青年海外協力隊の派遣に関する日本国政府とジャマイカ政府との間の交換公文

Kingston, December 2, 1987
書簡をもつて啓上いたします。本官は、日本国とジャマイカとの間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をジャマイカに派遣することに関し、日本国政府の代表者とジャマイカ政府の代表者との間でキングストンにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held in Kingston between the representatives of the Government of Japan and of the Government of Jamaica concerning the dispatch of volunteers to Jamaica under the Japan Overseas Co-operation Volunteers Programme (hereinafter referred to as "the Programme ") with a view to promoting technical co-operation between the two countries and to confirm on behalf of the Government of Japan the following under standings reached between them:
1 日本国政府は、ジャマイカ政府の要請に基づき、日本国の現行法令に従い、ジャマイカの社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される計画に従い協力隊員を派遣する。
1. At the request of the Government of Jamaica the Government of Japan will, in accordance with the laws and regulations in force in Japan, dispatch the volunteers for the purpose of contributing to the social and economic development of Jamaica, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とジャマイカとの間の渡航費及びジャマイカにおける生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与する。
2. The Government of Japan will, subject to budgetary appropriations, bear the cost of international travel between Japan and Jamaica and living allowances in Jamaica for the volunteers and make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 ジャマイカ政府は、協力隊員に対し、次の特権、免除及び利益を与える。
3. The Government of Jamaica will grant the volunteers the following privileges, exemptions and benefits:
(1) 2にいう装備、機械、材料及び医薬品に関して、関税、租税その他の課徴金の免除
(1) Exemption from customs duties, taxes and charges of any kind in respect of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
(2) 協力隊員の身回品及び家庭用品に関して、関税、租税その他の課徴金(港湾荷役、保管、運送及び類似の役務に関するものを除く。)の免除
(2) Exemption from customs duties, taxes and charges of any kind other than those for port handling, storage, cartage and similar services in respect of their personal and household effects.
(3) 2にいう生活手当等協力隊員に対して海外から送金される手当に関して、所得税その他の課徴金の免除
(3) Exemption from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas such as living allowances mentioned in paragraph 2 above.
(4) 協力隊員のジャマイカにおける任期中の無料診療
(4) Free medical care during the term of their assignment in Jamaica.
(5) 協力隊員がジャマイカ政府より与えられる任務を遂行する場所における無料の住居施設
(5) Rent-free housing accommodations at places where they are to perform their functions to be assigned to them by the Government of Jamaica.
4(1) ジャマイカ政府は、ジャマイカにおける計画の活動に関連して日本国政府による技術協力の実施機関である国際協力事業団が与える任務を遂行する駐在員一名及び調整員を受け入れる。
4. (1) The Government of Jamaica will accept a Representative and Co-ordinators who will discharge the functions to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical cooperation of the Government of Japan, relative to the activities of the programme in Jamaica.
(2) 駐在員及び調整員は、任務の遂行に必要な装備及び機械並びに身回品及び家庭用品に関して、関税、租税その他の課徴金(港湾荷役、保管、運送及び類似の役務に関するものを除く。)を免除される。
(2) The Representative and the Co-ordinators will be exempted from customs duties, taxes and charges of any kind other than those for port handling, storage, cartage and similar services in respect of equipment and materials necessary for the performance of their functions as well as of their personal and household effects. The Representative and the Co-ordinators will also be allowed duty-free importation from abroad or purchase from bond in Jamaica of one motorcar each.
(3) 駐在員及び調整員は、海外から送付される手当に関して、所得税その他の課徴金を免除される。
(3) The Representative and the Co-ordinators will be exempted from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas.
5 ジャマイカ政府は、ジャマイカにおける協力隊員の公務に起因し、当該公務の遂行中に発生し、又は、当該公務の遂行中における作為又は不作為に関連する請求が生じた場合には、その請求に関する責任を引き受ける。ただし、両政府がこれらの請求が協力隊員の故意又は重大な過失から生じたことを合意する場合には、この限りでない。
5. The Government of Jamaica undertakes to bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in Jamaica, except when two Governments agree that such claims arise from the willful misconduct or gross negligence on the part of the volunteers.
6 両政府は、ジャマイカにおける計画の実施を成功させるため随時協議する。
6. The two Governments will hold consultation from time to time, for the successful implementation of the Programme in Jamaica.
7(1) この了解は、両政府間の書簡の交換によつて修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によつて通告することにより終了させることができる。
7. (1) The understandings set out above may be amended by exchange of notes between the two Governments and terminated by either Government by giving the other six months I written notice of its intention to terminate them.
(2) この了解の終了は次のことに影響を与えるものではない。
(2) The termination of the present understandings will not affect:
(a) 協力隊員の任務(当該任務は、両政府間の別段の合意がある場合を除くほか、1にいう計画が終了するそれぞれの日まで継続される。)
(a) the functions performed the volunteers, which will continue until each date of completion of the schedules mentioned in paragraph 1. above unless the two Governments agree otherwise; and
(b) 前記の計画に関連した任務を遂行するためにジャマイカに滞在する協力隊員に対する特権、免除及び利益
(b) the privileges, exemptions and benefits accorded to the volunteers remaining in Jamaica for the performance of their duties in connection with the said schedules.
本官は、更に、この書簡及び前記の了解をジャマイカ政府に代わつて確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of Jamaica the foregoing understandings shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

Sir, I have the honour to acknowledge the receipt of your Note of today‘s date, which reads as follows:

本大臣は、更に、前記の了解をジャマイカ政府に代わつて確認するとともに、貴官の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of Jamaica the foregoing under standings and to agree that your Note and this Note shall be regarded as constituting an agreement between the two Governments which will enter into force on the date of this reply.
本大臣は、以上を申し進めるに際し、ここに重ねて貴官に向かつて敬意を表します。
