NOTE VERBALE
外務省は、在本邦アメリカ合衆国大使館に敬意を表するとともに、十月十八日付同大使館発外務省宛口上書第七百四十四号に言及し、日本国政府が日本国に入国することを希望するアメリカ合衆国国民に対する査証の免除に関し、千九百八十八年十二月十五日から次の措置をとる用意を有することを同大使館に通報する光栄を有する。
The Ministry of Foreign Affairs presents its compliments to the Embassy of the United States of America and with reference to the Embassy's Note Verbale No. 744 dated October 18, 1988, has the honour to inform the Embassy that the Government of Japan is prepared to take the following measures as from December 15, 1988 concerning the waiving of visas for the nationals of the United States of America seeking entry to Japan.
(1) 有効なアメリカ合衆国旅券を所持するアメリカ合衆国国民であつて、継続して九十日をこえない期間滞在する意図をもつて日本国への入国を希望するものは、査証を取得することなく、日本国に入国することができる。
(1) The nationals of the United States of America in possess ion of valid passports the United States of America who are seeking entry into Japan with the intention of staying there for a period not exceeding ninety consecutive days, may enter Japan without obtaining a visa.
(2) (1)の規定に基づく査証の要件の免除は、アメリカ合衆国国民であつて、報道機関の活動に従事する目的をもつて日本国に入国することを希望するもの、又はアメリカ合衆国国民であつて、就職し、永住し、自由職業若しくは他の生業を営み、若しくは報酬を得る目的で芸能(スポーツを含む)に従事する意図をもつて日本国に入国することを希望するものについては、適用しない。
(2) The waiver of the visa requirements under paragraph (1) above shall not apply to the nationals of the United States of America who desire to enter Japan with the purpose of engaging in the activities of information media or with the intention of seeking employment or permanent residence, of exercising a profession or other occupation or of engaging in a public entertainment (including sport) for remunerative purposes.
(3) (1)の規定に基づく査証の要件の免除は、日本国に入国するアメリカ合衆国国民に対し、外国人の入国、滞在、居住、出国及びその他の管理に関する日本国の法令に服する義務を免除するものではない。
(3) The waiver of the visa requirements under paragraph (1) above does not exempt the nationals of the United States of America entering Japan from the necessity of complying with the laws and regulations of Japan concerning the entry, stay, residence, exit, and other control over aliens.
(4) 日本国政府は、好ましくないと認めるアメリカ合衆国国民に対し、日本国に入国し又は滞在することを拒否する権利を留保する。
(4) The Government of Japan reserves the right to refuse the entry into or stay in Japan to the nationals of the united States of America considered undesirable.
(5) 日本国政府は、公の政策上の理由により前記の規定の全部又は一部を一時的に停止することができる。このような停止は、外交上の経路を通じてアメリカ合衆国政府に直ちに通告する。
(5) The Government of Japan may temporarily suspend the foregoing provisions in whole or in part for reasons of public policy. Any such suspension will be notified immediately to the Government of the United States of America through the diplomatic channel.
(6) 日本国政府は、合衆国移民・国籍法第二百十七条により認められた査証免除パイロット・プログラムに関連し、アメリカ合衆国政府が同プログラムに基づく日本国国民に対する査証免除措置を終了させるときには、相互主義に基づき、前記の諸規定を終了させることができる。
(5) With respect to the Visa Waiver Pilot Program authorized by Sec. 2l7 of the United States Immigration and Nationality Act, the Government of Japan may terminate the foregoing on a reciprocal basis if the Government of the United States of America terminates the waiving of visas for the nationals of Japan under the said Program.

アメリカ合衆国大使館は、外務省に敬意を表するとともに、移民・国籍法第二百十七条により認められた非移民査証免除パイロット・プログラムが、日本国民であつて日本国旅券を所持する者に対し、千九百八十八年十二月十五日より適用される旨同省に通報する光栄を有する。同プログラムは、日本国政府が同様の査証免除を行うことを条件として、日本国民であつて次に該当する者に対し、自発的に適用される。
The Embassy of the United States of America presents its compliments to the Ministry of Foreign Affairs and has the honor to inform the Ministry that as of 15 December l988, the Non-immigrant Visa waiver Pilot Program authorized by Section 217 of the Immigration and Nationality Act will be available to citizens and passport bearers of Japan. On the basis of the Government of Japan's according a similar waiver of visa requirements, the program will be available, voluntarily to Japanese citizens who:
A 九十日をこえない期間、商用又は娯楽を目的とする一時的訪問者として入国を希望する者
A. Seek admission as temporary visitors for business or pleasure for a period not exceeding ninety days;
B 必要とされる所定の書式に記入した者
B. Complete such forms as may be required;
C 関係法令に従つて審査され及び入国を許可される者
C. Are inspected and admitted according to the applicable laws and regulations;
D 次に掲げる譲渡不可の往復運送切符を所有する者
D. Are in possession of round-trip, non-transferable transportation tickets which:
(1) 少なくとも一年の期間、有効であるもの
(1) Are valid for a period of not less than one year;
(2) 発行された国又は当該外国人の国籍国若しくは居住国以外において償還不可てあるもの
(2) Are nonrefundable except in the country in which issued or in the country of the alien's nationality or residence;
(3) 関係当局との間の取決めを締結している運送業者により発行されたものであつて、旅行者の訪問の終了時に、当該外国人を合衆国の外に運送することを保証するもの
(3) Are issued by a carrier which has entered into an agreement between the carrier and the appropriate civil authority and guarantee transport of the alien out of the country at the end of the traveler's visit;
E 合衆国の福祉、衛生、安全、又は公安に対する脅威とならないと決定された者
E. Have been determined not to represent a threat to the welfare, health, safety or security of the United States;
F 以前にこのプログラムに基づき無査証で入国を許可された者の場合には、非移民旅行者としての以前の入国許可条件を満たしている者
F. Have complied with the conditions of any previous admission as nonimmigrant travelers if previously admitted without visas under the program.
このパイロット・プログラムは、千九百九十一年九月三十日まで効力を有する。アメリカ合衆国政府は同プログラムの終了又は新たなプログラムによる引継ぎがなされるときの二箇月前に、その旨を書面により通告するものとする。
This pilot program will remain in effect until September 30, 1991 and the Government of the United States of America will give a written notice two months before the termination of the program or its replacement by a successor program.
このプログラムの適用上、合衆国とは合衆国本土、アラスカ、ハワイ、プエルトリコ、グアム及びヴァージン諸島をいう。
For purposes of this program, the United States means the Continental United States, Alaska, Hawaii, Puerto Rico, Guam and the Virgin Islands of the United States.
アメリカ合衆国大使館は、以上を申し進めるに際し、ここに重ねて外務省に向かつて敬意を表する。
