朝鮮半島エネルギー開発機構の原加盟国間の協力に関する協定

AGREEMENT ON COOPERATION AMONG THE ORIGINAL MEMBERS OF THE KOREAN PENINSULA ENERGY DEVELOPMENT ORGANIZATION

　日本国政府、大韓民国政府及びアメリカ合衆国政府(以下「締約国政府」という。)は、

　The Government of Japan, the Government of the Republic of Korea, and the Government of the United States of America (hereinafter referred to as the "Parties"),

　朝鮮半島エネルギー開発機構(以下「機構」という。)の意思決定手続及び運営における締約国政府間の具体的な協力が最も重要であることに留意して、

　Bearing in mind the paramount importance of the concrete cooperation among the Parties in the decision-making process and management of the Korean Peninsula Energy Development Organization (hereinafter referred to as "KEDO"),

　次のとおり協定した。

　Have agreed as follows:

第一条
　締約国政府は、機構の原加盟国の政府として、締約国政府間の意見の一致に達するよう緊密に協議し、並びに機構の理事会のいかなる決定案又は朝鮮半島エネルギー開発機構の設立に関する協定(改正を含む。以下「協定」という。)を改正し、終了させ若しくは停止するいかなる提案についてもそのような意見の一致に基づき行動するとの原則及び慣行を維持する。

ARTICLE I
　The Parties, as the governments of the original Members of KEDO, Shall maintain the principle and practice of closely consulting in order to reach a consensus among themselves and of acting on that consensus on any draft decision of the Executive Board of KEDO or any proposal to amend, terminate, or suspend the Agreement on the Establishment of the Korean Peninsula Energy Development Organization, as amended (hereinafter referred to as the "Agreement").

第二条
　締約国政府は、協定第六条(e)に関し、決定案に賛成することにつき締約国政府間に意見の一致がある場合を除くほか、理事会に対していかなる決定案も提出せず、又は理事会においていかなる決定案にも同意しない。

ARTICLE II
　With reference to Article VI (e) of the Agreement, The Parties shall not submit a draft decision to the Executive Board nor agree to a draft decision at the Executive Board unless there is a consensus among the Parties for the draft decision.

第三条
　締約国政府は、協定第十四条(c)及び(d)に関し、締約国政府間に意見の一致がある場合を除くほか、協定を改正し、終了させ又は停止するいかなる提案にも同意しない。

ARTICLE III
　With reference to Article XIV (c) and (d) of the Agreement, the Parties shall not agree to any proposal to amend, terminate, or suspend the Agreement unless there is a consensus among the Parties on the proposal.

第四条
　協定を改正し、終了させ又は停止するための手続及び理事会の意思決定手続に関し、締約国政府がそのような手続において意見の一致に基づき行動し、そのような意見の一致がそのような手続における決定的な要素となるとの基本原則に合致するように協定が改正されない限り、締約国政府は、理事会に参加する代表の数を五を超えて増加させるための理事会決定案に同意しない。

ARTICLE IV
　The Parties shall not agree to a draft decision of the Executive Board to increase the number of representatives serving on the Executive Board beyond five unless appropriate amendments to the Agreement are made on the decision-making process of The Executive Board and on the procedure for amending, terminating, or suspending the Agreement, consistent with the basic principles that the Parties shall act on a consensus among themselves in the decision-making process of the Executive Board and in the procedure for amending, terminating, or suspending the Agreement and that such consensus shall be the determining factor in such process and procedure.

第五条
(a)　この協定は、署名により効力を生ずる。

ARTICLE V
(a) This agreement shall enter into force upon signature.

(b)　この協定は、締約国政府の書面による合意により改正し、終了させ又は停止することができる。

(b) This agreement may be amended, terminated, or suspended by written agreement of the Parties.

　千九百九十七年九月十九日にワシントンで、英語により本書三通を作成した。
