東南アジア貿易投資観光促進センターに関する協定
AGREEMENT ON THE SOUTHEAST ASIAN PROMOTION CENTRE FOR TRADE, INVESTMENT AND TOURISM
この協定の締約政府は、
The Governments Parties to the present Agreement,
輸出の増加、投資の流れ及び観光を促進することが東南アジアの経済開発にとつてきわめて重要であることを認め、
Recognizing the vital importance of promoting an increase in exports, flow of investments and tourism in the economic development of Southeast Asia;
その目的を達成するためには、地域的基礎に基づく協同の努力がきわめて効果的であることを確信して、
Convinced that cooperative efforts on a regional basis are highly effective in achieving such objectives;
以下の規定に従つて運営される東南アジア貿易投資観光促進センター(以下「センター」という。)をこの協定によつて設立することを合意した。
Have agreed to establish hereby the Southeast Asian Promotion Centre for Trade, Investment and Tourism, hereinafter called the "Centre", which shall operate in accordance with the following provisions:
第一条 目的
ARTICLE 1 Purpose
センターは、センターの加盟政府(以下「加盟政府」という。)の間の協力により、また、この協定の締約者でない政府及び機関との協力により、東南アジア諸国からの輸出を促進し、東南アジア地域への投資の流入を促進し、並びに同地域への及び同地域を通じての観光客の往来を増加させることを目的とする。
The purpose of the Centre is to promote exports from Southeast Asian countries, to accelerate the inflow of investments to the region and to increase tourist traffic to and through the region by mutual cooperation among the member governments of the Centre, hereinafter called the "Members", and through collaboration with governments and organizations which are not parties to this Agreement.
第二条 活動
ARTICLE 2 Activities
センターは、次の活動を行なうことができる。
The Centre may undertake the following activities:
(i) 博覧会、見本市、観光展その他これらに類する展覧会を開催し若しくはこれらに参加し、又はその開催若しくは参加を斡旋すること。
(i) to hold or participate in, or to exercise its good offices in holding or participating in, expositions, trade fairs, tourism exhibitions and other similar exhibitions;
(ii) 東南アジア地域内の産品、産業及び観光資源を紹介し及び宣伝すること。
(ii) to introduce and publicize products, industries, and tourist resources in the region;
(iii) 貿易、投資及び観光に関し、斡旋を行ない及び助言を与えること。
(iii) to exercise its good offices and give advice on trade, investment and tourism;
(iv) 貿易、投資及び観光に関する情報を収集し及び分析すること。
(iv) to collect and analyse information related to trade, investment and tourism;
(v) 貿易、投資及び観光に関する調査及び研究を行なうこと。
(v) to undertake researches and studies related to trade, investment and tourism;
(vi) 貿易、投資及び観光に関する情報並びにセンターによる調査及び研究の結果を関係のある機関及び人に提供すること。
(vi) to provide related organizations and persons with information on trade, investment and tourism as well as the results of researches and studies by the Centre;
(vii) 貿易、投資及び観光に関する技術協力を容易にするため斡旋を行なうこと。
(vii) to exercise its good offices in facilitating technical cooperation related to trade, investment and tourism; and
(viii) (i)から(vii)までに掲げる活動のほかに、センターの目的の達成に必要な事項を取り扱うこと。
(viii) in addition to the activities referred to in (i) to (vii) of this Article, to handle matters necessary for the achievement of the purpose of the Centre.
第三条 加盟政府の地位
ARTICLE 3 Membership
1 東南アジア経済開発閣僚会議の参加国及び同会議に招請された国、すなわち、ビルマ連邦、インドネシア共和国、日本国、カンボディア共和国、ラオス王国、マレイシア、フィリピン共和国、シンガポール共和国、タイ王国及びヴィエトナム共和国の政府は、センターの加盟政府となる資格を有し、この協定に署名することにより加盟政府となる。
1. The Governments of countries participating in and invited to the Ministerial Conference for the Economic Development of Southeast Asia, namely, the Union of Burma, the Republic of Indonesia, Japan, the Khmer Republic, the Kingdom of Laos, Malaysia, the Republic of the Philippines, the Republic of Singapore, the Kingdom of Thailand and the Republic of VietNam shall be entitled to membership in the Centre and shall become Members upon signature of this Agreement.
2 1の政府以外の政府は、理事会のすべての理事の全会一致によりセンターの加盟政府となることを認められる。
2. Governments which are not referred to in paragraph 1 of this Article may be admitted to membership in the Centre by a unanimous vote of all Directors of the Council.
第四条 組織
ARTICLE 4 Organization
センターに、理事会及び事務局を置く。
The Centre shall have a Council and a Secretariat.
第五条 理事会
ARTICLE 5 Council
1 理事会は、理事で構成する。各加盟政府は、一人の理事を指名する。
1. The Council shall be composed of Directors. Each Member shall designate one Director.
2 各加盟政府は、その理事が不在の際にその理事のすべての権限を行使する一人の理事代理を任命することができる。
2. Each Member may appoint an Alternate Director who shall exercise all the powers of its Director in his absence.
3 理事会は、輪番制により理事のうち一人を議長に指名する。
3. The Council shall designate, by rotation, one of the Directors as Chairman.
4 理事会は、次の権限及び任務を有する。
4. The Council shall have the following powers and functions:
(i) センターの運営及び所在地に関する実行計画及び事業計画を決定すること。
(i) to decide on the Plan of Operation and the Working Programme of activities concerning the operation and location of the Centre;
(ii) センターの年次計画並びにセンターの収入及び支出に関する年次予算を採択すること。
(ii) to adopt the annual programme and the annual budget of revenues and expenditures of the Centre;
(iii) センターの運営に関する年次報告を承認すること。
(iii) to approve the annual report on the operation of the Centre;
(iv) 新たな加盟政府の加盟を承認すること。
(iv) to admit new Members;
(v) 事務局長を任命すること。
(v) to appoint the Secretary-General;
(vi) 第七条2の援助の受入れを決定すること。
(vi) to decide to receive assistance referred to in Article 7, paragraph 2 of this Agreement;
(vii) 第八条7の規定に基づくこの協定の改正を採択すること。
(vii) to adopt amendments to this Agreement in accordance with the provisions of Article 8, paragraph 7;
(viii) センターの解散の際におけるセンターの財産及び資産の処分の方法を決定すること。
(viii) to decide on the manner in which the property and assets of the Centre shall be disposed of in case of the dissolution of the Centre; and
(ix) (i)から(viii)までに掲げる権限及び任務のほかに、センターに関する重要な事項につき決定を行ない又は承認を与えること。
(ix) in addition to the powers and functions referred to in (i) to (viii) of this paragraph, to decide and/or approve the important matters concerning the Centre.
5 理事会は、年次会合を開催するほか、理事会が定め、又は事務局長が理事会の議長の承認を得て招集する会合を開催する。事務局長は、理事の過半数から要請があつたときは、理事会の会合を招集する。理事会の最初の会合は、日本国政府が招集する。
5. The Council shall hold an annual meeting and such other meeting as may be decided by the Council or called by the Secretary-General with the approval of the Chairman of the Council. A meeting of the Council shall be called by the Secretary-General whenever requested by a majority of the Directors. The inaugural meeting of the Council shall be called by the Government of Japan.
第六条 事務局
ARTICLE 6 Secretariat
1 事務局は、事務局長及び事務局職員で構成する。
1. The Secretariat shall consist of a Secretary-General and Secretariat staff.
2 事務局長は、センターを代表し、理事会を補佐し、かつ、理事会に対して責任を負うものとし、このため、この協定により明示的に与えられる権限のほかに、理事会から委任されるすべての権限を行使する。
2. The Secretary-General shall represent the Centre and assist the Council, to which he shall be responsible, and, for this purpose, shall, in addition to the powers assigned to him expressly by this Agreement, exercise all the powers delegated to him by the Council.
3 事務局長の任期は、三年とし、事務局長は、再任されることができる。
3. The term of office of the Secretary-General shall be three years and he may be re-appointed.
4 事務局の上級職員は、事務局長が、能力及び地域的基礎に基づき、理事会の承認を得て任命する。事務局のその他の職員は、事務局長が任命する。
4. The senior staff of the Secretariat shall be appointed by the Secretary-General on a merit and regional basis with the approval of the Council; other personnel of the Secretariat shall be appointed by the Secretary-General.
第七条 財政
ARTICLE 7 Finance
1 加盟政府は、それぞれの国内法令に従い、かつ、それぞれの毎年の予算の範囲内で、センターに対し、その設立及び運営に必要な合意された額の金銭、動産、不動産及び役務を提供する。
1. The Members shall provide the Centre, in accordance with their respective national laws and regulations and within the limits of their respective annual budgetary appropriations, with an agreed amount of money, movable and immovable property and services necessary for the establishment and the operation of the Centre.
2 センターは、理事の総数の三分の二以上の多数票による議決で、この協定の締約者でない政府及び機関から援助を受けることができる。
2. The Centre may, by a two-thirds majority vote of the total number of the Directors, receive assistance from governments and organizations which are not parties to this Agreement.
第八条 最終規定
ARTICLE 8 Final Provisions
1 この協定は、第三条1の国の政府による署名のため開放しておく。
1. This Agreement shall remain open for signature by the Governments of the countries referred to in Article 3, paragraph 1 of this Agreement.
2 この協定は、少なくとも五の政府がこれに署名した日に効力を生ずる。
2. This Agreement shall enter into force on the date on which at least five (5) Governments have signed this Agreement.
3 この協定は、2の規定に基づいて効力を生じた日の後にこれに署名する各政府については、その署名の日に効力を生ずる。
3. For each Government signing this Agreement after the date on which it has entered into force pursuant to the preceding paragraph, this Agreement shall enter into force on the date of its signature.
4 この協定は、第三条2の規定に従つてセンターの加盟政府となることを認められた政府については、その加入書がこの協定の寄託政府に寄託された日に効力を生ずる。
4. For governments which have been admitted to membership in the Centre in accordance with the provisions of Article 3, paragraph 2 of this Agreement, it shall enter into force on the date of the deposit of their instruments of accession with the Depositary Government of this Agreement.
5 いずれの加盟政府も、この協定の寄託政府にあてた書面による通告により、いつでもこの協定から脱退することができる。脱退は、その通告が行なわれたセンターの会計年度の終りに効力を生ずる。
5. Any Member may withdraw from this Agreement at any time by written notification addressed to the Depositary Government of this Agreement. Such withdrawal shall become effective at the end of the fiscal year of the Centre in which such notification is made.
6 この協定は、五年間効力を有するものとし、その後も、すべての加盟政府の合意によりさらに一定の期間引き続き効力を有することができる。
6. This Agreement shall remain in force for five years, and thereafter may be extended for an additional fixed period or periods by the agreement of all Members.
7 いずれの加盟政府も、この協定の改正を提案することができる。
7. Any Member may propose an amendment to this Agreement.
いかなる改正も、すべての加盟政府が受諾した後にのみ効力を生ずる。
Any amendment shall come into force only after is has been accepted by all Members.
8 この協定の原本は、日本国政府に寄託するものとし、同政府は、その認証謄本を加盟政府に送付する。
8. The Original of this Agreement shall be deposited with the Government of Japan, who shall send certified copies thereof to the Members.
以上の証拠として、下名の代表者は、各自の政府から正当に委任を受けて、この協定に署名した。
IN WITNESS WHEREOF the undersigned representatives, being duly authorized thereto by their respective Governments, have signed the present Agreement.
