青年海外協力隊の派遣に関する日本国政府とインドネシア共和国政府との間の交換公文

Jakarta, August 7, 1987
書簡をもつて啓上いたします。本使は、日本国とインドネシア共和国との間の技術協力を促進する目的で、開発途上国に対し技術協力のため協力隊員を派遣する日本国政府の計画である青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をインドネシア共和国に派遣することに関し、日本国政府の代表者とインドネシア共和国政府の代表者との間でジャカルタにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held in Jakarta between the representatives of the Government of Japan and the Government of the Republic of Indonesia concerning the dispatch of junior experts under the Seinen Kaigai Kyooryokutai Programme, a government-sponsored programme to dispatch junior experts to developing countries for technical cooperation, (hereinafter referred to as "the Programme") to the Republic of Indonesia with a view to promoting technical cooperation between the two countries, and to confirm on behalf of the Government of Japan the following understandings reached between tehm:
1 日本国政府は、インドネシア共和国政府の要請に基づき、日本国の現行法令に従い、インドネシア共和国の社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される計画に従い協力隊員をインドネシア共和国に派遣するために必要な措置をとる。
1. At the request of the Government of the Republic of Indonesia and in accordance with the laws and regulations in force in Japan, the Government of Japan will dispatch the junior experts to the Republic of Indonesia for the purpose of contributing to the social and economic development of the Republic of Indonesia, according to the schedules to be separately agreed upon by the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とインドネシア共和国との間の渡航費及びインドネシア共和国における生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, bear the cost of international travel between Japan and Republic of Indonesia and living allowance in the Republic of Indonesia for the junior experts and provide such equipment, machinery, materials and medical supplies as necessary for the performance of their duties.
3 インドネシア共和国政府は、次のことを行う。
3. The Government of the Republic of Indonesia will:
a 2にいう生活手当等協力隊員に対して日本国政府から送付される手当に関して、協力隊員に対する所得税その他の公の課徴金を徴収しないこと。
a. levy neither income tax nor other public charges on the junior experts in respect of any allowances to be remitted for them from the Government of Japan such as the living allowances mentioned in paragraph 2 above.
b 2にいう装備、機械、材料及び医薬品に関し、関税、租税その他の課徴金を免除すること。
b. exempt the junior experts from custom duties, taxes and other charges in respect of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
c 協力隊員がインドネシア共和国に到着してから六箇月の間に持ち込まれた協力隊員の任務に必要な身回品及び家庭用品に関し、関税及び租税を免除すること。
c. exempt the junior experts from customs duties and taxes in respect of their personal and household effects necessary for their assignment, which are brought into Indonesia within six months of their first arrival.
d 協力隊員に対し、インドネシア共和国の政府職員が利用できる診療と同様の診療を提供すること。
d. provide the junior experts with medical care similar to the one that is available for the official of the Government of the Republic of Indonesia.
e 協力隊員に対し、当該隊員がインドネシア共和国政府より与えられる任務を遂行する場所において、事情が許すときは、住居施設を提供すること。
e. provide the junior experts with housing accommodations when circumstances permit at places where they are to perform their functions to be assigned to them by the Government of the Republic of Indonesia.
4 インドネシア共和国政府は、インドネシア共和国における協力隊員の公務に起因し、当該公務の遂行中に発生し、又は、当該公務の遂行中における作為又は不作為に関連する請求が生じた場合には、その請求に関する責任を負う。ただし、これらの請求が協力隊員の故意又は重大な過失から生ずる場合には、この限りでない。
4. The Government of the Republic of Indonesia under takes to bear claims, if any arise, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the junior experts in the Republic of Indonesia, except when such claims arise from wilful misconduct or gross negligence on the part of the junior experts.
5 両政府は、インドネシア共和国における計画の実施を成功させるため随時協議する。
5. The two Governments shall enter into consultations, from time to time, for the successful implementation of the Programme in the Republic of Indonesia.
6 この了解は、両政府間の書簡の交換によつて修正することがでる。
6. The understandings set out above may be amended by an exchange of letters between the two Governments.
7a この了解は、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によつて通告することにより終了させない限り、二年間効力を有する。
7. a. The present understandings shall remain in force for a period of two years, unless terminated by either Government by giving to the other six months' written notice of its intention to terminate them
b いずれの政府も、この了解が終了する六箇月前までにこの了解を更に二年間延長することを書面によつて提案することができる。
b. Either Government may propose, in written statement, the extention of another two years of the present understandings at the latest six months before their termination.
c この了解の終了は、両政府間の別段の合意がある場合を除くほか1にいう計画が終了するまでの間協力隊員が遂行する任務に影響を与えるものではなく、また、当該計画に関連した任務を遂行するためにインドネシア共和国に滞在する協力隊員に対する特権、免除及び利益に影響を与えるものではない。
c. The termination of the present understandings will neither affect the functions being performed by the junior experts until the date of the completion of the schedules mentioned in paragraph 1 above, unless otherwsise the two Governments agree, nor affect the privileges, exemptions and benefits accorded to the junior experts staying in the Republic of Indonesia for the performance of their duties in connection with the said schedules.
前記の了解がインドネシア共和国政府にとつて受諾し得るものであるときは、本使は、更に、この書簡及びそれに同意する閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that, if the foregoing understandings are acceptable to the Government of the Republic of Indonesia, this Note and Your Excellency's reply Note concerning therein shall constitute an agreement between the two Governments, which shall take effect on the date of Your Excellency's reply Note.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

書簡をもつて啓上たいします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本官は、更に、前記の了解をインドネシア共和国政府に代わつて確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに合意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Republic of Indonesia the understandings set forth in Your Excellency's Note and to agree that Your Excellency's Note and this reply Note shall constitute an agreement between the two Governments, which shall take effect on the date of this reply Note.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
