AGREEMENT ON FISHERIES BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF TUVALU

　日本国政府及びトゥヴァル政府は、

　The Government of Japan and the Government of Tuvalu,

　トゥヴァルの周辺海域における漁業資源の合理的な管理、保存及び最適利用に関する両政府の共通の関心を考慮し、

　Considering their common concern for the rational management, conservation and optimum utilization of fishery resources of the sea around Tuvalu,

　トゥヴァル政府が、千九百七十八年の漁業令に従つて、生物資源の探査及び開発、保存並びに管理のための主権的権利を国際法に従つて行使する二百海里水域(以下「トゥヴァル水域」という。)を設定していることを認め、

　Recognizing that the Government of Tuvalu has established a zone of 200 nautical miles in accordance with the Fisheries Ordinance of 1978, within which it exercises sovereign rights for the purpose of exploring and exploiting, conserving and managing the living resources in accordance with international law (hereinafter referred to as "the Tuvalu zone"),

　海洋法に関する国際連合条約の採択を考慮し、

　Taking into account the adoption of the United Nations Convention on the Law of the Sea,

　相互に関心を有する漁業に関する妥当な条件を確立することを希望し、

　Desirous of establishing reasonable terms and conditions pertaining to fisheries of mutual concern, and

　漁業の分野において協力することによつて日本国とトゥヴァルとの間の友好関係を強化するとの双方の希望を確認して、

　Affirming their wish to cooperate in the field of fisheries thereby enhancing friendly relations between Japan and Tuvalu,

　次のとおり協定した。

　Have agreed as follow:

第一条
　トゥヴァル政府は、トゥヴァルの漁業に関する関係法令及びこの協定に従つて、日本国の漁船がトゥヴァル水域内において漁獲することを許可する。

ARTICLE I
　The Government of Tuvalu undertakes to permit fishing vessels of Japan to fish within the Tuvalu zone in accordance with the relevant laws and regulations of Tuvalu in relation to fisheries and this Agreement.

第二条
　日本国政府及びトゥヴァル政府は、トゥヴアル水域内の日本国の国民及び漁船による漁獲並びにこの協定の実施に関して随時協議を行う。

ARTICLE II
　The Government of Japan and the Government of Tuvalu shall hold consultations from time to time concerning fishing by nationals and fishing vessels of Japan within the Tuvalu zone and regarding the implementation of this Agreement.

第三条
1　トゥヴァル政府は、毎年、この協定の第二条にいう日本国政府との協議を考慮に入れ、かつ、入手可能な最良の科学的証拠を基礎として、トゥヴァル水域内において日本国の国民及び漁船が漁獲を行うことに関する規制措置を決定することができる。

ARTICLE III
1. The Government of Tuvalu may determine each year, taking into account the consultations with the Government of Japan referred to in Article II of this Agreement and on the basis of the best available scientific evidence, regulatory measures with respect to the conduct of fishing by nationals and fishing vessels of Japan within the Tuvalu zone.

2　トゥヴァル政府は、1にいう決定を日本国政府に対して時宣を失することなく通報する。

2. The Government of Tuvalu shall notify the Government of Japan of the determinations referred to in paragraph 1 of this Article on a timely basis.

第四条
　トゥヴァル政府は、日本国の漁船がトゥヴァル水域内において漁獲に従事することを許可するため、料金を受領したときは、トゥヴァル水域の漁業に関するトゥヴァルの関係法令に従つて許可証を発給する。

ARTICLE IV
　The Government of Tuvalu shall issue licences, in accordance with the relevant laws and regulations of Tuvalu in relation to fisheries in the Tuvalu zone and upon receipt of fees, to permit fishing vessels of Japan to engage in fishing within the Tuvalu zone.

第五条
　日本国政府は、日本国の関係法令に従い、次のことを確保するための措置をとる。

ARTICLE V
　The Government of Japan shall take measures, in accordance with the relevant laws and regulations of Japan, to ensure that:

(a)　日本国の漁船が、この協定の第四条に基づく許可を受けない限りトゥヴァル水域内における漁獲に従事しないこと。

(a) fishing vessels of Japan shall not engage in fishing within the Tuvalu zone, unless licensed pursuant to Article IV of this Agreement; and

(b)　トゥヴァル水域において漁獲に従事する日本国の国民及び許可を受けた漁船がこの協定の規定及び許可証の条件に従うこと。

(b) nationals and licensed fishing vessels of Japan engaging in fishing within the Tuvalu zone comply with the provisions of this Agreement and with the terms and conditions of the licences.

第六条
1　日本国の国民又は漁船がトゥヴァルの当局によつて逮捕され又は拿捕されたときは、日本国政府に対し、その旨が速やかに通報される。

ARTICLE VI
1. In cases of arrest or seizure by the authorities of Tuvalu of nationals or fishing vessels of Japan, notification shall be given promptly informing the Government of Japan of the action taken.

2　逮捕された日本国の国民及び拿捕された日本国の漁船は、妥当な供託金又はその他の保証を条件として、速やかに釈放される。

2. Arrested nationals of Japan and seized fishing vessels of Japan shall be promptly released, subject to reasonable bond or other security.

第七条
　トゥヴァル政府は、関係する法律に従つて、この協定の規定に従わない日本国の国民及び漁船に対して、妥当な罰金を課すことができる。

ARTICLE VII
　The Government of Tuvalu may impose reasonable fines in accordance with the relevant laws on nationals and fishing vessels of Japan which do not comply with the provisions of this Agreement.

第八条
　日本国政府及びトゥヴァル政府は、トゥヴァル水域の内及び外の太平洋のまぐろ及びまぐろに類似した魚類の保存及び最適利用の目的を推進する。

ARTICLE VIII
　The Government of Japan and the Government of Tuvalu shall promote the objective of conservation and optimum utilization of tuna and tuna-like species of the Pacific Ocean both within and beyond the Tuvalu zone.

第九条
　トゥヴァル政府は、施設の利用可能性及びトゥヴァルの船舶の必要性を留保して、日本国の漁船が、補給品及び役務の入手、船体及び漁具の修理、乗組員の交替並びにその他の妥当な目的のためにフナフティの港に入港することをトゥヴァルの関係する法律及び行政上の要求に従つて認可することを約束する。

ARTICLE IX
　Subject to the availability of facilities and the needs of Tuvalu vessels, the Government of Tuvalu undertakes to authorize, in accordance with the relevant laws and administrative requirements of Tuvalu, fishing vessels of Japan to enter the port of Funafuti for the purpose of obtaining supplies and services, repairing their vessels and fishing gear, shipping or discharging their crew, and for other reasonable purposes.

第十条
　この協定のいかなる規定も、日本国及びトゥヴァルが締約国である漁業資源の保存に関する他の現行の国際協定に影響を与え、また、海洋法に関する国際連合条約に関連する海洋法のいかなる問題に関してもいずれの政府の見解又は立場をも害するものとみなしてはならない。

ARTICLE X
　Nothing in this Agreement shall be deemed to affect other existing international agreements on the conservation of fishery resources to which Japan and Tuvalu are parties and to prejudice the views or positions of either Government in regard to any question of the law of the sea related to the United Nations Convention on the Law of the Sea.

第十一条
　この協定のいずれかの規定の解釈又は適用に関して何らかの紛争が生じた場合には、日本国政府及びトゥヴァル政府は、その紛争を、両政府間の協議により解決するために努力するものとし、当該協議は、一方の政府が他方の政府から協議の開始のための正式の要請を受領した後可及的速やかに開始する。

ARTICLE XI
　In the event of any dispute arising as to the interpretation or application of any of the provisions of this Agreement, the Government of Japan and the Government of Tuvalu shall endeavour to settle it by consultations between themselves to be commenced as soon as practicable after the receipt by either party of a formal request from the other for the opening of such consultation.

第十二条
1　この協定は、署名の日に効力を生ずる。

ARTICLE XII
1. This Agreement shall enter into force on the date of signature.

2　この協定は、二年間効力を有し、その後はいずれか一方の政府がこの協定を終了させる意思を書面により通告する日から六箇月の期間が満了するまで効力を存続する。

2. This Agreement shall remain in force for a period of two years and shall continue in force thereafter until the expiration of six months from the day on which either Government shall give written notice of its intention to terminate this Agreement.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。

　IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.
