PROTOCOL FOR THE FURTHER PROLONGATION OF THE INTERNATIONAL SUGAR AGREEMENT OF 1958
この議定書の当事国政府は、
The Governments party to this Protocol,
千九百五十八年の国際砂糖協定の有効期間の延長のための千九百六十三年の議定書(以下「千九百六十三年の議定書」という。)により有効期間が延長された千九百五十八年の国際砂糖協定(以下「協定」という。)が、千九百六十五年十二月三十一日に効力を失うこととなることを考慮し、
Considering that the International Sugar Agreement of 1958 (hereinafter referred to as "the Agreement"), which was extended by the Protocol of 1963 for the Prolongation of the International Sugar Agreement of 1958 (hereinafter referred to as "the 1963 Protocol") will expire on 31 December 1965;
国際連合の主宰の下に、新たな国際砂糖協定が効力を生ずるまで、一定の期間について協定を存続させることを希望し、
Desiring to continue the Agreement in force for a further period pending the entry into force of a new International Sugar Agreement under the auspices of the United Nations;
協定に代わる新たな国際砂糖協定のための可能な基礎を緊急に検討する意図を再確認して、
Reaffirming their intention urgently to consider possible bases for a new International Sugar Agreement to replace the Agreement;
次のとおり協定した。
Have agreed as follows:
第一条 (1) 協定は、第二条の規定に従うことを条件として、千九百六十六年十二月三十一日まで、この議定書の当事国の間で、引き続き効力を有する。
ARTICLE 1 (1) Subject to the provisions of Article 2, the Agreement shall continue in force between the parties to this Protocol until 31 December 1966. Should a new International Sugar Agreement enter into force before that date, this Protocol shall cease to have effect on the date of the entry into force of the new International Sugar Agreement.
(2) 協定の当事国でなかつた政府で、この議定書の当事国となるものは、これにより、有効期間が延長された協定の当事国となるものとする。
(2) Any Government which was not party to the Agreement but which becomes a party to this Protocol shall thereby be deemed to be a party to the Agreement as extended in force.
第二条 協定第三条(２)及び(３)、第七条から第二十五条まで、第四十一条、第四十二条並びに第四十四条(４)及び(７)の規定は、適用されないものとする。
ARTICLE 2 Paragraphs (2) and (3) of Article 3, Articles 7 to 25 inclusive, Articles 41 and 42 and paragraphs (4) and (7) of Article 44 of the Agreement shall be deemed to be inoperative.
第三条 (1) 各政府は、次のいずれかの方法によりこの議定書の当事国となることができる。
ARTICLE 3 (1) Governments may become party to this Protocol
(a) この議定書に署名すること。
(a) by signing it; or
(b) 批准、受諾又は承認を条件としてこの議定書に署名した後にこれを批准し、又は承認すること。
(b) by ratifying, accepting or approving it after having signed it subject to ratification, acceptance or approval; or
(c) この議定書に加入すること。
(c) by acceding to it.
(2) 各署名国政府は、この議定書に署名するに際し、その署名が、自国の憲法上の手続に従つて批准、受諾又は承認を条件とするものであるかどうかを正式に述べなければならない。
(2) When signing this Protocol each signatory Government shall formally state whether, in accordance with its constitutional procedures, its signature is, or is not, subject to ratification, acceptance or approval.
第四条 (1) この議定書は、千九百六十五年十一月一日から同年十二月二十三日までロンドンで、千九百六十三年の議定書の当事国政府及び協定第三十三条又は第三十四条に掲げるその他の国の政府による署名のため開放しておく。
ARTICLE 4 (1) This Protocol shall be open for signature at London from 1 November to 23 December 1965, Inclusive, by the Governments party to the 1963 Protocol and by the Government of any other country referred to in Articles 33 or 34 of the Agreement.
(2) 批准、承認又は受諾が必要とされる場合には、批准書、承認書又は受諾書は、グレート・ブリテン及び北部アイルランド連合王国政府に寄託するものとする。
(2) Where ratification, approval or acceptance is required, the relevant instrument shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland.
(3) この議定書は、千九百六十五年十二月二十三日の後は、協定第三十三条又は第三十四条に掲げる国の政府の加入のため開放しておくものとし、加入は、グレート・ブリテン及び北部アイルランド連合王国政府に加入書を寄託することにより行なうものとする。
(3) After 23 December 1965 this Protocol shall open for accession by the Government of any country referred to in Article 33 or 34 of the Agreement, by deposit of an instrument of accession with the government of the United Kingdom of Great Britain and Northern Ireland.
(4) この議定書は、また、国際連合の加盟国政府又は千九百六十五年の国際連合砂糖会議に招請された政府で協定第三十三条若しくは第三十四条に掲げられていないものの加入のため開放しておく。ただし、加入を希望する政府が理事会で行使する票数については、まず、理事会と当該政府との間で合意される。
(4) This Protocol shall also be open for accession by the Government of any Member of the United Nations or any Government invited to the United Nations Sugar Conference, 1965 but not referred to in Articles 33 to 34 of the Agreement, provided that the number of votes to be exercised in the Council by the Government Desiring to accede shall first be agreed upon by the Council with that Government.
第五条 (1) この議定書は、千九百六十六年一月一日までにこの議定書の当事国となつた政府の間で、同日に効力を生ずる。ただし、それらの政府は、千九百六十五年十二月三十一日に、千九百六十三年の議定書により有効期間が延長された協定に基づき輸入国の票数の六十パーセント及び輸出国の票数の七十パーセントを有するものでなければならない。その後に寄託される批准書、受諾書、承認書又は加入書は、その寄託の日に効力を生ずる。
ARTICLE 5 (1) This Protocol shall enter into force on 1 January 1966 among those Governments which have by that date become parties to this Protocol, provided that such Governments hold 60 per cent of the votes of the importing countries and 70 per cent of the votes of the exporting countries under the Agreement as extended by the 1963 Protocol on 31 December 1965. Instruments of ratification, acceptance, approval or accession deposited thereafter shall take effect on the date of their deposit.
(2) 憲法上の手続に従つてできる限りすみやかに、可能なときは千九百六十六年七月一日前にこの議定書を批准し、受諾し若しくは承認し、又はこれに加入するよう努力することを約束する旨の通告をグレート・ブリテン及び北部アイルランド連合王国政府が千九百六十六年一月一日前に受領する場合には、その通告は、(1)に規定する百分率についての要件が満たされるかどうかを計算する際に考慮される。
(2) In calculating whether the percentage requirements referred to in paragraph (1) of this Article have been met, a notification containing an undertaking to seek ratification, acceptance, approval or accession in accordance with constitutional procedures as rapidly as possible and if possible before 1 July 1966, received by the Government of the United Kingdom of Great Britain and Northern Ireland before 1, January 1966, shall be taken into account.
(3) この議定書が千九百六十六年一月一日までに効力を生じなかつたときは、第三条の要件を満たした政府は、この議定書をそれらの政府の間で効力を生じさせることに同意することができる。
(3) If by 1 January 1966 this Protocol has not entered into force, the Governments which have satisfied the requirements of Article 3 may agree to put it into force among themselves.
第六条 協定又はこの議定書において、特定の条に列記され又は掲げられる政府又は国に言及する場合には、協定第三十三条又は第三十四条に掲げられていない国であつて、その政府が千九百六十四年一月一日前に協定の当事国となつたもの又はその政府が千九百六十三年の議定書若しくはこの議定書の当事国となつたものは、それぞれ、当該特定の条に列記され、又は掲げられているものとみなす。
ARTICLE 6 Where reference is made in the Agreement or in this Protocol to Governments or countries listed or referred to in particular articles, any country not referred to in Articles 33 or 34 of the Agreement the Government of which either has become a party to the Agreement before 1 January 1964, or has become a party to the 1963 Protocol or to this Protocol, shall be deemed to be listed or referred to accordingly.
第七条 この議定書の当事国政府は、その憲法上の手続に従つて協定第三十八条の規定に基づく自国の分担金を支払うことを約束する。理事会は、この議定書に基づく第一回会期において、当該年度の予算を承認し、及び各参加国政府が納付すべき分担金を定める。
ARTICLE 7 Governments party to this Protocol undertake to pay their contributions under Article 38 of the Agreement according to their constitutional procedures. At its first session under this Protocol the Council shall approve its budget for the year and assess the contributions to be paid by each Participating Government.
第八条 (1) グレート・ブリテン及び北部アイルランド連合王国政府は、千九百六十五年の国際連合砂糖会議に代表者を派遣したすべての政府に対し、この議定書の署名、批准、受諾、承認及び加入、第五条(２)の規定に従つて受領した通告並びにこの議定書の効力発生の日を直ちに通告するものとする。
ARTICLE 8 (1) The Government of the United Kingdom of Great Britain and Northern Ireland shall promptly in-form all Governments represented at the United Nations Sugar Conference, 1965, of each signature, ratification, acceptance and approval of this Protocol, of each accession thereto, of each notification received pursuant to paragraph (2) of Article 5 and of the date of entry into force of this Protocol.
(2) この議定書は、英語、中国語、フランス語、ロシア語及びスペイン語の本文をひとしく正文とし、グレート・ブリテン及び北部アイルランド連合王国政府に寄託するものとし、同政府は、その認証謄本を各署名国政府及び各加入国政府に送付するものとする。
(2) This Protocol, of which the English, Chinese, French, Russian and Spanish texts are equally authoritative, shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland, which shall transmit certified copies thereof to each signatory and acceding government.
以上の証拠として、下名は、このため各自の政府から正当に委任を受け、この議定書に署名した。

この議定書の当事国政府は、
The Governments party to this Protocol,
千九百六十三年の国際連合砂糖会議の最終決議に従い、千九百五十八年十二月一日から二十四日までロンドンで署名のために開放された国際砂糖協定(以下「協定」という。)の効力をこの議定書の当事国政府の間で存続させることを希望し、
Desiring, in accordance with the final resolution of the United Nations Sugar Conference, 1963, to continue in force, as between themselves, the Inter-national Sugar Agreement open for signature at London form 1 to 24 December 1958 (hereinafter referred to at "the Agreement"),
この協定に代わる新たな国際砂糖協定の草案のための可能な基礎を緊急に検討する意図を再確認して、
Reaffirming their intention urgently to consider possible bases for a new draft International Sugar Agreement to replace the Agreement
次のとおり協定した。
Have agreed as follows:
第一条 協定は、第二条(2)及び第三条の規定に従うことを条件として千九百六十五年十二月三十一日まで、この議定書の当事国の間で、引き続いて効力を有する。
ARTICLE 1 Subject to the provisions of paragraph (2)of Article 2 and of Article 3, the Agreement shall continue in force between the Parties to this Protocol until 31 December 1965.
第二条 (1) 理事会は、この議定書の有効期間の満了の日以前に効力を生ずる新たな協定の基礎及び構成について直ちに研究を開始するものとし、また、千九百六十四年六月三十日以前に、参加国政府のため、適当な勧告を含む報告書を作成する。
ARTICLE 2 (1) The Council shall forthwith initiate a study of the bases and framework of a new agreement to come into force not later than the date of expiry of this Protocol, and shall make a report, including appropriate recommendations, to participating Governments not later than 30 June 1964.
(2) 新たな協定がこの議定書の有効期間の満了の日前に効力を生ずる場合には、この議定書は、同時に終了する。
(2) In the event of a new agreement coming into force before the date of expiry of this Protocol the Protocol shall thereupon terminate.
第三条 協定第三条(2)及び(3)、第七条から第二十五条まで並びに第四十四条(4)及び(7)の規定は、適用されないものとする。協定第四十一条及び第四十二条の規定は、効力を停止する。
ARTICLE 3 Paragraphs (2) and (3) of Article 3, Article 7 to 25 inclusive, and paragraphs (4) and (7) of Article 44 of the Agreement shall be deemed to be inoperative; Articles 41 and 42 shall cease to have effect.
第四条 各政府は、自国の憲法上の手続に従い、次のいずれかの手続によつてこの議定書の当事国になることができる。
ARTICLE 4 Governments may become party to this Protocol, in accordance with their constitutional procedures,
(a) 議定書への署名
(a) by signing it; or
(b) 批准、受諾又は承認を条件とする議定書の署名の後における議定書の批准、受諾、又は承認
(b) by ratifying, accepting or approving it after having signed it subject to ratification, acceptance or approval; or
(c) 議定書への加入
(c) by acceding to it.
第五条 (1) この議定書は、千九百六十三年八月一日から千九百六十三年九月三十日まで、ロンドンで、協定の当事国政府又は協定第三十三条若しくは第三十四条に掲げるその他の国の政府による署名のため、開放しておく。
ARTICLE 5 (1) This Protocol shall be open for signature at London from 1 August 1963 to 30 September 1963 inclusive, by the Governments party to the Agreement and by the Government of any other country referred to in Articles 33 or 34 of the Agreement.
(2) 批准書、受諾書又は承認書は、グレート・ブリテン及び北部アイルランド連合王国政府に寄託するものとする。
(2) Instruments of ratification, acceptance or approval shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland.
(3) この議定書は、千九百六十三年九月三十日後、グレート・ブリテン及び北部アイルランド連合王国政府に加入書を寄託することによる協定第三十三条又は第三十四条に掲げる国の政府の加入のため、開放しておく。
(3) After 30 September 1963 this Protocol shall be open for accession by the Government of any country referred to in Article 33 or 34 of the Agreement, by deposit of an instrument of accession with the Government of the United Kingdom of Great Britain and Northern Ireland.
(4) この議定書は、国際連合の加盟国政府又は千九百六十三年の国際連合砂糖会議に招請されたが協定第三十三条若しくは第三十四条に掲げられていない政府の加入のためにも開放しておく。ただし、加入を希望する政府が理事会で行使する票数については、まず、理事会とその政府との間で合意される。
(4) This Protocol shall also be open for accession by the Government of any Member of the United Nations or any Government invited to the United Nations Sugar Conference, 1963, but not referred to in Article 33 or 34 of the Agreement, provided that the number of votes to be exercised in the Council by the Government desiring to accede shall first be agreed upon by the Council with that Government.
第六条 (1) この議定書は、千九百六十四年一月一日までにこの議定書の当事国となつた政府の間で、同日に効力を生ずる。ただし、それらの政府は、千九百六十三年十二月三十一日に、協定に基づいて輸入国の票数の六十パーセント及び輸出国の票数の七十パーセントを有するものでなければならない。その後に寄託される批准書。受諾書、承認書又は加入書は、その寄託の日に効力を生ずる。
ARTICLE 6 (1) This Protocol shall enter into force on 1 January 1964 among those Governments which have by that date become parties to this Protocol, provided that such Governments hold 60 per cent of the votes of the importing countries and 70 per cent of the votes of the exporting countries under the Agreement on 31 December 1963. Instruments of ratification, acceptance, approval or accession deposited thereafter shall take effect on the date of their deposit.
(2) グレート・ブリテン及び北部アイルランド連合王国政府が、憲法上の手続に従つてできる限りすみやかに、可能なときは千九百六十四年七月一日前に批准し、受諾し、承認し、又は加入するように努力することを約束する旨の通告を千九百六十四年一月一日前に受領した場合には、その通告は、(1)の規定に基づくこの議定書の効力発生上、批准書、受諾書又は加入書と同様の効力を有するものとする。ただし、理事会は、当該政府が憲法上の手続を終了することについての困難のために批准書、受諾書、承認書又は加入書を寄託しなかつたと認める場合には、千九百六十四年七月一日以後の理事会が決定する他の日まで前記の期限を延期することができる。
(2) For the purposes of entry into force of this Protocol in accordance with paragraph (1) of this Article a notification containing an undertaking to seek ratification, acceptance, approval or accession in accordance with constitutional procedures as rapidly as possible and if possible before 1 July 1964, received by the Government of the United Kingdom of Great Britain and Northern Ireland before 1 January 1964 shall be regarded as equal in effect to an instrument of ratification, acceptance, approval or accession; provided that, of the Council is satisfied that the Government concerned has not deposited its instrument owing to difficulties in completing its constitutional processes, the Council may extend the period beyond 1 July 1964 to such other date as it may determine.
(3) この議定書の当事国となる政府の有する票数の百分率が、千九百六十四年一月一日において、(1)に規定する票数の百分率に達しない場合には、この議定書に署名し、又はこの議定書を批准し、受諾し、承認し、若しくはこの議定書に加入した政府は、この議定書の効力をそれらの政府の間で生じさせることを合意することができる。
(3) If by 1 January 1964 Governments holding less than the percentage of votes referred to in paragraph (1) of this Article have become parties to this Protocol, the Governments which have signed, ratified, accepted, approved or acceded to this Protocol may agree to put it into force among themselves.
第七条 協定の適用上、協定の特定の条に掲げられ、規定され、又は含まれる政府又は国に言及する場合には、協定第三十三条又は第三十四条に掲げられていない国であつて、その政府が協定第四十一条(4)の規定に従つて千九百六十四年一月一日前に協定の当事国政府になり、又は第四条及び第五条の規定に従つてこの議定書の当事国政府になつたものは、それぞれ、当該特定の条に掲げられ、規定され、又は含まれているものとみなす。
ARTICLE 7 Where, for the purposes of the operation of the Agreement, reference is made to Governments or countries listed, named or included in particular Articles, any country not referred to in Article 33 or 34 of the Agreement the Government of which either has become a party to the Agreement prior to 1 January 1964 in accordance with paragraph (4) of Article 41 of the Agreement, or has become a party to this Protocol in accordance with Articles 4 and 5 of this Protocol, shall be deemed to be listed, named, or included accordingly.
第八条 この議定書の当事国政府は、その憲法上の手続に従つて協定第三十八条の規定に基づく自国の分担金を支払うことを約束する。
ARTICLE 8 Governments party to this Protocol undertake to pay their contributions under Article 38 of the Agreement according to their constitutional procedures.
第九条 グレート・ブリテン及び北部アイルランド連合王国政府は、千九百六十三年の国際連合砂糖会議に出席したすべての政府に対し、この議定書の各署名、各批准、各受諾及び各承認、この議定書への各加入、第六条(2)の規定に従つて受領した各通告並びにこの議定書の効力発生の日を直ちに通告するものとする。
ARTICLE 9 The Government of the United Kingdom of Great Britain and Northern Ireland shall promptly inform all Governments attending the United Nations Sugar Conference, 1963, of each signature, ratification, acceptance and approval of this Protocol, of each accession thereto, of each notification received pursuant to paragraph (2) of Article 6 and of the date of entry into force of this Protocol.
この議定書は、中国語、英語、フランス語、ロシア語及びスペイン語の本文をひとしく正文とし、グレート・ブリテン及び北部アイルランド連合王国政府に寄託しておくものとし、同政府は、各署名国政府及び各加入国政府に対してその認証謄本を送付するものとする。
This Protocol, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Government of the United Kingdom of Great Britain and Northern Ireland, which shall transmit certified copies thereof to each signatory and acceding Government.
以上の証拠として、下名は、このため各自の政府から正当に委任を受け、この議定書に署名した。
