AGREEMENT REGARDING FINANCIAL SUPPORT OF THE NORTH ATLANTIC ICE PATROL
ベルギー、カナダ、デンマーク、フランス共和国、ギリシャ、イタリア共和国、オランダ、ノールウェー、スウェ―デン、グレート・ブリテン及び北部アイルランド連合王国及びアメリカ合衆国の政府は、
The Governments of Belgium, Canada, Denmark, the French Republic, Greece, the Italian Republic, the Netherlands, Norway, Sweden, the United Kingdom of Great Britain and Northern Ireland, and the United States of America,
アメリカ合衆国政府が、千九百四十八年六月十日にロンドンで署名された千九百四十八年の海上における人命の安全のための国際条約第五章第五規則及び第六規則の規定に従つて、北大西洋における氷の監視機関(以下「氷の監視機関」という。)の管理並びに氷の状態の研究及び観測を、これから得られた情報の伝播を含めて、継続することに同意したことを考慮し、
Considering that, in accordance with the provisions of Chapter V. Regulations 5 and 6, or the International Convention for the Safety of Life at Sea, 1948, signed at London on June 1O, 1948, the Government of the United States of America has agreed to continue the management of the North Atlantic Ice Patrol (hereinafter referred to as the "Ice Patrol") and the study and observation of ice conditions, including the dissemination of information received therefrom,
これらの規則に従つて氷の監視機関を援助するためのそれぞれの分担金の率を定めることを希望して、
Desiring, in accordance with those Regulations, to determine the scale of their contributions to the support of the Ice Patrol,
次のとおり協定した。
Have agreed as follows:
第一条 分担金の基準
ARTICLE 1 Basis of Contributions
この協定の各当事国政府は、氷の季節中に氷の監視機関により監視される氷山区域を通過する当該当事国の船舶の総トン数の合計の同季節中に同区域を通過するすべての当事国の船舶の総トン数の合計に対する比率によつて定められる金額を、氷の監視機関の援助のため毎年分担する。
Each party to the present Agreement shall contribute annually to the support of the Ice Patrol a sum determined by the ratio which the total gross tonnage of that party's vessels passing during the ice season through the regions of icebergs guarded by the Ice Patrol bears to the combined total gross tonnage of the vessels of all parties to the present Agreement passing during the Ice season through the regions of icebergs guarded by the Ice Patrol.
この条にいう比率は、毎年計算される。分担金は、管理の便宜上、単位割当によつて表示される。
The ratio referred to in this Article shall be computed annually. For administrative convenience, contributions shall be expressed in terms of unit shares.
第二条 協定の適用を受ける船舶
ARTICLE 2 Vessels to which Agreement Applies
この協定の適用を受ける船舶は、政府が同協定の当事者である国において登録された船舶及びこれらの政府が千九百四十八年の海上における人命の安全のための国際条約を同条約第十三条の規定に従つて適用した領域において登録された船舶とする。
The vessels to which the present Agreement applies are vessels registered in countries the Governments of which are parties to this Agreement, and vessels registered in territories to which those Governments have extended the International Convention for the Safety of Life at Sea, 1948, in accordance with the provisions of Article XIII thereof.
第三条 氷山区域に含まれる航路
ARTICLE 3 Routes Falling within Iceberg Regions
氷の覧視機関により監視される氷山区域を通過する航路は次のとおりである。
The routes passing through the regions of icebergs guarded by the Ice Patrol are as follows:
(a) カナダの大西洋岸諸港(キャンソウ水道及びキャボット海峡を通つて北大西洋と連絡する内陸諸港を含む。)とジブラルタル海峡を通つて又は同海峡以北において北大西洋と連絡するヨー口ッパ、アジア又はアフリカの諸港との間の航路(この協定に附属する地図に示したすべての種類の氷の限界以南を通過する汽船航路を除く。)
(a) Routes between Atlantic Coast ports of Canada (including inland ports approached from the North Atlantic through the Gut of Canso and Cabot Straits) and ports of Europe, Asia, or Africa approached from the North Atlantic through or north of the Straits of Gibraltar (except steamer routes which pass south of the extreme limits of ice of all types as shown on the chart annexed hereto).
(b) ニュー・ファウンドランドのレイス岬以西のカナダの大西洋岸諸港(キャンソウ水道及びキャボット海峡を通つて北大西洋と連絡する内陸諸港を含む。)とニュー・ファウンドランドのレイス岬以北のカナダの大西洋岸諸港との間の航路で同岬を経由するもの。
(b) Routes via Cape Race, Newfoundland between Atlantic Coast ports of Canada (including inland ports approached from the North Atlantic through the Gut of Canso and Cabot Straits) west of Cape Race, Newfoundland and Atlantic Coast ports of Canada north of cape Race, Newfoundland.
(c) 合衆国の大西洋及びメキシコ湾岸諸港(キャンソウ水道及びキャボット海峡を通つて北大西洋と連絡する内陸諸港を含む。)とジブラルタル海峡を通つて又は同海峡以北において北大西洋と連絡するヨーロッパ、アジア又はアフリカの諸港との間の航路(この協定に附属する地図に示したすべての種類の氷の限界以南を通過する汽船航路を除く。)
(c) Routes between Atlantic and Gulf Coast ports of the United States (including inland ports approached from the North Atlantic through the Gut of Canso and Cabot Straits) and ports of Europe, Asia, or Africa approached from the North Atlantic through or north of the Straits of Gibraltar (except steamer routes which pass south of the extreme limits of ice of all types as shown on the chart annexed hereto).
(d) 合衆国の大西洋及びメキシコ湾岸諸港(キャンソウ水道及びキャボット海峡を通つて北大西洋と連絡する内陸諸港を含む。)とニュー・ファウンドランドのレイス岬以北のカナダの大西洋岸諸港との間の航路で同岬を経由するもの
(d) Routes via Cape Race, Newfoundland between Atlantic and Gulf Coast ports of the United States (including inland ports approached from the North Atlantic through, the Gut of Canso and Cabot Straits and Atlantic Coast ports of Canada north of Cape Race, Newfoundland.
すべての種類の氷の限界以南を通過する船舶に関して前項(a)及び(c)に明記する除外を受けようとする政府は、毎年十月十五日までにアメリカ合衆国政府に対し、このような南方航海ごとにそれに関し次の情報を記載した文書による通告を提出しなければならない。
A Government which wishes to avail itself of the exceptions specified in sub-paragraphs (a) and (c) of the preceding paragraph with regard to vessels passing south of the extreme limits of ice of all types will furnish to the Government of the United States of America by the fifteenth of October of each year a notification in writing giving the following information with regard to each such southerly voyage: the name and gross tonnage of the vessel; the last foreign port from which the vessel departed for the United States of Canada, or the first foreign port of arrival after the vessel departed from the United States of Canada; the date of such arrival of departure, and the northernmost position (latitude and longitude) reached by the vessel when west of the 37th meridian and east of the 61st meridian .

当該船舶が合衆国若しくはカナダに向け出発した最後の外国港、又は同船舶が合衆国若しくはカナダから出発した後の最初の到着外国港
前記の到着又は出発の日
第三十七度子午線以西で第六十一度子午線以東にある時、同船舶が達した最北の位置(緯度及び経度)
第四条 氷の季節
ARTICLE 4 Ice Season
氷の監視機関によつて監視される氷山区域を通過する船舶のトン数の計算上、氷の季節は、毎年二月十五日から七月一日までの期間とする。
For the purpose of calculating the tonnage of the vessels passing through the regions of icebergs guarded by the Ice Patrol, the ice season shall be considered to be the period from February 15 through July 1 of each year.
第五条 統計の出所
ARTICLE 5 Source of Statistics
氷の監視機関によつて監視される氷山区域を氷の季節中に通過する船舶のトン数に関する統計は、アメリカ合衆国政府及びカナダ政府が提供する。
Statistics as to the tonnage of the vessels passing during the ice season through the regions of icebergs guarded by the Ice Patrol will be provided by the Government of the United States of America and the Government of Canada.
第六条 経費の報告
ARTICLE 6 Statement of Cost
アメリカ合衆国政府は、この協定の各当事国政府に対して、毎年氷の監視機関を運営する経費についての報告書を提出する。
The government of the United States of America will furnish annually to each party to the present Agreement a statement of the east of operating the Ice Patrol.
第七条 従前の取極
ARTICLE 7 Previous Arrangements
この協定は、千九百四十八年―千九百四十九年にグレート・ブリテン及び北部アイルランド連合王国政府が提案し、千九百五十年度の氷の監視機関の運営の経費からはじめて実施された北大西洋における氷の監視機関に対する財政的分担に関する現行の取極に代るものとする。
The present Agreement shall replace the existing arrangements with respect to financial contributions to the North Atlantic ice Patrol, which were proposed by the Government of the United Kingdom of Great Britain and Northern Ireland in 1948-1949 and became operative beginning with the cost of the operation of the Ice Patrol for 1950.
第八条 審査
ARTICLE 8 Review
この協定は、千九百四十八年の海上における人命の安全に関する国際条約第五章第六規則(e)に掲げる原則に従つて、この協定の改正が望ましいかどうかを決定するため三年をこえない期間ごとに審査されるものとする。
In accordance with the principle expressed in Chapter V, Regulation 6(e), of the International Convention for the Safety of Life at Sea, 1948, the present Agreement shall be reviewed at intervals not exceeding three years with a view to determining whether amendment thereof is desirable.
第九条 効力発生
ARTICLE 9 Entry into Force
この協定は、前文に掲げるすべての政府のために同協定が署名された日に効力を生ずる。この協定は、千九百五十五年の氷の季節からはじめて実施されるものとし、同年度の支払請求書は、千九百五十六年に提示される。
The present Agreement shall enter into force on the date on which it shall have been signed on behalf of all the Governments named in the preamble to the Agreement. It shall be operative beginning with the ice season of 1955, for which bills will be rendered in 1956.
第十条 新たな分担国政府
ARTICLE 1O New Contributors
政府がこの協定の当事者でない国の船舶が氷の監視機関の業務から相当な程度利益を受けていることが明らかであるときはいつでも、アメリカ合衆国政府は、この協定の当事者である他の政府にこの旨を通報するものとする。これらの政府のいずれも反対をしないときは、アメリカ合衆国政府は、前記の国の政府に対し協定を受諾するよう招請するものとする。
Whenever it is evident that the shipping of a country, the Government of which is not a party to the present Agreement, is benefiting in an appreciable degree from the services of the Ice Patrol the Government of the United States of America shall so inform the other Governments parties to the Agreement. If no objection is raised by any of those Governments, the Government of the United States of America shall extend an invitation to the Government of such country to accept the Agreement.
受諾は、文書による適当な通告をアメリカ合衆国政府に対して送付することによつて行われる。この協定を受諾する通告は、アメリカ合衆国政府が同通告を受領した日に効力を生じ、かつ、同通告が受領された年の氷の季節について提示された支払請求書に関して実施される。
Acceptance shall be effected by transmitting to the Government of the United States of America an appropriate notification in writing. The notification or acceptance of the Agreement shall enter into force on the date on which it is received by the Government of the United States or America and shall be operative with respect to bills rendered for the ice Season of the year in which the notification has been received.
アメリカ合衆国政府は、協定のすべての当事国政府に対し、前記の受諾の通告の受領を通報する。
The Government of the United States of America shall notify all parties to the Agreement of the receipt of any such notification of acceptance.
第十一条 廃棄
ARTICLE 11 Denunciation
この協定の廃棄は、千九百四十八年の海上における人命の安全に関する国際条約第五章第六規則(b)の規定に従う。
Denunciation of the present Agreement shall be governed by the provisions of Chapter V, Regulation 6(b), of the International Convention fop the Safety of Life at Sea, 1948.
以上の証拠として、下名は、このために正当な委任を受け、この協定に署名した。
In WITNESS WHEREOF the undersigned, being duly authorized thereto, have signed the present Agreement.
千九百五十六年一月四日にワシントンで、英語により本書一通を作成した。この本書は、アメリカ合衆国政府の記録に寄託し、同政府は、認証謄本を署名政府に送付する。
DONE at Washington, in the English language, this fourth day of January 1956, in a single original to be deposited in the archives of the Government of the United States of America, which shall transmit certified copies thereof to the signatory Governments.
