AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF ITALY ON COOPERATION IN SCIENCE AND TECHNOLOGY
日本国政府及びイタリア政府は、
The Government of Japan and the Government of Italy,
両国間の緊密かつ友好的な関係を一層促進することを希望し、また、科学的知識の急速な拡大並びにそれが二国間の及び国際的な協力の促進において果たしている積極的な貢献を認識し、
Desiring to further promote the close and friendly relations existing between their two countries, and being aware of the rapid expansion of scientific knowledge and of its positive contribution in promoting bilateral and international cooperation,
平和的目的及び相互利益のための豊かな協力関係の創造を通じた科学技術協力の範囲を広げることを希望し、
Wishing to broaden the scope of scientific and technological cooperation through the creation of a productive partnership for peaceful purposes and for their mutual benefit,
科学技術協力が、適当な場合には公的部門及び民間部門の諸組織により支援されて、拡大することが望ましいことを認め、
Recognizing the desirability of the expansion of scientific and technological cooperation, as appropriate, supported by entities in the public and private sectors, and
科学技術における協力の一層の強化を確保することを確認し、
Affirming their commitment to further strengthen cooperation in science and technology,
次のとおり協定した。
Have agreed as follows:
第一条 両国政府は、平和的目的のため、平等及び相互利益の原則に基づき、相互に合意される科学技術分野における協力活動を行う。
ARTICLE I The two Governments will develop Cooperative activities in such areas of science and technology as may be mutually agreed for peaceful purposes on the basis of equality and mutual benefit.
第二条 1 この協定に基づく協力活動の形態には、次のものを含めることができる。
ARTICLE II Forms of the cooperative activities under this Agreement may include:
A 一般的な又は特定の問題の科学的及び技術的側面に関する討議及び情報の交換を行うための並びに協力を基礎として有益に実施することができる研究開発に関する計画を識別するための専門家の会合のような各種の形態の会合
A. Meetings of various forms, such as those of experts, to discuss and exchange information on scientific and technological aspects of general or specific subjects and to identify research and development projects and programs that may be usefully undertaken on a cooperative basis;
B 研究開発に関する活動、政策、慣行及び法令に関する情報の交換
B. Exchange of information on activities, policies, practices, and laws and regulations concerning research and development;
C 一般的な又は特定の問題に関する科学者、技術者その他の専門家の訪問及び交流
C. Visits and exchanges of scientists, technical personnel, or other experts on general or specific subjects;
D 合意された協力計画の実施
D. Implementation of agreed cooperative projects and programs; and
E 相互に合意されるその他の形態の協力活動
E. Other forms of cooperative activities as may be mutually agreed.
第三条 1 この協定に基づく特定の協力活動の細目及び手続を定める実施取極は、両国政府又は両国政府の機関のいずれか適当なものを当事者として行うことができる。
ARTICLE III 1. Implementing arrangements setting forth the details and procedures of the specific cooperative activities under this Agreement may be made between the two Governments or their agencies, whichever is appropriate.
2 この協定の発効時に存在している日伊科学技術協力協議の下での協力活動は、この協定の下に組み入れられる。
2. Cooperative activities under the Japan-Italy Consultation on Cooperation in Science and Technology existing at the time of the entry into force of this Agreement are incorporated under this Agreement.
第四条 1 この協定を効果的に実施するため、両国政府は、合同委員会を設置するものとし、その任務は、次のとおりとする。
ARTICLE IV 1. For the purpose of effective implementation of this Agreement, the two Governments will establish a Joint Committee, the functions of which will be:
A 科学技術政策問題に関する情報及び意見を交換すること
A. Exchanging information and views on scientific and technological policy issues;
B この協定に基づく協力活動及び成果を検討し討議すること
B. Reviewing and discussing the cooperative activities and accomplishments under this Agreement; and
C この協定の実施に関する助言(この協定に基づく協力活動の識別及び提案並びにそれらの活動の実施の奨励を含めることができる。)を両国政府に対し供与すること
C. Providing advice to the two Governments with regard to the implementation of this Agreement, which may include identification and proposition of the cooperative activities thereunder and encouragement of their implementation.
2 合同委員会は、相互に合意する時期に日本国及びイタリアにおいて交互に会合する。
2. The Joint Committee will meet alternately in Japan and Italy at mutually agreed times.
第五条 1 この協定に基づく協力活動から生ずる非所有権的性格の科学的及び技術的情報は、通常の経路を通じ、かつ、参加機関の一般的な手続に従い、いずれの政府によつても一般の利用に供することができる。
ARTICLE V 1. Scientific and technological information of a non-proprietary nature arising from the cooperative activities under this Agreement may be made available to the public by either Government through customary channels and in accordance with the normal procedures of the participating agencies.
2 両国政府は、この協定に基づく協力活動から生ずる知的所有権又は所有権的性格を有する他の権利の保護及び配分につき十分な考慮を払うものとし、必要に応じ、この目的のために相互に協議する。
2. The two Governments will give due consideration to the protect ion and the distribution of intellectual property rights or other rights of a proprietary nature resulting from the cooperative activities under this Agreement and will consult with each other for this purpose as necessary.
第六条 1 この協定の実施は、関係予算及びそれぞれの国において施行されている法令に従うことを条件とする。
ARTICLE VI 1. Implementation of this Agreement will be subject to the pertinent budgetary appropriations and to the laws and regulations in force in each country.
2 この協定に基づく協力活動のための費用は、相互に合意されるところに従つて負担される。
2. Costs for the cooperative activities under this Agreement will be borne as may be mutually agreed.
第七条 この協定のいかなる規定も、両国政府間の協力に関する他の協定でこの協定の署名の日に存在するもの又はその後締結されるものに影響を及ぼすものとは解されない。
ARTICLE VII Nothing in this Agreement will be construed to prejudice other agreements for cooperation between the two Governments, existing at the date of signature of this Agreement or concluded thereafter.
第八条 1 この協定は、署名の日に効力を生ずる。この協定は、二年間效力を有し、その後は、最初の二年の期間の終わりに又はその後いつでもいずれか一方の政府が他方の政府に対しこの協定を終了させる意思を少なくとも六箇月の事前の予告をもつて書面により通告することによつて終了させない限り効力を存続する。
ARTICLE VIII 1.This Agreement will enter into force on the date of signature thereof. It will remain in force for two years and will continue in force thereafter unless terminated by either Government at the end of the initial two-year period or at any time thereafter by giving to the other Government at least six months' written advance notice of its intention to terminate this Agreement.
2 この協定の終了は、この協定に基づいて行われ、かつ、この協定の終了の時までに履行を完了していないいかなる計画の実施にも影響を及ぼすものではない。
2. The termination of this Agreement will not affect the carrying out of any project or program undertaken under this Agreement and not fully executed at the time of the termination of this Agreement.
