THIRD PROCES-VERBAL EXTENDING THE DECLARATION ON THE PROVISIONAL ACCESSION OF TUNISIA TO THE GENERAL AGREEMENT ON TARIFFS AND TRADE
関税及び貿易に関する一般協定へのテュニジアの暫定的加入に関する千九百五十九年十一月十二日の宣言(以下それぞれ「一般協定」及び「宣言」という。）の当事国は、
The parties to the Declaration of 12 November 1959 on the Provisional Accession of Tunisia to the General Agreement on Tariffs and Trade (hereinafter referred to as "the Declaration"and"the General Agreement", respectively),
宣言６の規定に従つて行動して、次のとおり協定する。
Acting pursuant to paragraph 6 of the Declaration,
1 宣言の有効期間は、６に規定する日付を「千九百六十七年十二月三十一日」に改めることによつてさらに二年間延長される。
Agree that the validity of the Declaration is extended for a further two years by changing the date in paragraph 6 to "31 December 1967".
2 この調書は、一般協定の締約国団の書記局長に寄託されるものとする。この調書は、テュニジア及び宣言の参加国政府により署名その他によつて受諾されるため、開放される。この調書は、テュニジア政府及び参加国政府がこれを受諾した後直ちにこれらの政府の間で効力を生ずる。
This Proces-Verbal shall be deposited with the Director-General to the CONTRACTING PARTIES to the General Agreement. It shall be open for acceptance, by signature or otherwise, by Tunisia and by the participating governments to the Declaration. It shall become effective between the Government of Tunisia and any participating government as soon as it shall have been accepted by the Government of Tunisia and such government.
3 書記局長は、テュニジア政府、一般協定の各締約国、一般協定に暫定的に加入した各政府及び加入のための交渉を行なつた各政府に対し、この調書の認証謄本を送付し、また、この調書の各受諾を通告するものとする。
The Director-General shall furnish a certified copy of this Proces-Verbal and a notification of each acceptance thereof to the Government of Tunisia, to each contracting party to the General Agreement, to each government which has acceded provisionally thereto and to each government which enters into negotiations for accession.

The Government of Tunisia and the other governments on behalf of which this Declaration has been accepted (the latter governments hereinafter referred to as the "participating governments"),
テュニジア政府が、千九百五十九年十一月四日に、関税及び貿易に関する一般協定（以下「一般協定」という。）第三十三条の規定に従つて一般協定に加入することを正式に要請したことを考慮して、また、
CONSIDERING that the Government of Tunisia on 4 November 1959 made a formal request to accede to the General Agreement on Tariffs and Trade (hereinafter referred to as the "General Agreement") in accordance with the provisions of Article XXXIII of the General Agreement, and
一般協定の多数の締約国が、一般協定の締約国団（以下「締約国団」という。）により準備されている千九百六十年及び千九百六十一年の関税会議中に、テュニジアと一般協定第三十三条の規定に基づく加入に先だつべきであると認められる関税交渉を行なうことを希望していることを考慮して、
HAVING REGARD to the desire of many contracting parties to the General Agreement to conduct the tariff negotiations with Tunisia, which it is considered should precede accession under Article XXXIII, during the tariff conference to be held in 1960 and 1961, the arrangements for which are being made by the CONTRACTING PARTIES to the General Agreement (hereinafter referred to as the "CONTRACTING PARTIES"):
1 千九百五十一年十月二十三日に締約国団が承認した加入議定書のひな型の規定がこの宣言に含まれているものとみなして、参加国政府とテュニジアとの通商関係が、一般協定の締約国との関税交渉の終了後第三十三条の規定に基づいてテュニジアが加入するまでの間、一般協定に基づかなければならないことを宣言する。ただし、テュニジアは、一般協定の附表に掲げる譲許に関して、一般協定第二条その他の条の規定に基づくいかなる直接の権利をも有しない。
1. DECLARE that, pending the accession of Tunisia under the provisions of Article XXXIII, following the conclusion of tariff negotiations with contracting parties to the General Agreement, the commercial relations between the participating governments and Tunisia shall be based upon the General Agreement as if the provisions of the model protocol of accession approved by the CONTRACTING PARTIES on 23 October 1951, were embodied in this Declaration, Declaration, except that Tunisia shall not have any direct rights with respect to the concessions contained in the schedules annexed to the General Agreement either under the provisions of Article II or under the provisions of any other Article of the General
2 テュニジア政府及び参加政府は、締約国団に対し、この宣言の運用のために必要な任務を遂行することを要請する。
2. REQUEST the CONTRACTING PARTIES to perform such functions as are necessary for the operation of this Declaration.
3 締約国団が三分の二の多数によつて承認したこの宣言は、テュニジア、一般協定の締約国及び一般協定に暫定的に加入している政府により署名その他によつて受諾されるため、開放される。
3. This Declaration, which has been approved by the CONTRACTING PARTIES by a two-thirds majority, shall be opened for acceptance, by signature or otherwise, by Tunisia, by contracting parties to the General Agreement, and by any governments which accede provisionally to the General Agreement.
4 この宣言は、締約国団の書記局長に寄託する。
4. This Declaration shall be deposited with the Executive Secretary of the CONTRACTING PARTIES.
5 締約国団の書記局長は、この宣言が受諾のため開放されている各政府に対し、すみやかに、この宣言の認証謄本を送付し、また、この宣言の各受諾について通告するものとする。
5. The Executive Secretary of the CONTRACTING PARTIES shall promptly furnish a certified copy of this Declaration, and a notification of each acceptance thereof, to each government to which this Declaration is open for acceptance.
6 この宣言は、テュニジア及びいずれかの参加政府がこれを受諾した日の後三十日目に、テュニジアとその参加政府との間で効力を生ずる。この宣言は、テュニジア政府が一般協定第三十三条の規定に基づいて一般協定に加入する日又は千九百六十一年十二月三十一日のいずれか早い日まで、テュニジア及び参加政府がこの宣言の有効期間を後の日まで延長することを合意しない限り、効力を有するものとする。
6. This Declaration shall become effective between Tunisia and any participating government on the thirtieth day following the day upon which it shall have been accepted on behalf of Tunisia and of that government; it shall remain in force until the Government of Tunisia accedes to the General Agreement under the provisions of Article XXXIII thereof or until 31 December 1961. whichever date is earlier, unless it has been agreed by Tunisia and the participating governments to extend its validity to a later date.

1 千九百五十九年十一月十二日の宣言の最大の有効期間は、千九百五十九年十一月十二日の宣言６の「千九百六十一年十二月三十一日」の日付を「千九百六十三年十二月三十一日」と改めることにより、二年間延長される。
1. The maximum period of validity of the Declaration of 12 November 1959 is extended for two years by changing the date in paragraph 6 from "31 December 1961" to 31 December 1963.
2 この調書は、一般協定の締約国団の書記局長に寄託する。この調書は、テュニジア及び千九百五十九年十一月十二日の宣言の当事国政府により、並びに千九百五十九年十一月十二日の宣言を受諾する一般協定の締約国政府その他の政府については、当該受諾に引き続いてこれらの締約国政府その他の政府により、署名その他によつて受諾されるため、開放される。
2. The Proces-Verbal shall be deposited with the Executive Secretary of the CONTRACTING PARTIES to the General Agreement. It shall remain open for acceptance, by signature of otherwise, by Tunisia, and by the participating governments to the Declaration of 12 November 1959, and by contracting parties to the General Agreement and other governments, following their acceptance the Declaration of 12November 1959.
3 この調書は、千九百五十九年十一月十二日の宣言のすべての当事国によつて受諾されたときから効力を生ずる。ただし、この調書が千九百六十一年十二月三十一日までに、これらすべての当事国によつて受諾されなかつたときは、
3. This Proces-Verbal shall enter into force upon its acceptance by all the parties to the Declaration of 12 November 1959. Provided that if it shall not have been accepted by all such parties by 31 December 1961,
(a) この調書は、この調書を受諾した千九百五十九年十一月十二日の宣言の当事国については、この調書がテュニジア及びテュニジア以外の当該当事国によつて受諾された時から効力を生ずる。また、
(a) it shall enter into force in respect of those parties thereto which shall have accepted it as soon as it shall have been accepted by Tunisia and any other such party, and
(b) この調書は、その後にこの調書を受諾したいずれかの当事国については、その受諾の時又は千九百五十九年十一月十二日の宣言が当該当事国について効力を生じた時のいずれかおそい時に効力を生ずる。
(b) it shall enter into force for any such party subsequently accepting it upon such acceptance or upon the entry into force of the Declaration of 12 November 1959 in respect of such party, whichever is the later.
4 書記局長は、テュニジア政府、一般協定の各締約国、一般協定への加入のための交渉を開始した各政府及び一般協定に暫定的に加入した各政府に対し、すみやかに、この調書の認証謄本を送付し、また、この調書の各受諾について通告するものとする。
4. The executive Secretary shall promptly furnish a certified copy of this Proces-Verbal and a notification of each acceptance thereof to the Government of Tunisia, to each contracting party to the General Agreement, to each government which enters into negotiations for accession to the General Agreement and to each government which has acceded provisionally thereto.
