THIRD PROCES-VERBAL EXTENDING THE DECLARATION ON THE PROVISIONAL ACCESSION OF ARGENTINA TO THE GENERAL AGREEMENT ON TARIFFS AND TRADE

　関税及び貿易に関する一般協定(以下「一般協定」という。)へのアルゼンティンの暫定的加入に関する千九百六十年十一月十八日の宣言(以下「宣言」という。)の当事国は、

　The parties to the Declaration of 18 November 1960 on the Provisional Accession of Argentina to the General Agreement on Tariffs and Trade (hereinafter referred to as "the Declaration" and "the General Agreement", respectively),

　宣言4の規定に従つて行動して、

　ACTING pursuant to paragraph 4 of the Declaration,

　次のとおり協定する。

　AGREE that

1　宣言の有効期間は、4に規定する日付を「千九百六十七年十二月三十一日」に改めることによつてさらに一年間延長される。

1. The period of validity of the Declaration is extended for a further year by changing the date in paragraph 4 to "31 December 1967".

2　この調書は、一般協定の締約国団の事務局長に寄託されるものとする。この調書は、アルゼンティン及び宣言の参加国政府により署名その他によつて受諾されるため、開放される。この調書は、アルゼンティン政府及びいずれかの参加国政府がこれを受諾した後直ちにこれらの両国政府の間で効力を生ずる。

2. This Proces-Verbal shall be deposited with the Director-General to the CONTRACTING PARTIES to the General Agreement. It shall be open for acceptance, by signature or otherwise, by Argentina and by the participating governments. It shall become effective between the Government of Argentina and any participating government as soon as it shall have been accepted by the Government of Argentina and such government.

3　事務局長は、アルゼンティン政府、一般協定の各締約国及び一般協定に暫定的に加入した各政府に対し、この調書の認証謄本を送付し、また、この調書の各受諾を通告するものとする。

3. The Director-General shall furnish a certified copy of this Proces-Verbal and a notification of each acceptance thereof to the Government of Argentina, to each contracting party to the General Agreement and to each government which has acceded provisionally thereto.

　アルゼンティン政府及びこの宣言を受諾した他の政府(以下「参加国政府」という。)は、

　The Government of Argentina and the other governments on behalf of which this Declaration has been accepted (the latter governments being hereinafter referred to as the "participating governments"),

　アルゼンティン政府が千九百六十年九月二十一日に関税及び貿易に関する一般協定(以下「一般協定」という。)第三十三条の規定に基づいて一般協定に加入することを正式に申請したこと、及び同政府が一般協定第三十三条の規定に基づく加入に先だつて行なわれなければならないと認められる関税交渉をアルゼンティンの新たな関税が効力を生じた後直ちに一般協定の締約国と開始する用意があることを考慮し、

　CONSIDERING that the Government of Argentina on 21 September 1960 made a formal request to accede to the General Agreement on Tariffs and Trade (hereinafter referred to as the "General Agreement") in accordance with the provisions of Article XXXIII of the General Agreement, and that that Government will be prepared to conduct the tariff negotiations with contracting parties, which it is considered should precede accession under Article XXXIII, as soon as its new customs tariff enters into force,

　重要な貿易国でありかつ一般協定の締約国団が現在検討している千九百六十年二月十八日のモンテヴィデオ条約の署名国であるアルゼンティンが、一般協定第三十三条の規定に基づく一般協定への加入の前の一段階として、一般協定に暫定的に加入するよう招請されることが望ましいということを考慮し、

　CONSIDERING the desirability of Argentina, an important trading country which is a signatory of the Montevideo Treaty of 18 February 1960, currently being considered by the CONTRACTING PARTIES, being invited to accede provisionally to the General Agreement as a step towards its eventual accession pursuant to Article XXXIII:

1　アルゼンティンが一般協定の締約国と関税交渉を終了した後一般協定第三十三条の規定に基づいて一般協定へ加入するまでの間、参加国政府とアルゼンティン政府との間の通商関係が、次の規定に従うことを条件として、一般協定の規定に基づくものであることを宣言する。

1. DECLARE that, pending the accession of Argentina to the General Agreement under the provisions of Article XXXIII, which will be preceded by the conclusion of tariff negotiations with contracting parties to the General Agreement, the commercial relations between the participating governments and Argentina shall be based upon the General Agreement, subject to the following conditions:

(a)　アルゼンティン政府は、暫定的に、かつ、この宣言の規定に従い、(i)一般協定第一部及び第三部の規定、並びに(ii)この宣言の日付の日に有効なアルゼンティンの法令に反しない最大限度において、一般協定第二部の規定を適用しなけばならない。一般協定第一条１に定める義務で第三条の規定に関連するもの及び第二条2(b)に定める義務で第六条の規定に関連するものは、この項の規定の適用上、一般協定第二部に属するものとする。

(a) The Government of Argentina shall apply provisionally and subject to the provisions of this Declaration (i) Parts I and III of the General Agreement, and (ii) Part II of the General Agreement to the fullest extent not inconsistent with its legislation existing on the date of this Declaration; the obligations incorporated in paragraph 1 of Article I of the General Agreement by reference to Article III thereof and those incorporated in paragraph 2(b) of Article II by reference to Article VI shall be considered as falling within Part II of the General Agreement for the purpose of this paragraph.

(b)　アルゼンティンは、一般協定第一条の最恵国待遇に関する規定に基づいて一般協定に附属している譲許表に定める譲許の利益を受ける場合において、一般協定第二条その他の条の規定に基づく譲許について、いかなる直接の権利も有しない。

(b) While Argentina under the most-favourednation provisions of Article I of the General Agreement will receive the benefit of the concessions contained in the schedules annexed to the General Agreement, it shall not have any direct rights with respect to those concessions either under the provisions of Article II or under the provisions of any other Article of the General Agreement.

(c)　一般協定第五条6、第七条4(d)及び第十条3(c)中同協定の日付に言及する場合において、アルゼンティンについては、これをこの宣言の日付と読み替えて、適用する。

(c) In each case in which paragraph 6 of Article V, sub-paragraph 4(d) of Article VII, and sub-paragraph 3(c) of Article X of the General Agreement, refer to the date of that Agreement, the applicable date in respect of Argentina shall be the date of this Declaration.

(d)　一般協定第一条1の規定にもかかわらず、この宣言は、アルゼンティンによりボリヴィア、ブラジル、チリ、パラグァイ、ペルー及びウルグァイのうち一又は二以上の国に対して排他的に与えている輸入税又は課徴金に関する優遇措置をアルゼンティンが除去することを要求するものではない。ただし、前記の優遇措置は、この宣言の日付の日において実施されている水準を上まわらないものとする。さらに、この宣言はボリヴィアに与えられている前記の優遇措置を変更することを妨げるものではない。ただし、変更された前記の優遇措置の一般的水準は、この宣言の日付の日にアルゼンティンによつてボリヴィアに与えられている優遇措置の一般的水準から実質的に離れたものであつてはならない。この項のいかなる規定も、自由貿易地域の形成に関する一般協定の規定に基づく利益についてのアルゼンティンの権利に影響を及ぼすものではない。

(d) Notwithstanding the provisions of paragraph 1 of Article I of the General Agreement, this Declaration shall not require the elimination by the Government of Argentina of any preferences in respect of import duties or charges accorded by Argentina exclusively to one or more of the following countries: Bolivia, Brazil, Chile, Paraguay, Peru, and Uruguay; provided, however, that these preferences do not exceed the levels in effect on the date of this Declaration. Moreover, it shall not prevent the modification of such preferences accorded to Bolivia provided that the general level of such modified preferences does not differ substantially from the general level of the preferences accorded by Argentina to Bolivia on the date of this Declaration. Nothing in this paragraph will affect the right of Argentina to benefit from the provisions of the General Agreement relating to the formation of a free-trade-area.

(e)　アルゼンティンが適用する一般協定の規定は、国際連合貿易雇用会議準備委員会第二会期の最終議定書に附属する協定文に含まれている規定で、この宣言の日付の日までに効力を生じた文書により訂正、改正、補足その他の修正が行なわれた規定とする。

(e) The provisions of the General Agreement to be applied by Argentina shall be those contained in the text annexed to the Final Act of the second session of the Preparatory Committee of the United Nations Conference on Trade and Employment as rectified, amended, supplemented, or otherwise modified by such instruments as may have become effective by the date of this Declaration.

2　アルゼンティン及び参加国政府は、一般協定の締約国団(以下「締約国団」という。)に対し、この宣言の実施のために必要な措置をとることを要請する。

2. REQUEST the CONTRACTING PARTIES to the General Agreement (hereinafter referred to as the "CONTRACTING PARTIES") to perform such functions as are necessary for the implementation of this Declaration.

3　締約国団が三分の二の多数によつて承認したこの宣言は、締約国団の書記局長に寄託する。この宣言は、アルゼンティン、一般協定の締約国及び一般協定に暫定的に加入したいずれかの政府により署名その他によつて受諾されるため、開放される。

3. This Declaration, which has been approved by the CONTRACTING PARTIES by a two-thirds majority shall be deposited with the Executive Secretary of the CONTRACTING PARTIES. It shall be open for acceptance, by signature or otherwise, by Argentina, by contracting parties to the General Agreement and by and governments which shall have acceded provisionally to the General Agreement.

4　この宣言は、アルゼンティン及びいずれかの参加国政府の双方が受諾した日の後三十日目に、アルゼンティンとその締約国との間で効力を生ずる。この宣言は、一般協定第三十三条の規定に基づいてアルゼンティン政府が一般協定に加入する時又は千九百六十二年十二月三十一日のいずれか一層早い日まで効力を有する。ただし、アルゼンティンと参加国政府との間でこの宣言の有効期間を一層おそい日まで延長する旨を同意した場合は、その限りでない。

4. This Declaration shall become effective between Argentina and any participating government on the thirtieth day following the day upon which it shall have been accepted on behalf of both Argentina and that government; it shall remain in force until the Government of Argentina accedes of the General Agreement under the provisions of Article XXXIII thereof or until 31 December 1962 whichever date is earlier, unless it has been agreed between Argentina and the participating governments to extend its validity to a later date.

5　締約国団の書記局長は、すみやかに、この宣言がその受諾のために開放される各政府に対し、この宣言の認証謄本を送付し、また、この宣言の各受諾について通告するものとする。

5. The Executive Secretary of the CONTRACTING PARTIES shall promptly furnish a certified copy of this Declaration, and a notification of each acceptance thereof, to each government to which this Declaration is open for acceptance.

1. The period of validity of the Declaration of 18 November 1960 is extended for two years by changing the date in paragraph 4 from "31 December 1962" to "31 December 1964".

2　この調書は、一般協定の締約国団の書記局長に寄託される。この調書は、アルゼンティン、千九百六十年十一月十八日の宣言への参加国政府、一般協定の締約国及びその後に千九百六十年十一月十八日の宣言を受諾するその他の政府により署名その他の方法によつて受諾されるため、開放しておく。

2. This Proces-Verbal shall be deposited with the Executive Secretary of the CONTRACTING PARTIES to the General Agreement. It shall remain open for acceptance, by signature of otherwise, by Argentina, by the participating governments to the Declaration of 18 November 1960, and by contracting parties to the General Agreement and other governments following their acceptance of the Declaration of 18 November 1960.

3　この調書は、千九百六十年十一月十八日の宣言のすべての当事国による受諾の時に効力を生ずる。ただし、千九百六十二年十二月三十一日までにこれらのすべての当事国によつて受諾されなかつた場合には、

3. This Proces-Verbal shall enter into force upon its acceptance by all the parties to the Declaration of 18 November 1960; provided that if it shall not have been accepted by all such parties by 31 December 1962,

(a)　この調書は、アルゼンティンその他のこの宣言の当事国については、その受諾の後直ちに効力を生じ、また、

(a) it shall enter into force in respect of those parties thereto which shall have accepted it as soon as it shall have been accepted by Argentina and any other such party; and

(b)　その後にこの調書を受諾するこの宣言の当事国については、その受諾の時又はその当事国について千九百六十年十一月十八日の宣言が効力を生ずる時のいずれか一層おそい時に効力を生ずる。

(b) it shall enter into force for any such party subsequently accepting it upon such acceptance or upon the entry into force of the Declaration of 18 November 1960 in respect of such party, whichever is the later.

4　書記局長は、アルゼンティン政府、一般協定の各締約国、一般協定への加入のための交渉を開始した各政府及び一般協定に暫定的に加入した各政府に対し、この調書の認証謄本を送付し、また、この調書への各加入を通報するものとする。

4. The Executive Secretary shall promptly furnish a certified copy of this Proces-Verbal and a notification of each acceptance thereof to the Government of Argentina, to each contracting party to the General Agreement, to each government which enters into negotiations for accession to the General Agreement and to each government which has acceded provisionally thereto.
