航空業務に関する日本国政府とクウェイト政府との間の協定の付表の修正に関する交換公文

(Japanese Note)


　

　Kuwait, March 23, 1983


　書簡をもつて啓上いたします。本官は、千九百六十二年に署名された航空業務に関する日本国政府とクウェイト政府との間の協定(以下「協定」という。)第十二条(2)の規定に基づいて、千九百七十四年五月十三日から十五日まで及び千九百八十二年四月十五日から十六日まで東京で行われた日本国及びクウェイトの航空当局間の協議に言及する光栄を有します。

　Excellency,I have the honour to refer to the con-salutations which took place in Tokyo from l3th to l5th of May, 1974 and from l5th to l6th of April, 1982 between the aeronautical authorities of Japan and Kuwait in accordance with Article 12-(2) of "Agreement between the Government of Japan and the Government of Kuwait for Air Services" (hereinafter referred to as the Agreement) signed in 1962.


　本官は、前記の協議において到達した合意に照らし、この書簡に同封する修正された付表が協定の付表に代わるべきことを日本国政府に代わつて提案する光栄を有します。

　in the light of agreements reached at the above-mentioned consultations, I have the honour to propose, on behalf of the Government of Japan, that the Schedule of the Agreement be replaced by the revised Schedule set out in the enclosure to this Note.


　本官は、更に、前記の提案がクウェイト政府にとつて受諾し得るものであるときは、この書簡(同封物を含む。)及びその旨の閣下の返簡を、この問題に関する両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　If this proposal is acceptable to the Government of Kuwait, I have further the honour to suggest that this Note with its enclosure and Your Excellency's reply in that sense shall be regarded as constituting an agreement between the two Governments in this matter, which will enter into force on the date of Your Excellency's reply.  


　本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

第一部

Section I


　クウェイトの一又は二以上の指定航空企業が運営する路線

　Routes to be operated by the designated airline or airlines of Kuwait: -


　両方向に、クウェイトーバハレーン、ダーラン、ドーハ、アブ・ダビー、ドバイ及び(又は)マスカット(注1)―イスラマバード、カラチ、ボンベイ、ニュー・デリー及び(又は)ダッカ(注2)－バンコック、シンガポール、クアラ・ランプール、マニラ及び(又は)香港(注3)―東京

　Kuwait - Bahrain, Dhahran, Doha, Abu Dhabi, Dubai and/or Muscat (Note 1) -- Islamabad, Karachi, Bombay New Delhi and/or Dacca (Note 2) -- Bangkok, Singapore, Kuala Lumpur,Manila and/or Hong Kong (Note 3) -- Tokyo and V . V.


注1　クウェイトの一又は二以上の指定航空企業は、いずれの運航期間においても、これら六地点のうち三地点以上を使用することができない。

Note 1: The designated airline or air-lines of Kuwait cannot use more than two (2) points out of those six (6) points during any one given operational period.


注2　クウェイトの一又は二以上の指定航空企業は、いずれの運航期間においても、これら五地点のうち三地点以上を使用することができない。

Note 2: The designated airline or airlines of Kuwait cannot use more than two (2) points out of those five (5) points during any one given operational period.


注3　クウェイトの一又は二以上の指定航空企業は、いずれの運航期間においても、これら五地点のうち四地点以上を使用することができない。

Note 3: The designated airline or airlines of Kuwait cannot use more than three (3) points out of those five (5) points during any one given operational period


第二部

Section II


　日本国の一又は二以上の指定航空企業が運営する路線

　Routes to be operated by the designated airline or airlines of Japan: -


　両方向に、日本国内の地点―香港又はマニラ－ホーチミン・シティ－バンコック－ラングーン又はダッカ－インド又はパキスタン内の一地点－クウェイト－アテネ－ローマ－ドイツ内の一地点―パリ－ロンドン

　Points in Japan -- Hong Kong or Manila -- Ho Chi Mind City -- Bangkok -- Rangoon or Dacca -- one (1) point in India or Pakistan -- Kuwait -- Athens -- Rome -- one (1) point in Germany -- Paris -- London and V. V.


注1　日本国の一又は二以上の指定航空企業は、クウェイトとロンドンとの間について運輸権を行使してはならない。

Note 1: No traffic rights shall be exercised by the designated airline or airlines of Japan between Kuwait and London.


注2　日本国の一又は二以上の指定航空企業は、クウェイトとフランクフルト・アム・マインとの間について運輸権を行使してはならない。もつとも、日本国の一又は二以上の指定航空企業は、完全な運輸権を有して、ドイツ内の他の地点への及び当該地点からの運航を行うことができる。

Note 2: No traffic rights shall be exercised by the designated airline or airlines of Japan between Kuwait and Frankfurt am Main, however, the designated airline or airlines of Japan may operate to and from any other point in Germany with full traffic rights.


第三部

Section III


　いずれの締約国の一又は二以上の指定航空企業が行う協定業務も、当該締約国の領域内の一地点を起点とするものでなければならないが、路線上の他の地点は、いずれかの又はすべての飛行に当たり、当該指定航空企業の選択により省略することができる。

　The agreed services Provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the specified route may at the option of the designated airline be omitted on any or 811 flights.


第四部

Section IV


　いずれの締約国の一又は二以上の指定航空企業も、路線に掲げられていないアジア及び(又は)中東内の追加の二地点に寄航することができる。ただし、これら二地点への又はこれら二地点からの第五の自由に係る運輸権が行使されないことを条件とする。

　The designated airline or airlines of either Contracting Party may call at two (2) additional points in Asia and/or Middle East not mentioned in the route schedule,provided that no fifth freedom traffic right are exercised to/from such two points.

　書簡をもつて啓上いたします。本官は、本日付けの貴官の次の書簡を受領したことを確認する光栄を有します。

　Sir,I have the honour to Acknowledge the receipt of your Note of today's date 1 which reads as follows:

　本官は、クウェイト政府が日本国政府の前記の提案を受諾する旨を貴官に通報するとともに、貴官の書簡及びこの返簡をこの間題に関する両国政府間の合意を構成するものとみなし、その合意が本日効力を生ずることを確認する光栄を有します。

　I have the honour to inform you that the Government of Kuwait accepts the above proposal of the Government of Japan and to confirm that your Note and this reply are regarded as constituting an agreement between the two Governments in this matter, which enters into force on this date.


　本官は、以上を申し進めるに際し、ここに重ねて貴官に向かつて敬意を表します。

　I avail myself of this opportunity to extend to you the assurances of my highest consideration
