AGREEMENT FOR THE ESTABLISHMENT OF THE INDO-PACIFIC FISHERIES COUNCIL
国際連合食糧農業機関の加盟国たるビルマ、中国、フランス、インド、オランダ、フィリピン共和国、連合王国及びアメリカ合衆国の政府は、インド＝太平洋区域の水産天然資源の開発及びその適切な利用に関して相互的利害関係を有し、かつ、これらの目的を、インド＝太平洋漁業理事会の設立により国際間の協力を通じて推進することを希望し、次のとおり協定する。
The Governments of Burma, China, France, India, the Netherlands, the Republic of the Philippines, the United Kingdom and the United States of America, members of the Food and Agriculture Organization of the United Nations, having a mutual interest in the development and proper utilization of the living aquatic resources of the Indo-Pacific Areas, and desiring to further the attainment of these ends through international cooperation by the establishment of an Indo-Pacific Fisheries Council agree as follows :
第一条 理事会
ARTICLE I The Council
1 締約政府は、第三条に定める機能及び任務を遂行するため、インド＝太平洋漁業理事会と称する理事会を設立することを合意する。
1. The contracting Governments agree to establish a Council, to be known as the Indo-Pacific Fisheries Council, for the purpose of carrying out the functions and duties hereinafter set forth in Article III.
2 理事会の構成員は、第九条の規定に従つてこの協定を受諾する政府とする。
2. The members of the Council shall be the Governments which accept this Agreement in accordance with the provisions of Article IX thereof.
第二条 組織
ARTICLE II Organization
1 各加盟政府は、理事会の会議に一人の代表者を出すものとし、その代表者は、一人の代表代理並びに若干の専門家及び顧問を随伴することができる。代表代理、専門家及び顧問の理事会の会議への参加は、代表代理が代表者の不在中その代表者に代つて行動する場合を除くほか、それらの者に投票権を与えるものではない。
1. Each Member Government shall be represented at Sessions of the Council by a single delegate, who may be accompanied by an alternate and by experts and advisers. Participation in Sessions of the Council by alternates, experts and advisers shall not entail the right to vote, except in the case of an alternate who is acting in the place of a delegate during his absence.
2 各加盟政府は、一個の投票権を有するものとする。理事会の決定は、この協定又は理事会の手続を定める規則により一層大きい多数決が要求される場合を除くほか、投票の過半数によるものとする。理事会の全構成員の過半数は定足数を構成する。
2. Each Member Government shall have one vote. Decisions of the Council shall be taken by a majority of the votes cast, except when a greater majority is required by this Ageement or by the Rules governing the procedure of the Council. A majority of the total member-ship of the Council shall constitute a quorum.
3 理事会は、議長及び副議長を選出するものとし、新たに選出された議長及び副議長は、前回の議長とともに執行委員会を組織する。理事会の議長は、執行委員会の一人又は二人の委員が同委員会の会議にやむをえない理由のため欠席した場合には、自己の裁量により、その会議に限り、理事会の手続を定める規則に従つて随時設立されることのある一又は二の専門委員会の議長を、前記の欠席した一又は二人の委員に代つて選定する権限を有するものとする。ただし、執行委員会の会議には一人の常任委員が必ず出席していなければならないこと及び、同委員会の会議に出席して投票する委員の数が三人をこえてはならないことを条件とする。
3. The Council shall elect a Chairman and a Vice-Chairman who with the immediately retiring Chairman shall constitute the Executive Committee. In the unavoidable absence of one or two members of the Executive Committee from a Committee session, the Chairman shall have the power to co-opt the chairman of one or two of the Technical Committee which may from time to time be established in accordance with the Rules governing the procedure of the Council, at his discretion, to substitute the absent Committee member or members for that Committee session only, provided that one permanent member of the Executive Committee shall always be present and that the number of voting members attending the Committee session shall in no case exceed three.
4 理事会は、その会議の回数、期日及び場所を決定し、かつ、その手続を定める規則を設定する。
4. The Council shall determine the frequency, dates and places of its Sessions and establish rules governing its procedure.
5 議長は、加盟政府の過半数により別に指定されない限り、少くとも毎年一回理事会の会議を招集する。第一回会議は、この協定の効力発生の後六箇月以内に、国際連合食糧農業機関により、その指定した場所に招集される。
5. The Chairman shall call a Session of the Council at least once in every year, unless directed otherwise by a majority of the member Governments. The initial Session shall be called by the Food and Agriculture Organization of the United Nations within six months after the entry into force of this Agreement and at such place as it may designate.
6 理事会の所在地は、第四条に定める区域内の最も便宜な場所にある国際連合食糧農業機関地域事務局の所在地に置く。この地域事務局が設立されるまでの間、理事会は、その区域内に臨時の所在地を選定する。
6. The seat of the Council shall be at the seat of the Regional Office of the Food and Agriculture Organization of the United Nations most conveniently situated within the area defined in Article IV. Pending the establishment of such a Regional Office, the Council shall select a temporary seat within that area.
7 国際連合食糧農業機関は、理事会の事務局を設け、かつ、その事務局長を任命する。
7. The Food and Agriculture Organization of the United Nations shall provide the Secretariat for the Council and shall appoint its Secretary.
第三条 任務
Article III Functions
理事会は、次の機能及び任務を有する。
The Council shall have the following functions and duties:
a 水産天然資源の開発及びその適切な利用に関する問題の海洋学的、生物学的及び他の専門的な部面を明確に定めること。
a. To formulate the oceanographical, biological and other technical aspects of the problems of development and proper utilization of living aquatic resources ;
b 調査すること及び日常業務に改善された方法を適用することを奨励し、かつ、調整すること。
b. To encourage and co-ordinate research and the application of improved methods in everyday practice;
c 水産天然資源に関する海洋学的、生物学的及び他の専門的な情報を収集し、公表し、及び配布すること。
c. To assemble, publish or otherwise disseminate oceanographical, biological and other technical information relating to living aquatic resources;
d 加盟政府に対し、前記の知識の欠陥を満たすために必要であり、又は望ましいと認める国家的又は協力的な調査及び開発計画を勧告すること。
d. To recommend to member Governments such national or co-operative research and development projects as may appear necessary or desirable to fill gaps in such knowledge;
e 適当な場合には、前記の目的のための協力的な調査及び開発計画作成を引き受けること。
e. To undertake, where appropriate, co-operative research and development projects directed to this end;
f 科学的設備、技術及び名称の規格化をはかるための措置を提案し、かつ、必要なときはそれを採用すること。
f. To propose, and where necessary to adopt, measures to bring about the standardization of scientific equipment, techniques and nomenclature;
g 欠くことのできない資材及び設備を確保するため加盟政府を援助することについて、尽力すること。
g. To extend its good offices in assisting Member Governments to secur essential material and equipment;
h 加盟政府又は国際連合食糧農業機関及び利害関係を有する他の国際的、国家的若しくは民間の機関から勧告を受けた場合には、海洋学的、生物学的及び他の技術的な事項に関する問題について報告すること。
h. To report upon such questions relating to oceanographical, biological and other technical problems as may be recommended to it by Member Governments or by the Food and Agriculture Organization of the United Nations and other international, national or private organizations with related interests;
i 国際連合食糧農業機関の総会に対し総会の情報として理事会の活動に関し年次報告を行い、また、国際連合食糧農業機関に対し理事会の権限内にある事項に関し、同機関のために必要かつ望ましいと認める他の報告を行うこと。
i. To report annualy to the Conference of the Food and Agriculture Organization of the United Nations upon its activities for the information of the Conference; and to make such other reports to the Food and Agriculture Organization of the United Nations on matters falling within the competence of the Council as may seem to it necessary and desirable.
第四条 区域
ARTICLE IV Area
理事会は、インド＝太平洋区域において、第三条に定める権能及び任務を遂行するものとする。
The Council shall carry out the functions and duties set forth in Article III in the Indo-Pacific area.
第五条 国際団体との協力
ARTICLE VCo-operation with International Bodies
理事会は、相互に利害関係のある事項について、他の国際団体と緊密に協力するものとする。
The Council shall co-operate closely with other international bodies in matters of mutual interest.
第六条 費用
ARTICLE VI Expenses
1 理事会の会議への出席のために生ずる代表者、代表代理、専門家及び顧問の費用は、各自の政府が決定して支払うものとする。
1. The expenses of delegates and their alternates, experts and advisers occasioned by attendance at Sessions of the Council shall be determined and paid by their respective Governments.
2 事務局の費用(刊行物及び通信の費用を含む。)並びに会議と会議との間の期間において理事会の業務に関連する任務を遂行する場合の理事会の議長、副議長及び前回の議長の費用は、国際連合食糧農業機関が、同機関の現行規則に従つて作成し、かつ、承認した一年次予算の限度内で決定して支払うものとする。
2. The expenses of the Secretariat, including publications and communications, and of the Chairman, Vice-Chairman and the immediately retired Chairman of the Counil, when performing duties connected with its work during intervals between its Sessions, shall be determined and paid by the Food and Agriculture Organization of the United Nations within the limits of an annual budget prepared and approved in accordance with the current regulations of that Organization.
3 理事会の一構成員が引き受けた調査及び開発計画作成に関する費用は、自主的に引き受けた場合であると理事会の勧告に基いて引き受けた場合であるとを問わず、その関係政府が決定して支払うものとする。
3. The expenses of research or development projects undertaken by individual members of the Council, whether independently or upon the recommendation of the Council, shall be determined and paid by their respective Governments.
4 第三条(d)及び(e)の規定に従つて引き受けられた協力的な調査又は開発計画作成に関連して生ずる費用は、別途に使用されない限り、加盟政府が、相互に合意する形式及び額で、決定して支払うものとする。
4. The exenses incurred in connection with cooperative research or development projects undertaken in accordance with the provisions of Article III, paragraphs (d) and (e) unless otherwise available shall be determined and paid by the Member Governments in the form and proportion to which they shall mutually agree.
第七条 改正
ARTICLE VII Amendments [1]
この協定の改正に関するいずれの提案も、理事会のすべての構成員の三分の二の多数による承認を必要とする。ただし、この規定は、次の場合に限り、その適用が除外される。
Any proposal for amending this Agreement shall require the approval of a two-thirds majority of all the Members of the Council. An exception to this rule is made in the following cases:
(1) 理事会の機能を拡張することに関するこの協定の改正は、理事会のすべての構成員の三分の二の多数による承認のほか、国際連合食糧農業機関の総会の承認をも必要とする。
(1) Amendments to the Agreement extending the functions of the Council require the approval of the Conference of the Food and Agriculture Organization of the United Nations in addition to approval by a two-thirds majority of all the Members of the Council;
(2) 国際連合食糧農業機関の負担すべき費用を引き受けるために理事会の権限を拡張することに関するこの協定の改正は、理事会のすべての構成員の三分の二の多数による承認及び国際連合食糧農業機関の事務局長の承認を必要とする。
(2) Amendments of the Agreement extending the powers of the Council to incur expenses to be borne by the Food and Agriculture Organization of the United Natons, shall require the approval of a two-thirds majority of all the Members of the Council and of the Director-General of the Food and Agiculture Organization of the United Nations.
第八条 受諾
ARTICLE VIII Acceptance
1 この協定は、国際連合食糧農業機関に加盟している政府の受諾のため開放しておく。
1. This Agreement shall be open to acceptance by Governments which are members of the Food and Agriculture Organization of the United Nations.
2 この協定は、また、国際連合食糧農業機関に加盟していない政府が、同機関の総会の承認及が理事会の構成員の三分の二の承認を得て受諾するため開放しておく。同政府の理事会の活動への参加は、理事会が決定し、かつ、国際連合食糧農業機関の総会が承認した事務局の費用の比例割当額を引き受けることを条件とする。
2. This Agreement shall also be open to acceptance by Governments which are not members of the Food and Agriculture Organization of the United Nations, with the approval of the Conference of the Food and Agriculture Organization of the United Nations and of two-thirds of the members of the Council. Participation by such Governments in the activities of the Council shall be contingent upon the assumption of a proportionate share in the expenses of the Secretariat, as determined by the Council and approved by the Food and Agriculture Organization Conference.
3 この協定の受諾通告書は、国際連合食糧農業機関の事務局長に寄託するものとし、事務局長は、その受領を直ちにすべての関係政府に通報するものとする。
3. The notifications of acceptance of this Agreement shall be deposited with the Director-General of the Food and Agriculture Organization of the United Nations, who shall immediately inform all the Governments concerned of their receipt.
第九条 効力発生
ARTICLE IX Entry into Force
1 この協定は、五番目の受諾通告書の受領の日に効力を生ずるものとする。
1. This Agreement shall enter into force upon the date of receipt of the fifth notification of acceptance.
2 この協定の効力発生の後に受領した受領通告は、国際連合食糧農業機関の事務局長が受領した日に効力を生ずるものとし、事務局長は、その受領を直ちにすべての関係政府及び理事会に通報するものとする。
2. Notifications of acceptance received after the entry into force of this Agreement shall take effect on the date of their receipt by the Director-General of the Food and Agriculture Organization of the United Nations who shall immediately inform all the Government concerned and the Council of their receipt.
第十条 脱退
ARTICLE X Withdrawal
加盟政府は、この協定がその政府について効力を生じた日から二年の期間が満了した後はいつでも、国際連合食糧農業機関の事務局長に脱退の通告書を送付することにより、この協定から脱退することができる。事務局長は、その脱退を直ちにすべての関係政府及び理事会に通報するものとする。脱退通告は、事務局長が受領した日から三箇月で効力を生ずる。
Any Member Government may withdraw from this Agreement, at any time after the expiration of two years from the date upon which the Agreement entered into force with respect to that Government by giving written notice of such withdrawal to the Director-General of the Food and Agriculture Organization of the United Nations who shall immediately inform all the Governments concerned and the Council of such withdrawal. Notice of withdrawal shall become effective three months from the date of its receipt by the Director-General.
千九百四十八年二月二十六日にバキオで、英語により本書一通を作成した。本書は、国際連合食糧農業機関の記録に寄託されるものとし、同機関は、その認証謄本を同機関の加盟政府に送付するものとする。
Formulated at Baguio this 26th day of February, one thousand nine hundred and forty-eight, in the English, language, in a single copy which shall be deposited in the archives of the Food and Agriculture Organization of the United Nations which shall furnish certified copies thereof to the Governments members of the Food and Agriculture Organization of the United Nations.
