北太平洋におけるにたり鯨の西資源の沿岸捕鯨についての規制に関する日本国政府とフィリピン共和国政府との間の取極

ARRANGEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES FOR THE REGULATION OF COASTAL WHALING OF THE WESTERN STOCK OF BRYDE'S WHALES IN THE NORTH PACIFIC OCEAN

　千九百四十六年十二月二日にワシントンで署名された国際捕鯨取締条約(以下「条約」という。)の締約政府である日本国政府及びフィリピン共和国政府は、

　The Government of Japan and the Government of the Republic of the Philippines, being Parties to the International Convention for the Regulation of Whaling, signed at Washington on December 2, 1946 (hereinafter referred to as "the Convention"),

　次のとおり協定した。

　Have agreed as follows:

第一条
　この取極の適用上、「解禁期」とは、条約の付表4(a)及び(b)の規定に基づき、千九百八十五年において北太平洋におけるにたり鯨の西資源の捕獲が許される期間をいう。

ARTICLE 1
　For the purpose of the present Arrangement, the term "season" shall mean the season during which the taking of the Western Stock of Bryde's whales in the North Pacific Ocean is permitted in 1985 under sub-paragraphs (a) and (b) of paragraph 4 of the Schedule to the Convention.

第二条
　千九百八十五年解禁期において、条約に基づき鯨体処理場に附属する捕鯨船による捕獲を認められた北太平洋におけるにたり鯨の西資源の総捕獲頭数は、次のとおり両国の間に配分する。

ARTICLE 2
　In the 1985 season, the total catch of the Western Stock of Bryde's whales in the North Pacific Ocean, authorized under the Convention to be taken by whale catchers attached to the land stations, shall be allocated between the two countries in the following manner:

　日本国　　　　　　三一七頭

　Japan ................................ 317

　フィリピン共和国　　四〇頭

　Republic of the Philippines............40

第三条
　いずれか一方の国に配分された割当頭数のいずれかの部分が当該一方の国の解禁期の終了のときに捕獲されておらず及び他の国の宣言した解禁期が終了していない場合には、当該部分は、自動的に当該他の国の割当頭数として移譲される。

ARTICLE 3
　If any portion of the quota allocated to one of the two countries is left untaken at the end of its season while the season declared by the other country has not expired, the said portion shall be automatically transferred to the quota of the other country.

第四条
　この取極は、前文に掲げる政府によつて署名された日に効カを生ずる。

ARTICLE 4
　The present Arrangement shall enter into force on the day upon which it is signed by the Governments referred to in the preamble.

第五条
　この取極は、千九百八十五年解禁期の終了まで実施する。

ARTICLE 5
　The present Arrangement shall be operative until the end of the 1985 season.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの取極に署名した。

　IN WITNESS WHEREOF the undersigned, being duly authorized thereto by their respective Governments, have signed the present Arrangement.

　千九百八十五年二月十八日にマニラで、英語により本書二通を作成した。
