青年海外協力隊の派遣に関する日本国政府とジンバブエ共和国政府との間の交換公文

Harare, July 11, 1988
書簡をもって啓上いたします。本使は、日本国とジンバブエ共和国との間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をジンバブエ共和国に派遣することに関し、日本国政府の代表者とジンバブエ共和国政府の代表者との間でハラーレにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
Honourable Minister, I have the honour to refer to the recent discussions held in Harare between the representatives of the Government of Japan and of the Government of the Republic of Zimbabwe concerning the dispatch of Volunteers to the Republic of Zimbabwe under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as "the Programme") with a view to promoting technical cooperation between the two countries, and to confirm on behalf of the Government of Japan the following understandings reached between them:
1 日本国政府は、ジンバブエ共和国政府の要請に基づき、日本国において施行されている法令に従い、ジンバブエ共和国の社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される計画に従い協力隊員をジンバブエ共和国に派遣するために必要な措置をとる。
1. At the request of the Government of the Republic of Zimbabwe and in accordance with the laws and regulations in force in Japan, the Government of Japan will take necessary measures to dispatch the volunteers to the Republic of Zimbabwe for the purpose of contributing to the social and economic development of the Republic of Zimbabwe, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とジンバブエ共和国との間の渡航費及びジンバブエ共和国における生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Republic of Zimbabwe and living allowances in the Republic of Zimbabwe for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 ジンバブエ共和国政府は、次のことを行う。
3. The Government of the Republic of Zimbabwe shall:
(1) 協力隊員に対して、2にいう装備、機械、材料及び医薬品であって輸入されたものについての関税、物品税、租税その他の課徴金の支払を免除すること。
(1) exempt the volunteers from the payment of customs and excise duties, taxes and charges of any kind in respect of the imported equipment, machinery, materials and medical supplies mentioned in paragraph 2 above;
(2) 協力隊員に対して、ジンバブエ共和国に最初に到着した時に持ち込まれた身回品及び家財であって申告されたものについての関税、物品税、租税その他の課徴金を免除すること。当該物品は、関税・物品税検査官の事前の許可なくして、協力隊員の到着の日の後二年の間は処分することができない。ただし、当該物品は、ジンバブエ共和国における協力隊員の任務の終了時以降は、協力隊員によって自由にジンバブエ国外に持ち出すことができる。
2) exempt the volunteers from the payment of customs and excise duties, taxes and charges of any kind on their declared personal and household effects imported by them into the Republic of Zimbabwe on first arrival. Such effects may not be disposed of until two years after the date of their first arrival, without prior permission of the Controller of Customs and Excise, while such effects may be freely exported by the volunteers on and after the completion of their assignments in the Republic of Zimbabwe;
(3) 協力隊員に対して、所得税を免除すること。
(3) exempt the volunteers from income tax;
(4) 協力隊員に対して、医科及び歯科の診療及び便宜(入院を含む。)を、相当する地位の公務員と同一の基準をもって提供すること。
(4) provide for the volunteers medical and dental services and facilities (hospitalization included) on the same basis as those available to civil servants of comparable status; and
(5) 協力隊員に対して、ジンバブエ共和国政府より与えられる任務を遂行する場所における住居施設を提供すること、又は、月極の住居手当(その額は、ジンバブエ共和国において活動しているすべての外国ボランティアのためにジンバブエ共和国政府が決定する。)若しくは実際の賃借料に相当する額のいずれか少ない方の額を支払うこと。
(5) provide the volunteers with housing accommodations at places where they are to perform their duties as assigned to them by the Government of the Republic of Zimbabwe, or pay the volunteers the monthly housing allowance, which is fixed by the Government of the Republic of Zimbabwe for 811 foreign volunteers working in the Republic of Zimbabwe, or the amount equivalent to the actual rent of houses, whichever is the lesser.
4(1) ジンバブエ共和国政府は、ジンバブエ共和国における計画の活動に関連して日本国政府による技術協力の実施機関である国際協力事業団が与える任務を遂行する駐在員一名及び調整員を受け入れる。
4.(1) The Government of the Republic of Zimbabwe will accept a Representatives and Coordinators who will discharge the duties to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical cooperation extended by the Government of Japan, relative to the activities of the Programme in the Republic of Zimbabwe.
(2) 駐在員及び調整員は、その任務の遂行に必要な装備及び材料並びに身回品及び家財についての関税、物品税、租税その他の課徴金を、関税及び物品税規則に従って免除される。また、駐在員及び調整員は、各一名につき一台の自動車を無税で輸入することを許可される。
(2) The Representative and the Coordinators will be exempted from the payment of customs and excise duties, taxes and charges of any kind in respect of equipment and materials necessary for the performance of their functions as well as of their personal and household effects in accordance with Customs and Excise Regulations. The Representative and the Coordinators will also be allowed duty-free importation of one motorcar each.
(3) 駐在員及び調整員は、海外から送付される手当についての所得税その他の租税を免除される。
(3) The Representative and the Coordinators will be exempted from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas.
5 ジンバブエ共和国政府は、ジンバブエ共和国における協力隊員の公務に起因し、当該公務の遂行中に発生し、又は、当該公務の遂行中における作為又は不作為に関連する請求が生じた場合には、その請求に関する責任を負う。ただし、これらの請求が協力隊員の故意又は重大な過失から生じた場合には、この限りでない。
5. The Government of the Republic of Zimbabwe undertakes to bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteer s in the Republic of Zimbabwe, except when such claims arise from the wilful misconduct or gross negligence on the part of the volunteers.
6 両政府は、ジンバブエ共和国における計画の実施を成功させるため随時協議する。
6. The two Governments will hold consultations, from time to time, for the successful implementation of the Programme in the Republic of Zimbabwe.
7 この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
7. The present understandings may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months I written notice of its intention to terminate them.
本使は、更に、この書簡及び前記の了解をジンバブエ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Honourable Minister's Note in reply confirming the foregoing understandings on behalf of the Government of the Republic of Zimbabwe will constitute agreement between the two Governments, which will enter into force on the date of Your Honourable Minister's reply.

Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本大臣は、更に、前記の了解をジンバブエ共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm the foregoing understandings on behalf of the Government of the Republic of Zimbabwe and to agree that Your Excellency's Note and this reply will constitute an agreement between the two Governments, which will enter into force on the date of this reply.
