AMENDMENTS TO THE AGREEMENT
ESTABLISHING

東南アジア諸国連合貿易投資観光促進センターを設立する協定の一部を次のように改正する。

THE ASEAN PROMOTION CENTRE ON TRADE, INVESTMENT AND TOURISM

１　前文の第二段落を次のように改める。
      日本国とＡＳＥＡＮ構成国との間の一層深いかつ広範な戦略的な連携を構築するため、貿易、投資、観光及び人物交流を促進することが極めて重要であることを認識し、

1. The second paragraph of the preamble of the Agreement is hereby amended as follows:

  Recognizing the vital importance of promoting trade, investment, tourism and exchanges of persons to create a deeper and broader strategic partnership between Japan and the ASEAN member countries;

２  第一条１を次のように改める。
  　１  東南アジア諸国連合貿易投資観光促進センター（以下「センター」という。）と称する貿易、投資、観光及び人物交流を促進するためのセンターを設立する。

2. Article I 1. of the Agreement is hereby amended as follows:

 1. There shall be established a promotion centre on trade, investment, tourism and exchanges of persons known as the ASEAN Promotion Centre on Trade, Investment and Tourism (hereinafter referred to as “the Centre”).

  ３  第二条を次のように改める。
      センターは、日本国とＡＳＥＡＮ構成国との間の緊密な協力を通じ、日本国へのＡＳＥＡＮ構成国からの貿易、特に、半加工品及び製品の貿易の促進により日本国とＡＳＥＡＮ構成国との間の経済上の連携を強化し、日本国とＡＳＥＡＮ構成国との間の投資の流れ（投資の流れに伴う技能及び技術の移転を含む。）を加速させ、日本国とＡＳＥＡＮ構成国との間の観光客の数を増加させ並びに人物交流を拡大させることを目的とする。

3. Article II of the Agreement is hereby amended as follows:

  The purpose of the Centre is to enhance an economic partnership between Japan and the ASEAN member countries by means of promoting trade from the ASEAN member countries to Japan, particularly that of semi-processed and manufactured products; to accelerate the flow of investment between Japan and the ASEAN member countries including the transfer of skill and technology; to vitalize tourist traffic between Japan and the ASEAN member countries; and to expand exchanges of persons through close cooperation between Japan and the ASEAN member countries.

  ４  第三条(1)を次のように改める。
    　(1)　日本国及びＡＳＥＡＮ構成国において、日本国及びＡＳＥＡＮ構成国の双方の産品、産業、投資の機会及び観光資源並びに日本国とＡＳＥＡＮ構成国との間の交流事業を紹介し及びこれらについて宣伝すること。

4. Article III (1) of the Agreement is hereby amended as follows:

 (1) to introduce and publicize in Japan and the ASEAN member countries, products, industries, investment opportunities and tourism resources of both Japan and the ASEAN member countries as well as exchange programmes between Japan and the ASEAN member countries;

  ５  第三条(3)を次のように改める。
    　(3)  日本国及びＡＳＥＡＮ構成国の双方の利益の増進を目的とするＡＳＥＡＮ構成国からの及びＡＳＥＡＮ構成国への貿易、投資、観光及び人物交流に関しての派遣団に対し、適当な場合には、援助及び助言を与えること。

5. Article III (3) of the Agreement is hereby amended as follows:

 (3) to assist and advise, where appropriate, missions from and to the ASEAN member countries on trade, investment, tourism and exchanges of persons which will enhance the interests of both Japan and the ASEAN member countries;

  ６　第三条(4)を次のように改める。
    　(4)  日本国とＡＳＥＡＮ構成国との間の貿易、投資、観光及び人物交流の振興に関係のある情報（市場への進出に関する規制を含む。）の交換を有意義なものとするための経路の役割を果たすこと並びに市場に関する資料及び情報を準備し及び分析すること（市場の動向を分析することを含
    　　む。）。

6. Article III (4) of the Agreement is hereby amended as follows:

 (4) to serve as a channel for the meaningful exchange of information relevant to the enhancement of trade, investment, tourism and exchanges of persons between Japan and the ASEAN member countries including rules and regulations concerning market access, as well as to prepare and analyse data and information, and trends on markets;

  ７  第三条(5)を次のように改める。
    　(5)  貿易、投資、観光及び、適当な場合には、人物交流に関する調査及び研究を行うこと。

7. Article III (5) of the Agreement is hereby amended as follows:

 (5) to conduct researches and studies on trade, investment, tourism and, as appropriate, exchanges of persons;

  ８  第三条(6)を次のように改める。
    　(6)  加盟国並びに、適当な場合には、関係する団体及び個人に対し、貿易、投資、観光及び、適当な場合には、人物交流に関する情報（(4)に規定する情報を含む。）並びにセンターによる調査及び研究の成果を提供すること。

8. Article III (6) of the Agreement is hereby amended as follows:

 (6) to provide Members and, as appropriate, related organizations and persons with information on trade, investment, tourism and, as appropriate, exchanges of persons including those mentioned in subparagraph (4) above, as well as the results of researches and studies by the Centre;

  ９  第三条(7)を次のように改める。
    　(7)  必要に応じ、貿易、投資、観光及び、適当な場合には、人物交流に関する技術協力（技術移転に係るものを含む。）を促進すること。

9. Article III (7) of the Agreement is hereby amended as follows:

 (7) to facilitate, whenever necessary, technical cooperation including transfer of technology related to trade, investment, tourism and, as appropriate, exchanges of persons;

  10  第三条(8)を次のように改める。
    　(8)  貿易、投資、観光及び人物交流の分野において加盟国政府並びに関係のある地域的及び国際的な機関との緊密な協力を維持すること。

10. Article III (8) of the Agreement is hereby amended as follows:

 (8) to maintain close cooperation in the fields of trade, investment, tourism and exchanges of persons with the Governments of the Members and relevant regional and international organizations;

11  第三条(9)を次のように改める。
    　(9)  特に学生の間の相互理解を促進するために適当と認められる青少年の交流事業を行うこと。

11. Article III (9) of the Agreement is hereby amended as follows:

 (9) to undertake youth exchange programmes as may be deemed appropriate to promote mutual understanding, in particular among students; and

  12  第三条（9）の次に(10)として次のように加える。
    　(10)  センターの目的を達成するために必要と認められる他の活動を行うこと。

12. After Article III (9) of the Agreement a new paragraph is inserted reading as follows:

 (10) to undertake such other activities as may be deemed necessary to achieve the purpose of the Centre.

  13  第十条２を次のように改める。
  　２  日本国が負担する常設東南アジア諸国連合貿易投資観光展示場の賃借料を除くほか、センターの年次予算は、次の割合で負担する。
　　　  　日本国　八七・五パーセント
　　　  　ＡＳＥＡＮ構成国　一二・五パーセント

13. Article X 2. of the Agreement is hereby amended as follows:

2. Except for the rent of the permanent ASEAN Trade, Investment and Tourism Exhibition Hall, which shall be born by Japan, the annual budget of the Centre shall be met in the following proportion:  Japan: 87.5 per cent, the ASEAN member countries: 12.5 per cent.
