INTERNATIONAL LABOUR CONFERENCE INSTRUMENT INSTRUMENT FOR THE AMENDMENT OF THE CONSTITUTION OF THE INTERNATIONAL LABOUR ORGANISATION ADOPTED BY THE CONFERENCE AT ITS EIGHTY-FIFTH SESSION,GENEVA,19 JUNE 1997
国際労働機関の総会は、
The General Conference of the International Labour Organisation,
理事会によりジュネーヴに招集されて、千九百九十七年六月三日にその第八十五回会期として会合し、
Having been convened at Geneva by the Governing Body of the International Labour Office, and having met in its Eighty-fifth Session on 3 June 1997, and
その会期の議事日程の第七議題に含まれる問題、すなわち、国際労働機関憲章の改正の採択を決定して、
Having decided upon the adoption of an amendment to the Constitution of the International Labour Organisation, a question which is included in the seventh item on the agenda of the Session;
次の国際労働機関憲章の改正に関する文書（引用に際しては、千九百九十七年の国際労働機関憲章改正文書と称することができる。）を千九百九十七年六月十九日に採択する。
adopts, this nineteenth day of June of the year one thousand nine hundred and ninety-seven, the following instrument for the amendment of the Constitution of the International Labour Organisation, which may be cited as the Constitution of the International Labour Organisation Instrument of Amendment, 1997:
第一条 この改正文書が効力を生ずる日から、国際労働機関憲章第十九条８の次に次の９を加える。 ９ この条の規定に従つて採択された条約がその目的を失つたこと又はこの機関の目的の達成に当たりもはや有益な貢献をしていないことが明らかである場合には、総会は、理事会の提案に基づき、出席代表の投票の三分の二の多数によつて当該条約を廃止することができる。
Article 1 As from the date of the coming into force of this Instrument of Amendment, article 19 of the Constitution of the International Labour Organisation shall be amended by the insertion after paragraph 8 of the following new paragraph: "9. Acting on a proposal of the Governing Body, the Conference may, by a majority of two-thirds of the votes cast by the delegates present, abrogate any Convention adopted in accordance with the provisions of this article if it appears that the Convention has lost its purpose or that it no longer makes a useful contribution to attaining the objectives of the Organisation."
第二条 この改正文書の二通は、総会議長及び国際労働事務局長の署名によって認証される。その一通は国際労働事務局に寄託し、他の一通は国際連合憲章第百二条の規定に従って登録するために国際連合事務総長に送付する。事務局長は、この改正文書の認証謄本を国際労働機関のすべての加盟国に送付する。
Article 2 Two copies of this Instrument of Amendment shall be authenticated by the signatures of the President of the Conference and of the Director-General of the International Labour Office. One of these copies shall be deposited in the archives of the International Labour Office and the other shall be communicated to the Secretary-General of the United-Nations for registration in accordance with article 102 of the Charter of the United Nations. The Director-General will communicate a certified copy of the Instrument to all the Members of the International Labour Organisation.
第三条 １ この改正文書の正式の批准書又は受諾書は、国際労働事務局長に送付するものとし、同事務局長は、その受領を国際労働機関の加盟国に通報する。
Article 3 1 The formal ratifications or acceptances of this Instrument of Amendment shall be communicated to the Director-General of the International Labour Office, who shall notify the Members of the Organisation of the receipt thereof.
２ この改正文書は、国際労働機関憲章第三十六条の規定に従って効力を生ずる。
2 This Instrument of Amendment will come into force in accordance with the provisions of article 36 of the Constitution of the International Labour Organisation.
３ 国際労働事務局長は、この改正文書が効力を生じたときは、その旨を国際労働機関のすべての加盟国及び国際連合事務総長に通報する。
3 On the coming into force of this Instrument, the Director-General of the International Labour Office shall so notify all the Members of the International Labour Organisation and the Secretary-General of the United Nations.
以上は、国際労働機関の総会が、ジュネーヴで開催されて千九百九十七年六月十九日に閉会を宣言されたその第八十五回会期において、正当に採択した文書の真正な本文である。
The foregoing is the authentic text of the instrument duly adopted by the General Conference of the International Labour Organisation during its Eighty-fifth Session which was held at Geneva and declared closed the 19 June 1997.
