南氷洋捕鯨規制取極

ARRANGEMENT FOR THE REGULATION OF ANTRACTIC PELAGIC WHALING

　千九百四十六年十二月二日にワシントンで署名された国際捕鯨取締条約(以下「条約」という。)の締約政府であるノールウェー王国、日本国及びソヴィエト社会主義共和国連邦の政府は、

　The Governments of the Kingdom of Norway, of Japan and of the Union of Soviet Socialist Republics, being Parties to the International Convention for the Regulation of Whaling, signed at Washington on December 2, 1946 (hereinafter referred to as "the Convention");

　次の取極を協定した。

　Have agreed upon the following arrangements:

第一条
　この取極の適用上、「漁期」とは、条約の附表７(a)の規定に基づいて南氷洋においてひげ鯨の捕獲が許される期間をいう。

ARTICLE 1
　For the purpose of the present Arrangement, the term "season" shall mean the season during which the taking of baleen whales in the Antarctic is permitted under paragraph 7(a) of the Schedule to the Convention.

第二条
　条約に基づいて認められた南緯四十度以南の水域における母船によるひげ鯨の年間総捕獲頭数は、次のとおり署名政府の国の間に配分する。

ARTICLE 2
　The total annual catch of baleen whales authorized under the Convention to be taken in waters south of 40° South Latitude by pelagic expeditions shall be allocated among the countries of the signatory Governments in the following manner:

　ノールウェー　七百三十一しろながす鯨単位

　Norway .................................. 731 blue whale units

　日本国　千四百九十三しろながす鯨単位

　Japan ................................... 1,493 "

　ソヴィエト社会主義共和国連邦　九百七十六しろながす鯨単位

　Union of Soviet Socialist Republics ..... 976 "

第三条
　第二条に定める割当額は、一国から他国に譲渡することができない。

ARTICLE 3
　The allocations mentioned in Article 2 are not transferable as between one country and another.

第四条
　この取極の締約政府でない政府の管轄下にある母船が南氷洋捕鯨に従事し、かつ、当該政府が条約の締約政府であるか、又は締約政府となつた場合には、この取極は、終了する。

ARTICLE 4
　If a factory ship under the jurisdiction of a Government which is not a party to the present Arrangement should engage in Antarctic pelagic whaling and that Government is or becomes a Party to the Convention, the present Arrangement shall be terminated.

第五条
　この取極は、前文に掲げるすべての政府によつて署名された日に効力を生ずる。

ARTICLE 5
　The present Arrangement shall enter into force on the day upon which it is signed by all the Governments referred to in the Preamble.

第六条
　この取極は、千九百六十七年・千九百六十八年漁期の終了まで実施する。

ARTICLE 6
　The present Arrangement shall be operative until the end of the 1967-68 season.

　以上の証拠として、下名は、このため各自の政府から正当に委任を受け、この取極に署名した。

　In witness whereof the undersigned, being duly authorized thereto by their respective Governments, have signed the present Arrangement.

　千九百六十七年九月十九日にオスロで英語により本書一通を作成した。本書は、ノールウェー政府に寄託する。ノールウェー政府は、その認証謄本を他のすべての署名政府に送付する。

　Done at Oslo the nineteenth day of September 1967 in the English language in a single copy which shall be deposited in the archives of the Government of Norway. The Government of Norway shall transmit certified copies thereof to all other signatory Governments.
