activities and investments when an investor (e.g. an enterprise) of a Contracting Party invests in the other Contracting Party: national treatment at the post-establishment phase of investments, most-favoured-nation treatment at the pre-establishment and post-establishment phase of investments; fair and equitable treatment; conditions for expropriation and compensation; freedom of transfers; procedures for dispute settlements.
- The fact that Paraguay is relatively stable in terms of political and social conditions, along with its regional and geographical characteristics of being a member of Mercosur and being close to Brazil, a core country in the South American region, is increasingly attracting interest from Japanese companies. Additionally, the Paraguayan government is actively working on developing a system to promote foreign investment, and the conclusion of this agreement is expected to further develop the investment environment in Paraguay and promote investment by Japanese companies.
- The Contracting Parties will notify each other, through diplomatic channels, of the completion of their respective internal procedures necessary for the entry into force of this Agreement (in case of Japan, the approval of the National Diet will be required). This Agreement will enter into force on the thirtieth day after the latter of the dates of receipt of the notifications.
