国際連合工業開発機関工業投資促進事務所のための拠出に関する日本国政府と国際連合工業開発機関との間の交換公文

(Japanese Note)

　Vienna, 24 June 1986

　書簡をもつて啓上いたします。本使は、開発途上国における工業投資の促進のための国際連合工業開発機関工業投資促進事務所(以下「事務所」という。)のための日本国政府の拠出に関して千九百八十四年六月十九日にウィーンで行われた日本国政府と国際連合工業開発機関(以下「UNIDO」という。)との間の書簡の交換に言及するとともに、事務所を日本国に設置して行うUNIDOの複数の地域を対象とする事業(以下事業」という。)の期間が千九百八十六年六月三十日に終了することを考慮して、事業に関する次の取極を日本国政府に代わつて提案する光栄を有します。

　Sir, I have the honour to refer to the Exchange of Notes between the representatives of the Government of Japan and of the United Nations Industrial Development Organization (hereinafter referred to as "UNIDO") done at Vienna on June 19, 1984 concerning the contribution of the Government of Japan for the UNIDO Service for the Promotion of Industrial Investment in Developing Countries (hereinafter referred to as "the Service") and, taking into account that the interregional project of UNIDO for the establishment in Japan of the Service (hereinafter referred to as "the Project") terminates on June 30, 1986, to propose on behalf of the Government of Japan the following arrangements in respect of the Project:

1　事業は、工業協力の分野において、投資事業の促進及びこれらに関連する技術の移転についての日本国と開発途上国との協力を強化することを目的とする。この目的は、国際連合における開発途上国の工業化のための機関であるUNIDOと日本国の企業との緊密なかつ信頼のある接触によつて達成されることとなる。

1. The objective of the Project is to strengthen the co-operation between Japan and the developing countries in the area of industrial co-operation, in the promotion of investment projects and the related transfer of technology. This objective will be furthered by close and trustful contacts between UNIDO as the UN Organization for the industrialization of developing countries and Japanese enterprises.

2　この取極の対象となる事業の期間は、千九百八十六年七月一日から千九百八十九年六月三十日までとする。

2. The duration of the Project covered by the present arrangmements shall be from July 1,1986 to June 30, 1989.

3　日本国政府は、日本国において施行されている法令に従つて、事業に要する経費を負担するため、UNIDOに対し、UNIDOの工業開発基金に対する目的指定拠出として百二十万合衆国ドル(一、二〇〇、〇〇〇合衆国ドル)に相当する額を限度とする額の供与を日本円で行う。事業に対する一年目の拠出については、三十五万合衆国ドル(三五〇、〇〇〇合衆国ドル)に相当する額の供与を日本円で行う。二年目及び三年目の拠出については、日本国において施行されている法令に従つて行う。

3. The Government of Japan, in accordance with the laws and regulations in force in Japan, shall place at the disposal of UNIDO for the purpose of meeting the costs of the Project as a special-purpose contribution to the Industrial Development Fund of UNIDO an amount up to the equivalent of one million two hundred thousand US dollars (US$1,200,000) payable in Japanese yen. Concerning the financial contribution for the first one (1) year of the Project, the amount to be placed shall be the equivalent of three hundred and fifty thousand US dollars (US$350,000) in Japanese yen. The financial contribution for the second and third year shall be made in accordance with the laws and regulations in force in Japan.

4　UNIDOは、その財政規則及び他の関連規則に従つて日本国政府による目的指定拠出を管理するものとし、要請のあつたときは、日本国政府に対し、支払に係る領収書の詳細な一覧表及び関係する会計検査報告書を提出する。

4. UNIDO shall administer the special-purpose contribution of the Government of Japan in accordance with its financial rules and other applicable regulations and shall make available a detailed list of vouchers on which payments were made and the relevant auditing report to the Government of Japan at its request.

5　事務所の職員の採用は、UNIDOの職員規則に従つて行う。事務所長は、日本国政府との協議の上、かつ、その意見を尊重しつつ任命する。

5. The recruitment of personnel for the Service shall be effected in accordance with the staff rules and regulations of UNIDO. The appointment of the Head of the Service will be made after consultation with and respecting the opinion of the Government of Japan.

6　東京の事務所及びその職員に対して、国際連合の特権及び免除に関する条約を適用することを確認する。日本国が専門機関の特権及び免除に関する条約をUNIDOについて適用することとしたときは、同条約を適用する。

6. It is confirmed that the Convention on the Privileges and Immunities of the United Nations (1946) applies to the Service in Tokyo and its personnel until the Convention on the Privileges and Immunities of the Specialized Agencies enters into effect for Japan with respect to UNIDO, after which time the latter convention shall apply.

7　この取極から生ずる問題についての日本国政府からUNIDOに対する及びUNIDOから日本国政府に対するいかなる公的な連絡も、在オーストリア日本国大使館を通じて行う。

7. Any official communication from the Government of Japan to UNIDO and from UNIDO to the Government of Japan with regard to matters arising from the present arrangements shall be made through the Embassy of Japan in Austria.

8　この取極の実施に必要な他のすべての細目は、一年目については千九百八十六年六月三十日前に、二年目及び三年目についてはそれぞれ千九百八十七年六月三十日前及び千九百八十八年六月三十日前に、日本国政府とUNIDOとの間で交渉し、取り決める。

8. All other details necessary to implement the arrangements for the first year shall be negotiated and arranged between the Government of Japan and UNIDO before June 30, 1986, and for the second and third year before June 30, 1987 and 1988, respectively.

9　UNIDOは、事業の終了の後遅くとも六箇月以内に、日本国政府に対し、事業の実施に関する最終報告書(日本国政府によつて行われた目的指定拠出の運用に係る最終的な決算書を含む。)を提出する。最終報告書には、この取極の終了の遅くとも六箇月前に日本国政府及びUNIDOの双方によつて行われる合同評価を基礎としてUNDIOが事業について行う評価を含める。

9. UNIDO shall submit to the Government of Japan not later than six months after completion of the Project a final report on its implementation, including the final accounts covering the utilization of the special-purpose contribution provided by the Government of Japan. The final report shall contain the appraisal of the Project by UNIDO on the basis of the joint evaluation which shall be carried out by both sides not later than six months prior to the expiry of the present arrangements.

　本使は、更に、この書簡及びUNIDOに代わつて前記の取極を確認される貴官の返簡が日本国政府とUNIDOとの間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that the present Note and your Note in reply thereto confirming on behalf of UNIDO the foregoing arrangements shall be regarded as constituting an agreement between the Government of Japan and UNIDO, which will enter into force on the date of your reply.

　書簡をもつて啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

　本官は、更に、UNIDOに代わつて、前記の取極を確認するとともに、閣下の書簡及びこの返簡が日本国政府とUNIDOとの間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。

　I have further the honour to confirm on behalf of UNIDO the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between UNIDO and the Government of Japan, which will enter into force on the date of this reply.
