アセアン貿易投資観光促進暫定センターの設立に関する交換公文

書簡をもつて啓上いたします。本使は、日本国政府及び東南アジア諸国連合(以下「アセアン」という。)加盟国政府がアセアン貿易投資観光促進センターを東京に設立する意思を有することに言及する光栄を有します。日本国政府及びアセアン加盟国政府は、アセアン加盟国から日本国への輸出の促進、日本国からアセアン加盟国への投資の流入の増進及び日本国からアセアン加盟国への観光の振興を一層緊密な協力を通じて図ることについての緊急の必要性を認識し、暫定措置として、アセアン加盟国の首脳及び日本国総理大臣がその設立を合意したアセアン貿易観光常設展示場の早急な設立をその機能の一として有するアセアン貿易投資観光促進暫定センター(以下「暫定センター」という。)を東京に設立することに合意する。
Excellency, I have the honor to refer to the intentio of the Government of Japan and the Government of member countries of the Association of South East Asian Nations (hereinafter referre to as "ASEAN") to establish the ASEAN Promoti Centre on Trade, Investment and Tourism in Tokyo. Recognizing, however, the urgent necessity to promote exports from the ASEAN countries to Japan, to accelerate the inflow of investments from Japan to the ASEAN countries and to vitalize tourism from Japan to the ASEAN countries trough closer cooperatio the Governments of Japan and the ASEAN member countries have agreed as an interim arrangeme to the setting up of the Provisional ASEAN Promotion Centre on Trade, Investment and Tourism (hereinafter referred to as "the Provisional Centre") in Tokyo whose function includes the immediate establishment of a permanent ASEAN trade and tourism exhibition hall which was agreed upon by the ASEAN Heads of Government and the Prime Minister of Japan
暫定センターは、以下の活動を行う。
The activities of the Provisional Centre shall be the following:
(1) アセアン加盟国の産品、産業、投資機会及び観光資源を日本国において紹介し及び宣伝すること。
(1) to introduce and publicize in Japan, products, industries, investment opportunities and tourism resources of the ASEAN member countries;
(2) アセアン諸国の利益を増進する貿易、投資及び観光に関する使節団(アセアン諸国からの使節団であるかアセアン諸国への使節団であるかを問わない。)に対し、適当であると認める場合には、援助及び助言を与えること。
(2) to assist and advise, where appropriate, missions from and to the ASEAN countries on trade, investment and tourism which will enhance ASEAN's interest;
(3) アセアン諸国の対外的な貿易、投資及び観光の増進に関連する情報(市場への接近に関する規則を含む。)の有意義な交換のための経路の役割を果たすこと並びに市場に関する資料、情報及び動向を準備し及び分析すること。
(3) to serve as a channel for the meaningful exchange of information relevant to the enhancement of ASEAN external trade, investment and tourism including rules and regulations concerning market access, as well as to prepare and analyze data and information, and trends on markets.
アセアンのそれぞれの加盟国の代表一名及び日本国の代表一名により構成される執行委員会を置く。執行委員会は、事務局によつて補佐される。事務局の長は、執行委員会によつて任命される。事務局の長は、直接執行委員会に対し責任を負う。執行委員会は、暫定センターの予算及び事業計画を承認する。執行委員会は、暫定センターの能率的な運営につき責任を有する。
There shall be and Executive Board composed of a representative from each of the ASEAN countries and a representative from Japan. The Executive Board shall be assisted by a bureau, and the head of the bureau shall be appointed by and directly responsible to the Executive Board. The Executive Board shall approve the budget and the work programme of the Provisional Centre. The Executive Board shall be responsible for the efficient management of the Provisional Centre.
アセアン諸国政府及び日本国政府は、暫定センターの経費のため、暫定センターの運営及び活動に必要な合意された額の金銭を、それぞれの法令に従い、かつ、それぞれの予算の範囲内で拠出する。
The Governments of the ASEAN countr es and the Government of Japan shall contribute to the expenses of the Provisional Centre, in accordance with the respective national laws and regulations and within the limits of their respective budgetary appropriations, with an agreed amount of money necessary for the operation and activities of the Provisional Centre.
日本国政府は、振興のための展示に供されるアセアン諸国の物品及び資材であつて展示の後適当と認められる場合に無料試供品として配布されることのあるものの輸入に関し国内法令に従い、免税輸入を許与し、及びあらゆる便宜を与える。日本国政府は、また、それらの物品及び資材の展示の後における販売を援助するため、関係法令に従い、あらゆる便宜を与える。
The Government of Japan shall, in accordance with its relevant laws and regulations, give duty free entry and every facility to assist in the import of ASEAN goods and materials for promotional display and, where appropriate, for subsequent distribution of such goods and materials as free samples. The Government of Japan shall also, in accordance with its relevant laws and regulations, give every facility to assist in the subsequent sales of such goods and materials.
本使は、更に、この書簡及びアセアン加盟国政府のために前記のことを確認される閣下の返簡が合意を構成するものとみなし、かつ、その合意が閣下の返簡の日付の日に効力を生じ、その後一年が満了する日又はアセアン貿易投資観光促進センターを設立する協定が発効する日のいずれか早い方の日まで効力を有することを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's reply confirming the foregoing on behalf of the Governments of the member countries of ASEAN shall be considered as constituting an agreement, which will enter into force on the date of Your Excellency's reply and remain in force until expiration of one year or entry into force of the agreement establishing the ASEAN Promotion Centre on Trade, Investment and Tourism, whichever is earlier.

Excellency, I have the honour to acknowledge receipt of Your Excellency's Note of today's date, which reads as follows:

本使は、更に、アセアン加盟国政府に代わつて前記のことを確認するとともに、閣下の書簡及びこの書簡が合意を構成するものとみなし、かつ、その合意がこの返簡の日付の日に効力を生じ、その後一年が満了する日又はアセアン貿易投資観光促進センターを設立する協定が発効する日のいずれか早い方の日まで効力を有することに同意する光栄を有します。
I have further the honour to confirm the foregoing on behalf of the Governments of the member countries of ASEAN and to agree that Your Excellency's Note and this Note shall be considered as constituting an agreement, which will enter into force on the date of this reply and remain in force until expiration of one year or entry into force of the Agreement establishing the ASEAN Promotion Centre on Trade, Investment and Tourism, whichever is earlier.
