北太平洋のおつとせい保存に関する暫定条約の延長に関する日本国政府とアメリカ合衆国政府との間の交換公文

　本国務長官は、千九百五十七年二月九日にワシントンで署名され、かつ、千九百六十三年十月八日にワシントンで署名された議定書により改正された北太平洋のおつとせいの保存に関する暫定条約の当事国政府の駐在使節代表閣下に敬意を表するとともに、別添写しの北太平洋おつとせい委員会議長から受領した千九百六十八年十月十三日付けの書簡に言及する光栄を有します。アメリカ合衆国政府は、前記の条約の各当事国が同様の書簡を受領しているものと了解いたします。アメリカ合衆国政府は、この条約の目的の達成に悪影響を与えることなく陸上猟獲との関連において海上猟獲を行なうことが一定の状況下において許容されるかどうかを決定するための研究を継続するという北太平洋おつとせい委員会の勧告にかんがみ、改正された条約をさらに一定の期間引き続き有効とすることが当事国にとつて適当であるという委員会議長の意見に同意いたします。

　The Secretary of State presents his compliments to Their Excellencies and Messieurs the Chiefs of Mission of the Governments concerned with the Interim Convention on Conservation of North Pacific Fur Seals signed at Washington on February 9, 1957, as amended by the Protocol signed at Washington on October 8, 1963, and has the honor to refer to a letter dated October 13, 1968 received from the Chairman of the North Pacific Fur Seal Commission, a copy of which is enclosed. It is the understanding of the Governmnent of the United States that similar letters have been received by each of the Parties to the above-mentioned Convention.


　

　In view of the recommendation by the North Pacific Fur Seal Commission that studies be continued to determine whether or not pelagic sealing in conjunction with land sealing could be permitted in certain circumstances without adversely affecting achievement of the objectives of the Convention, the Government of the United States agrees with the Chairman of the Commission that it would be in order for the Parties to continue the amended Convention in force for an additional period of time.


　アメリカ合衆国政府は、当事国が、改正された条約の第十三条4の規定に関し、同条約は十八年間有効とし、その後は新たな若しくは改正されたおつとせい条約が当事国の間で効力を生ずる時又は前記の十八年の期間の後一年が経過する時のいずれか早い時まで引き続き有効とすること及び条約第十一条の規定に関し、当事国が、委員会によつて新たな勧告が行なわれた後、条約の第十八年度の初期までの相互に受諾可能な時に同条に規定する目的のために会合することに同意するものと了解いたします。

　It is the understanding of the Government of the United States that the Parties agree, with reference to Article XIII, paragraph 4, of the amended Convention, that the Convention as amended shall continue in force for eighteen years and thereafter until the entry into force of a new or revised fur seal convention between the Parties, or until the expiration of one year after such period of eighteen years, whichever may be earlier, and, with reference to Article XI, that the Parties shall meet for the purposes set forth in that Article at a mutually acceptable time, not later than early in the eighteenth year, after further recommendations have been made by the Commission.


　アメリカ合衆国政府は、さらに、ここに示されているとおり条約の第十二年度の初期の当事国の会合の目的がすでに達成されているので、その会合は必要でないと了解いたします。

　It is further the understanding of the Government of the United States that a meeting of the Parties early in the twelfth year of the Convention will be unnecessary, the purposes of such meeting already having been accomplished as herein indicated.


　アメリカ合衆国政府は、ここに前記の了解を確認するとともに、他の当事国からこの了解の文書による確認を受領できれば幸いであります。アメリカ合衆国政府は、このような確認書を受領したときは、それを他の当事国に通知する用意があります。

　The Government of the United States hereby confirms the foregoing understanding on its part and would appreciate receiving written confirmations of such understandings by the other Parties. The Government of the United States will be pleased to notify such Parties of confirmations when received.

　Dear Sir:


　書簡をもつて啓上いたします。千九百六十三年十月八日に署名された議定書によつて改正された北太平洋のおつとせいの保存に関する暫定条約の第五条2(e)には、北太平洋おつとせい委員会は、他の研究のほか、「この条約の目的の達成に悪影響を与えることなく、陸上猟獲との関連において海上猟獲を行なうことが一定の状況下において、できうるかどうかを研究して、この条約の効力発生の後十一年の期間を経過した時にそれについて、ヽヽヽヽヽヽヽ当事国に勧告する」と規定しています。

　Article V, paragraph 2(e), of the Interim Convention on Conservation of North Pacific Fur Seals, as amended by the Protocol signed on October 8, 1963, provides that the North Pacific Fur Seal Commission, in addition to other duties, shall "study whether or not pelagic sealing in conjunction with land sealing could be permitted in certain circumstances without adversely affecting achievement of the objectives of this Convention, and make recommendations thereon to the Parties at the end of the eleventh year after entry into force of this Convention x x x x x." 


　本官は、委員会議長として、貴国政府に対し、委員会が千九百六十八年四月八日から十二日までソヴィエト社会主義共和国連邦のモスクワで開催されたその第十一回会合において第五条2(e)の規程を検討し、それについての勧告を次のとおり作成したことを通報する光栄を有します。

　As Chairman of the Commission, I have the honor to inform your Government that the Commission considered Article V-2(e) at its Eleventh Meeting, held in Moscow, U.S.S.R., April 8-12, 1968, and formulated a recommendation thereon as follows: 


　「委員会は、北太平洋のおつとせいの保存に関する暫定条約の第五条2(e)の規定に基づく要請に従い、この条約の目的の達成に悪影響を与えることなく、陸上猟獲との関連において海上猟獲を行なうことが一定の事情の下において、できるかどうかを決定するために研究を行なつた。これらの研究は、現段階においては委員会がこの問題について最終的決定を行なうために十分な資料を提供していない。したがつて委員会は、当事国に対し、条約の規定に従つて研究を継続するよう勧告する。」

　"As required under Article X-2(e) of the Iterim Convention on Conservation of North Pacific Fur Seals, the Commission has conducted studies to determine whether or not pelagic sealing in conjunction with land sealing could be permitted in certain circumstances without adversely affecting achievement of the objectives of the Convention. These studies have not provided sufficient data to permit the Commission to reach a final decision on this matter at this time and the Commission, therefore, recommends to the Parties that the studies be continued in accordance with the provisions of the Convention."


　この問題に関する研究を継続するという委員会の勧告を四の当事国が承認する場合には、本官は、改正された条約をさらに一定の期間引き続き有効とすることが当事国にとつて適当であると思います。本官は、アメリカ合衆国が条約の寄託国政府として近い将来この問題について他の当事国に提案を行なうものと了解いたします。

　If the four Parties approve the recommendation of the Commission that the studies on this question be continued, it seems to me that it would be in order for the Parties to continue the amended Convention in force for an additional period of time. I understand that the United States, as the Depositary Government for the Convention, will submit a proposal on this matter to the other Governments in the near future.

　The Canadian Embassy presents its compliments to the Secretary of State and has the honour to refer to the Secretary's Note of March 19, 1969 concerning the Interim Convention on Conservation of North Pacific Fur Seals signed at Washington on February 9, 1957, as amended by the Protocol signed at Washington on October 8, 1963.
