航空業務に関する日本国とオーストラリア連邦との間の協定の付表の修正に関する交換公文

書簡をもつて啓上いたします。本大臣は、千九百五十六年一月十九日に東京で署名された航空業務に関するオーストラリア連邦と日本国との間の協定(以下「協定」という。)に関して千九百八十七年一月二十八日から三十日までの間キャンベラにおいてオーストラリア及び日本国の航空当局の間で行われた協議に言及する光栄を有します。
Excellency, I have the honour to refer to the consultations held in Canberra on January 28-30, 1987 between the aeronautical authorities of Australia and Japan concerning the Agreement between the Commonwealth of Australia and Japan for Air Services signed at Tokyo on January 19, 1956 (hereinafter referred to as the "Agreement").
本大臣は、前記の協議において到達した了解に従い、協定の付表が次のとおり修正されるべき旨をオーストラリア政府に代わつて提案する光栄を有します。
Pursuant to the understanding reached at the said consultations, I now have the honour to propose, on behalf of the Government of Australia, that the Schedule to the Agreement be amended as follows:

日本国の指定航空企業が両方向に運営する路線は、次のとおりとする。
Routes to be operated in both directions by the designated airline of Japan shall be as follows:
1日本国内の地点－香港－マニラーインドネシア内の一地点―ダーウィンーシドニー、メルボルン、ブリスベン、パース、アデレイド、ケアンズ及びタウンズビルのうち五地点
1. Points in Japan - Hong Kong - Manila - a point in Indonesia - Darwin - any five of either Sydney, Melbourne, Brisbane, Perth, Adelaide, Cairns or Townsville.
2日本国内の地点―グァムーシドニー
2. Points in Japan - Guam - Sydney.
注1日本国の指定航空企業が前記の路線において行う協定業務は、日本国の領域内の一地点を起点としなければならないが、その路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によつて省略することができる。
Notes: 1. The agreed services provided by the designated airline of Japan on these routes shall begin at a point in the territory of Japan, but other points on either of these routes may, at the option of the designated airline, be omitted on any or all flights.
注2日本国の指定航空企業は、路線1において選択するオーストラリア内の地点をオーストラリアの航空当局に通報する。その地点は、九十日前にオーストラリアの航空当局に通知することにより、変更することができる。
2. The designated airline of Japan shall inform the aeronautical authorities of Australia of its selection of the alternative points in Australia referred to in route 1 and may, upon giving 90 days notice to the aeronautical authorities of Australia, change its selection.
注3日本国の指定航空企業は、メルボルン、ブリスベン、パース、アデレイド、ケアンズ又はタウンズビルと路線1の中間地点との間で、第五の自由の運輸権を行使してはならない。
3. The designated airline of Japan shall not exercise fifth freedom traffic rights between Melbourne, Brisbane, Perth. Adelaide, Cairns or Townsville and any intermediate point on route 1.
注4日本国の指定航空企業は、オーストラリア内で積み込んだ貨客をオーストラリア内で積み卸してはならない。
4. The designated airline of Japan shall not put down in Australia traffic taken on board in Australia.
注5オーストラリア内で路線1に関して認められた六地点については、日本国の指定航空企業は、同一の業務においていかなる組合せの六以下の地点へも運航することができる。
5. In respect of route 1, the designated airline of Japan shall be entitled to serve, on the same service, any number of its six authorized points in Australia and in any combination.
オーストラリアの指定航空企業が両方向に運営する路線は、次のとおりとする。
Routes to be operated in both directions by the designated airline of Australia shall be as follows:
1 オーストラリア内の地点―インドネシア内の一地点―マレイシアのサバ州又はラブアン島内の一地点－マニラ―香港―東京、大阪、名古屋、福岡、長崎、鹿児島及び那覇のうち五地点
1. Points in Australia - a point in Indonesia - a point in Sabah or Labuan in Malaysia - Manila - Hong Kong - any five of either Tokyo, Osaka, Nagoya, Fukuoka, Nagasaki, Kagoshima or Naha.
2 オーストラリア内の地点―グァム－東京
2. Points in Australia - Guam - Tokyo.
注1オーストラリアの指定航空企業が前記の路線において行う協定業務は、オーストラリアの領域内の一地点を起点としなければならないが、その路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によつて省略することができる。

3. The designated airline of Australia shall not exercise fifth freedom traffic rights between Osaka, Nagoya, Fukuoka, Nagasaki, Kagoshima or Naha and any intermediate point on route 1.
注4オーストラリアの指定航空企業は、日本国内で積み込んだ貨客を日本国内で積み卸してはならない。
4. The designated airline of Australia shall not put down in Japan traffic taken on board in Japan.
注5日本国内で路線1に関して認められた五地点については、オーストラリアの指定航空企業は、同一の業務においていかなる組合せの五以下の地点へも運航することがてきる。
5. In respect of route 1, the designated airline of Australia shall be entitled to serve, on the same service, any number of its five authorized points in Japan and in any combination.
注6オーストラリアの指定航空企業は、関西国際空港が開港された後直ちに、大阪への業務を開始することができる。
6. The designated airline of Australia may commence services to Osaka as soon as the Kansai International Airport becomes operational.
本大臣は、更に、前記の提案が日本国政府にとつて受諾し得るものであるときは、この書簡及び受諾を表明する閣下の返簡を両国政府間の合意を構成するものとみなし、その合意か閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
If the above proposal is acceptable to the Government of Japan I have further the honour to propose that this Note together with Your Excellency's Note in reply indicating such acceptance shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of Your Excellency's reply.
本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

書簡をもつて啓上いたします。本使は、本日付けの貴大臣の次の書簡に言及する光栄を有します。
Sir, I have the honour to refer to your Note of today's date, which reads as follows:

本使は、更に、日本国政府がオーストラリア政府の前記の提案を受諾する旨を貴大臣に通報するとともに、貴大臣の書簡及びこの返簡が両国政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。
I have further the honour to inform you that the Government of Japan accepts the above proposal of the Government of Australia and to confirm that your Note and this Note in reply shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of this reply.
本使は、以上を申し進めるに際し、ここに重ねて貴大臣に向かつて敬意を表します。
