南氷洋捕鯨規制取極

ARRANGEMENT FOR THE REGULATION OF ANTARCTIC PELAGIC WHALING

　千九百四十六年十二月二日にワシントンで署名された国際捕鯨取締条約(以下「条約」という。)の締約政府である日本国、ノールウェー王国及びソヴィエト社会主義共和国連邦の政府は、

　The Governments of Japan, of the Kingdom of Norway and of the Union of Soviet Socialist Republics, being Parties to the International Convention for the Regulation of whaling, signed at Washington on December 2,1946 (hereafter referred to as "the Convention"):

　次の取極を協定した。

　Have agreed upon the following arrangements:

第一条
　この取極の適用上、「解禁期」とは、条約の附表７(ａ)の規定に基づき南氷洋においてひげ鯨の捕獲が許される期間をいう。

Article 1
　For the purpose of the present Arrangement, the term "season" shall mean the season during which the taking of baleen whales in the Antarctic is permitted under paragraph 7 (a) of the Schedule to the Convention.

第二条
　条約に基づいて認められた南緯四十度以南の水域における母船によるながす鯨及びいわし鯨(にたり鯨を含む。)の年間総捕獲頭数は、次のとおり署名政府の国の間に配分する。

Article 2
　The total annual catches of fin whales and sei and Bryde's whales combined, authorized under the Convention to be taken in waters south of 40° South Latitude by pelagic expeditions, shall be allocated among the countries of the signatory Governments in the following manner:

　Japan.............1,142 fin whales
                  2,919 sei and Bryde's whales combined

　ノールウェー　　　　　　　　　　　ながす鯨　　　　　四〇頭いわし鯨(にたり鯨を含む。)一二〇頭

　Norway.............40 fin whales
                   120 sei and Bryde's whales combined

　ソヴィエト社会主義共和国連邦　　　ながす鯨　　　　七六八頭いわし鯨(にたり鯨を含む。)一、九六一頭

　Union of Soviet
Socialist Republics 768 fin whales
                    1,961 sei and Bryde's whales combined

第三条
　第二条に定める割当額は、一国から他国に譲渡することができない。

Article 3
　The allocations mentioned in Article 2 are not transferable as between one country and another.

第四条
　この取極の締約政府でない政府の管轄下にある母船が南氷洋捕鯨に従事し、かつ、当該政府が条約の締約政府であり又は締約政府となつた場合には、この取極は、終了する。

Article 4
　If a factory ship under the jurisdiction of a Government which is not a party to the present Arrangement should engage in Antarctic pelagic whaling and that Government is or becomes a Party to the Convention, the present Arrangement shall be terminated.

第五条
　この取極は、前文に掲げる政府によつて署名された日に効力を生ずる。

Article 5
　The present Arrangement shall enter into force on the day upon which it is signed by the Governments referred to in the preamble.

第六条
　この取極は、千九百七十二年・千九百七十三年解禁期の終了まで実施する。

Article 6
　The present Arrangement shall be operative until the end of the 1972/73 season.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの取極に署名した。

　In witness whereof the undersigned, being duly authorized thereto by their respective Governments, have signed the present Arrangement.

　千九百七十二年八月一日にモスクワで英語により本書一通を作成した。本書は、ソヴィエト社会主義共和国連邦政府に寄託する。ソヴィエト社会主義共和国連邦政府は、その認証謄本を他のすべての署名政府に送付する。

　Done at Moscow the first day of August, 1972, in the English language in a single copy which shall be deposited in the archives of the Government of the Union of Soviet Socialist Republics.

　The Government of the Union of Soviet Socialist Republics shall transmit certified copies thereof to all other signatory Governments.
