AGREEMENT ON THE ALLOCATION OF THE TOTAL CATCH QUOTA OF HAKE IN 1986 UNDER THE INTERNATIONAL COMMISSION FOR THE SOUTHEAST ATLANTIC FISHERIES

　千九百六十九年十月二十三日にローマで作成された南東大西洋の生物資源の保存に関する条約(以下「条約」という。)の締約国政府であるこの取極の締約国政府は、

　The Governments of the States Parties to this Agreement, being Parties also to the Convention on the Conservation of the Living Resources of the Southeast Atlantic, done at Rome on 23rd October 1969 (hereafter referred to as "the Convention");

　条約区域の生物資源の保存及び合理的な利用に関する共通の利益を考慮し、

　Considering their mutual interest in the conservation and rational exploitation of the living resources of the Convention Area;

　南東大西洋漁業国際委員会(以下「委員会」という。)の第八回通常会議において千九百八十五年十二月十二日にスペインのタラゴナで採択された千九百八十六年のヘイクの総漁獲量の規制に関する勧告(以下「勧告」という。)を実施するための措置をとることを希望して、

　Desiring to elaborate the Recommendation relating to the regulation of the total catch of hake in 1986 (hereafter referred to as "the Recommendation"), adopted at the Eighth Regular Session of the International Commission for the Southeast Atlantic Fisheries (hereafter referred to as "the Commission"), at Tarragona, Spain, on 12th December 1985;

　次のとおり協定した。

　Have agreed as follows:

第一条
　この取極が適用される区域は、南緯十七度十七分と南緯二十八度三十八分との間及び東経十度と東経二十度との間の条約区域の水域(委員会の設定する禁漁区域の水域を除く。)とする。

Article 1
　The area to which this Agreement shall apply shall be waters of the Convention Area lying between 17゜17'S latitude and 28゜38'S latitude, and between 10゜00'E longitude and 20゜00'E longitude, excluding waters falling in a closed area established by the Commission.

第二条
(1)　勧告に定める千九百八十六年のヘイクの総漁獲量は、次のとおり配分する。

(1) The total catch of hake in 1986 set out in the Recommendation shall be allocated in the following manner:

(2)
(a)　(１)の規定にかかわらず、(１)に掲げる国の権限のある当局は、千九百八十六年九月一日まで、当該国に対する配分量の全部又は一部を(１)に掲げる他の国に移譲することができる。

(2)
(a) Notwithstanding the provisions of paragraph (1) above, the competent authorities of the States mentioned therein may, not later than lst September 1986, transfer their catch allocations or parts thereof to any other State or States referred to above.

(b)　関係国政府は、(ａ)に規定する移譲について委員会の事務局長に直ちに通報するものとし、同事務局長は、この取極のすべての締約国政府に対しこれを速やかに通報する。

(b) The Executive Secretary of the Commission shall be immediately notified by the Governments of the States concerned of the terms of any such transfers, and he shall promptly notify all Contracting Parties to this Agreement.

第三条
(1)　この取極は、前条(１)に掲げるすべての国の政府が委員会の事務局長に受諾の通告書を寄託した時に効力を生ずる。

Article 3
(1) The Agreement shall enter into force when all the Governments of the States referred to in paragraph (1) of Article 2 shall have deposited their notifications of acceptance with the Executive Secretary of the Commission.

(2)　委員会事務局長は、この取極のすべての締約国政府に対し次の事項を通報する。

(2) The Executive Secretary of the Commission shall inform all Contracting Parties to this Agreement:

(a)　(１)の規定に従つて行われる受諾の通告書の寄託

(a) of the deposit of notifications of acceptance in accordance with paragraph (1) above;

(b)　この取極が(１)の規定に従つて効力を生ずる日

(b) of the date on which this Agreement entered into force in accordance with paragraph (1) above.

(3)　この取極の原本は、委員会の事務局長に寄託する。

(3) The original of this Agreement shall be deposited with the Executive Secretary of the Commission.

　千九百八十五年十二月十二日にスペインのタラゴナで、英語により本書一通を作成した。

　Done at Tarragona, Spain, this twelfth day of December, one thousand nine hundred and eighty-five, in a single copy in the English language.

　以上の証拠として、委員会の議長及び事務局長は、この取極に署名した。

　In witness whereof the Chairman of the Commission, together with the Executive Secretary of the Commission, has signed this Agreement.
