科学技術の分野における協力に関する日本国政府と大韓民国政府との間の協定

AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF KOREA ON COOPERATION IN THE FIELD OF SCIENCE AND TECHNOLOGY

　日本国政府及び大韓民国政府は、

　The Government of Japan and the Government of the Republic of Korea,

　平和的目的のための科学技術の分野における両政府間の協力が、両国間の友好協力関係を一層強固にし、かつ、それぞれの国の経済及び社会の発展に貢献することを信じ、

　Believing that the cooperation between the two Governments in the field of science and technology for peaceful purposes will further consolidate the friendly and cooperative relations between the two countries and contribute to the economic and social progress of their respective countries,

　民間部門の発意により行われる互恵的な両国間の産業技術協力の拡大が望ましいことを再確認し、

　Reaffirming the desirability of the expansion of mutually beneficial industrial technology cooperation between the two countries which is undertaken by the initiative of private sector,

　そのような協力の促進に資する環境を適切な方法により醸成する必要性に留意し、

　Noting the need to foster an environment conducive to the promotion of such cooperation by appropriate means, and

　科学技術の分野における両政府間の協力を一層強化することを目的として、

　Aiming at further strengthening the cooperation between the two Governments in the field of science and technology,

　次のとおり協定した。

　Have agreed as follows:

第一条
1　両政府は、平等及び相互利益の原則の下に、科学技術の分野における両政府間の協力を促進し、及び容易にする。

Article 1 
1. The two Governments shall, on the principle of equality and mutual benefit, promote and facilitate cooperation in the field of science and technology between them.

2　1の協力は、次の分野において行うことができる。

2. Such cooperation may be undertaken in the following areas:

(a)　海洋科学

(a) marine science;

(b)　資源及びエネルギー

(b) resources and energy;

(c)　保健及び環境

(c) health and environment;

(d)　建築及び土木

(d) architecture and civil engineering;

(e)　農学、林学及び水産学

(e) agriculture, forestry and fisheries science;

(f)　材料科学

(f) material science;

(g)　電子工学

(g) electronics;

(h)　電気通信

(h) telecommunication;

(i)　航空科学及び宇宙科学

(i) aviation and space science;

(j)　機械工学及び化学工学

(j) mechanical al chemical engineering;

(k)　バイオテクノロジー

(k) biotechnology;

(l)　コンピューター及び情報科学

(l) computer and information science;

(m)　産業開発の基礎として適当科学技術

(m) science and technology suitable to provide a basis for industrial development; and

(n)　相互に合意されるその他の分野

(n) other areas as may be mutually agreed upon.

第二条
　この協定に基づく協力活動の形態には、次のものを含めることができる。

Article 2 
　Forms of the cooperative activities under this Agreement may include the following:

(a)　科学技術に関する情報及び資料の交換

(a) exchange of information and data on science and technology;

(b)　科学技術の分野における主要政策事項に関する情報の交換

(b) exchange of information on the major policy matters in the field of science and technology;

(c)　共同研究及び機関間の研究協力

(c) joint research and institutional research cooperation;

(d)　科学者、技術者及びその他の専門家の交流

(d) exchange of scientists, technical personnel and other experts:

(e)　科学者、技術者及びその他の専門家による各種の形態の会合

(e) meetings of various forms by scientists, technical personnel and other experts; and

(f)　相互に合意されるその他の形態の協力

(f) other forms of cooperation as may be mutually agreed upon.

第三条
1　両政府は、この協定の目的を達成するため、両政府の代表者から成る日韓科学技術協力委員会(以下「委員会」という。)を設置する。

Article 3 
1. With a view to achieving the aim of this Agreement, the two Governments shall establish a Japan-Korea Committee on Scientific and Technological Cooperation (hereinafter referred to as "the Committee") consisting of the representatives of the two Governments.

2　委員会は、外交上の経路により決定される日に日本国及び大韓民国において交互に会合する。

2. The Committee shall meet in Japan and in Korea alternately on the date to be agreed upon through diplomatic channels.

3　委員会は、次の任務を有する。

3. The Committee shall have the following functions:

(a)　この協定の実施に関する主要な政策事項を討議すること。

(a) to discuss major policy matters relating to the implementation of this Agreement;

(b)　この協定の実施状況を検討すること。

(b) to review the progress of the implementation of this Agreement; and

(c)　この協定に基づく協力の増進を確保するための特定の措置に関し両政府に提案すること。

(c) to propose to the two Governments as regards specific measures to ensure the enhancement of cooperation under this Agreement.

4　委員会の会合が開催されていない期間中の委員会の任務に関する連絡は、外交上の経路により行われる。

4. Contacts concerning the functions of the Committee when it is not in session shall be conducted through diplomatic channels.

第四条

Article 4

　各政府は、他方の国の国民に対し、この協定に基づく活動の遂行に必要な便宜を与える。

　Each Government shall accord to the national of the other country facilities necessary for the carrying out of the activities under this Agreement

第五条

Article 5

　この協定に基づく特定の協力活動の細目及び手続を定める実施取極は、両政府又は両政府の機関のいずれか適当なものを当事者として行うことができる。

　Implementing arrangements setting forth the details and procedures of the specific cooperative activities under this Agreement may be made between the two Governments or their agencies, whichever is appropriate.

第六条

Article 6

　この協定は、それぞれの国において施行されている法令の範囲内において実施される。

　This Agreement shall be implemented within the scope of laws and regulations in force in each country.

第七条

Article 7

　この協定のいかなる規定も、両政府間の協力に関する他の取極でこの協定の署名の日に存在するもの又はその後締結されるものに影響を及ぼすものと解してはならない。

　No provision in this Agreement shall be interpreted as to affect other arrangements for cooperation between the two Governments, existing at the date of signature of this Agreement or concluded thereafter.

第八条
1　この協定は、署名の日に効力を生ずる。

Article 8 
1. This Agreement shall enter into force on the date of signature.

2　この協定は、二年間効力を有する。

2. This Agreement shall remain valid for a period of two years. This Agreement shall be automatically extended for successive periods of two years unless either Government notifies the other Government in writing of its intention to terminate this Agreement at least six months prior to the expiry of any one period.

　この協定は、更に各二年の期間自動的に延長される。ただし、一方の政府が、他方の政府に対していずれかの期間が満了する六箇月前までに書面によりこの協定を終了させる意思を通告する場合は、この限りでない。

3　この協定の終了は、この協定に基づいて行われ、かつ、この協定の終了の時でに実施を完了していないいかなる計画の実施にも影響を及ぼすものではない。

3. The termination of this Agreement shall not affect the carrying out of any project or program undertaken under this Agreement and not fully implemented at the time of the termination of this Agreement.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。

　IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Government have signed this Agreement.

　千九百八十五年十二月二十日にソウルで、ひとしく正交である日本語、韓国語及び英語により本書二通を作成した。解釈に相違がある場合には、英語の本文による。

　DONE in duplicate at Seoul on December 20, 1985, in the Japanese, Korean and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail
