国際連合工業開発機関工業投資促進事務所のための拠出に関する日本国政府と国際連合工業開発機関との間の交換公文

(Japanese Note)

　Vienna, March 25, 1980

　Sir,

　書簡をもって啓上いたします。本使は、開発途上国における工業投資の促進のための国際連合工業開発機関(以下「UNIDO」という。)の事務所(以下「事務所」という。)を日本国に設置することを目的としたUNIDOの複数の地域を対象とする事業に関して日本国政府の代表者とUNIDOの代表者との間で最近行われた討議に言及するとともに、日本国政府に代わって当該事業に関する次の取極を提案する光栄を有します。

　I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and the United Nations Industrial Development. Organization (hereinafter referred to as "UNIDO") concerning the interregional project of UNIDO for the establishment in Japan of a UNIDO Service for the Promotion of Industrial Investment in Developing Countries (hereinafter referred to as "the Service") and to propose on behalf of thc Government of Japan the following arrangements in respect of the afore-mentioned project:

1　事業は、工業協力の分野、投資事業の促進及びこれらに関連する技術の移転についての日本国と開発途上国との協力を強化することを目的とする。この目的は、国際連合における開発途上国の工業化のための機関であるUNIDOと日本国の企業との緊密なかつ信頼のある接触によって達成されることとなる。

1. The objective of the project is to strength-en the co-operation between Japan and the developing countries in the area of industrial co-operation, the promotion of investment projects and the related transfer of technology. This objective will be furthered by close and trustful contacts between UNIDO as the UN Organization for the industrialization of developing countries and Japanese enterprises.

2　この取極の対象となる事業の期間は、千九百八十年七月一日から千九百八十二年六月三十日までとする。

2. The duration of the project covered by the present arrangements shall be from July l, 1980 to June 30, 1982.

3　日本国政府は、予算に従い、事業に要する経費を負担するため、UNIDOに対し、国際連合工業開発基金に対する目的指定拠出として三十三万二千六百六合衆国ドル(三三二、六〇六合衆国ドル)に相当する額を限度とする額の供与を日本円で行う。費用のうち日本国政府による拠出の額を超える部分については、UNIDOが負担する。

3. The Government of Japan, subject to its budgetary appropriations, shall place at the disposal of UNIDO for the purpose of meeting the costs of the project as a special-purpose contribution to the United Nations Industrial Development Fund an amount up to the equivalent of three hundred thirty-two thousand six hundred six US dollars (US$332,606) in Japanese The costs in excess of the contribution yen . provided by the Government of Japan shall be borne by UNIDO.

4　UNIDOは、その財政規則及び他の関連規則に従って日本国政府による目的指定拠出を管理するものとし、要請のあったときは、日本国政府に対し支払に係る領収書の詳細な一覧表及び関係する会計検査報告書を提出する。

4. UNIDO shall administer the special-purpose contribution of the Government of Japan in accordance with its financial rules and other applicable regulations and Shall make available a detailed list of vouchers on which payments were made and the relevant auditing report to the Government of Japan at its request.

5　事務所の職員の採用は、国際連合の職員規則に従って行う。事務所長は、日本国政府との合意の上任命する。

5. The recruitment of personnel for the Service shall be effected in accordance with the Staff Rules and Regulations of the United Nations. The appointment of the Head of the Service will be made in agreement with the Government of Japan.

6　この取極から生ずる問題についての日本国政府からUNIDOに対する及びUNIDOから日本国政府に対するいかなる公的な連絡も、在オーストリア日本国大使館を通じて行う。

6. Any official communication from the Government of Japan to UNIDO and from UNIDO to the Government of Japan with regard to matters arising from the present arrangements shall be made through the Embassy of Japan in Austria.

7　この取極の実施に必要な他のすべての細目は、千九百八十年六月三十日前に、日本国政府とUNIDOとの間で交渉し、取り決める。

7. All other details necessary to implement the present arrangements shall be negotiated and arranged between the Government of Japan and UNIDO before June 30, 1980.

8　UNIDOは、事業の終了の後遅くとも六箇月以内に、日本国政府に対し事業の実施に関する最終報告書(日本国政府によって行われた目的指定拠出の運用に係る最終的な決算書を含む。)を提出する。最終報告書には、この取極の終了の遅くとも六箇月前に日本国政府及びUNIDOの双方によって行われる合同評価を基礎としてUNIDOが事業について行う評価を含める。

8. UNIDO shall submit to the Government of Japan not later than six months after completion of the project a final report on its implementation, including the final accounts covering the utilization of the special-purpose contribution provided by the Government of Japan. The final report shall contain the appraisal of the project by UNIDO on the basis of the joint evaluation which shall be carried out by the both sides not later than six months prior to the expiry of the present arrangements.

　本使は、更に、この書簡及びUNIDOに代わって前記の取極を確認される貴官の返簡が日本国政府とUNIDOとの間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that the present Note and your Note in reply thereto confirming on behalf of UNIDO the foregoing arrangements shall be regarded as constituting an agreement between the Government of Japan and UNIDO which will enter into force on the date of your reply.

　本官は、更に、UNIDOに代わって、前記の取極を確認するとともに、閣下の書簡及びこの返簡が日本国政府とUNIDOとの間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm on behalf of UNIDO the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between UNIDO and the Government of Japan, which will enter into force on the date of this reply.
