PROTOCOL AMENDING THE AGREEMENT ESTABLISHING THE SOUTHEAST ASIAN FISHERIES DEVELOPMENT CENTER SIGNED AT BANGKOK ON 28 DECEMBER 1967
千九百六十七年十二月二十八日にバンコックで署名された「東南アジア漁業開発センター（以下「センター」という。）を設立する協定」（以下「協定」という。）第十八条は、センターの加盟政府（以下「加盟政府」という。）のいずれも、この協定の改正を理事会に対して提案することができ、改正は、理事会の理事の総数の全会一致の投票によってのみ採択されること及びこのようにして採択された改正は、すべての加盟政府がこれを受諾した日にすべての加盟政府について効力を生ずることを定めており、
WHEREAS Article 18 of the Agreement Establishing the Southeast Asian Fisheries Development Center (SEAFDEC), signed at Bangkok on 28 December 1967, stipulates that amendments to this Agreement may be proposed to the Council by any Member and shall only be adopted by a unanimous vote of the total number of the Directors of the Council, and that each amendment so adopted shall come into force for all the Members on the date on which it is accepted by all the Members,
センターの理事会が、千九百九十二年十二月八日から十一日まで東京で開催された第二十五回会合において協定第三条、第十五条4及び第十九条を改正することについて合意し、
WHEREAS the SEAFDEC Council at its 25th Meeting, held in Tokyo from 8 to I l December 1992, has agreed to amend Articles 3, 15(4) and 19 of the Agreement,
理事会の理事が、千九百九十三年十一月二十二日から二十五日までクアラ・トレンガヌで開催された第二十六回会合において、改正案を全会一致の投票によって採択したので、
WHEREAS the proposed amendment has been adopted by a unanimous vote of the total number of the Directors of the Council at the 26th Meeting, he]d in Kuala Terengganu from 22 to 25 November 1993,
加盟政府は、ここに次のとおり協定を改正することを受諾する。
The Members of SEAFDEC hereby accept the amendment of the said Agreement as follows:
第一条 協定第三条を次のように改める。
Article I Article 3 of the Agreement shall be replaced by the following:
第三条 加盟政府の地位
"Article 3 MEMBERSHIP
1 加盟政府の地位は、東南アジア諸国の政府及び日本国政府に対して開放される。
1. Membership in the Center shall be open to the governments of the Southeast Asian countries and Japan.
2 1の規定に基づいて加盟政府の地位を得る資格を有する政府であって、第十四条に規定する期間内に署名を行わなかったものは、理事会の理事の総数の全会一致の投票によって、センターへの加盟を承認される。
2. Governments eligible for membership under paragraph I of this Article which do not sign within the period specified in Article 14 of this Agreement may be admitted to membership in the Center by a unanimous vote of the total number of Directors of the Council."
第二条 協定第十五条4を次のように改める。
Article II Article 15 Paragraph 4 of the Agreement shall be replaced by the following:
4 寄託政府は、1から3までの規定によるこの協定の効力発生について加盟政府に通告するものとする。
"The Depositary Government shall inform the Members of the entering into force of this Agreement according to the preceding paragraphs of this Article."
第三条 協定第十九条を次のように改める。
Article III Articie 19 of the Agreement shall be replaced by the following:
第十九条 寄託
"Article 19 DEPOSIT
この協定の原本は、タイ王国政府に寄託されるものとし、同政府は、その認証謄本を加盟政府に送付する。
The original of this Agreement shall be deposited with the Government of Thailand, who shall send certified copies thereof to the Members."
第四条 この議定書は、署名の日に効力を生ずる。
Article IV This Protocol shall enter into force on its date of signature.
以上の証拠として、下名の代表者は、このため、それぞれの政府から正当に委任を受け、この議定書に署名した。
IN WITNESS WHEREOF the undersigned representatives being duly authorized thereto by their respective governments, have signed the present Protocol.
