　書簡をもつて啓上いたします。本大臣は、千九百八十三年十一月八日付けの日本国とアメリカ合衆国との間の相互防衛援助協定に基づくアメリカ合衆国に対する武器技術の供与に関する交換公文の附属書に言及するとともに、日本国政府の代表者とアメリカ合衆国政府の代表者との間で最近行われた前記附属書(2)の修正に関する討議において到達した了解に基づき、前記の交換公文附属書(2)を次のとおり改めることを日本国政府に代わつて提案する光栄を有します。

　Sir,
I have the honor to refer to the ANNEX attached to the Exchange of Notes concerning the Transfer of Military Technologies to the United States of America under the Mutual Defense Assistance Agreement between Japan and the United States of America dated November 8, 1983, and, on the basis of the understanding reached between the representatives of the Government of Japan and the Government of the United States of America in their recent discussions concerning the amendment to (2) of the above-mentioned ANNEX, to propose, on behalf of the Government of Japan, that (2) of the ANNEX be amended as follows:


(2)(a)　(1)にいう「武器」は、前記方針において「輸出貿易管理令別表第一の第一七二の項から第一八三の項までに掲げる物品のうち軍隊が使用するものであつて、直接戦闘の用に供されるもの」と定義されている。同方針は、武器」製造関連設備は「武器」に準じて取り扱う旨明らかにしている。

(2)(a) The term "arms" as referred to above is defined in the said Policy Guideline as "goods which are listed from Item No. 172 to Item No. 183 of Annexed List 1 of the Export Trade Control Order of Japan, and are to be used by military forces and directly employed in combat". The said Policy Guideline proclaims that equipment related to "arms" production will be treated in the same manner as "arms". (b) The relevant part of Annexed List 1 of the Export Trade control Order:

　本大臣は、更に、前記の提案がアメリカ合衆国政府により受諾される場合には、この書簡及びアメリカ合衆国政府に代わつて受諾する旨の貴官の返簡が両政府間の合意を構成するものとみなすこと、並びにその合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。


							

						

						

							

								
　I have further the honor to propose that, if the above-mentioned proposal is acceptable to the Government of the United States of America, the present Note and your reply of acceptance on behalf of the Government of the United States of America be regarded as constituting an agreement between the two Government, and such agreement enter into force on the date of your reply.
