ARRANGEMENT BETWEEN JAPAN AND THE UNION OF SOVIET SOCIALIST REPUBLICS FOR THE REGULATION OF PELAGIC WHALING FOR MINKE WHALES IN THE SOUTHERN  HEMISPHERE

　南半球における母船によるミンク鯨の捕鯨の規制に関する日本国とソヴィエト社会主義共和国連邦との間の取極

　ARRANGEMENT BETWEEN JAPAN AND THE UNION OF SOVIET SOCIALIST REPUBLICS FOR THE REGULATION OF PELAGIC WHALING FOR MINKE WHALES IN THE SOUTHERN  HEMISPHERE

　千九百四十六年十二月二日にワシントンで署名された国際捕鯨取締条約(以下「条約」という。)の締約政府である日本国及びソヴィエト社会主義共和国連邦の政府は、

　The Governments of Japan and of the Union of Soviet Socialist Republics, being Parties to the International Convention for the Regulation of Whaling, signed at Washington on December 2. 1946 (hereinafter referred to as "the Convention").

　次のとおり協定した。

　Have agreed upon the following arrangements

第一条
　この取極の適用上、「解禁期」とは、条約の付表2(b)及び(d)の規定に基づき南半球におけるミンク鯨の捕獲が許される期間をいう。

ARTICLE 1
　For the purpose of the present Arrangement, the term ″season″ shall mean the season during which the taking of minke whales in the Southern Hemisphere is permitted under sub-paragraphs (b) and (d) of paragraph 2 of the Schedule to the Convention.

第二条
　千九百八十三年・千九百八十四年解禁期において、条約に基づき南半球における母船による捕獲を認められたミンク鯨の総割当頭数のうちの日本国及びソヴィエト社会主義共和国連邦の割当頭数は、次のとおり両国の間に配分する。

ARTICLE 2 
　In the 1983/84 season, of the total quota of minke whales, authorized under the Convention to be taken in the Southern Hemisphere by pelagic expeditions. the quota allotted to Japan and the Union of Soviet Socialist Republics shall be allocated between the two countries in the following manner:

第三条
(1)　次のいずれかの区域におけるいずれか一方の政府の管轄下にある母船による捕獲頭数は、次の限度を超えてはならない。

ARTICLE 3
(1) The catches taken in any of the Areas as described below by pelagic expeditions under the jurisdiction of either Government shall not exceed the limits shown below:

(i)　第一区域(西経百二十度から西経六十度まで)

(2)　(1)の規定にかかわらず、いずれか一方の政府の管轄下にある母船による区域別の捕獲頭数の合計は、前条においてそれぞれの国に配分された割当頭数を超えてはならない。

(2) Notwithstanding the above provisions, the sum of the Area catches by pelagic expeditions under the jurisdiction of either Government shall not exceed the quotas for their respec-tive countries as allocated in Article 2.

第四条
　この取極の締約政府でない政府の管轄下にある母船が南半球におけるミンク鯨の捕鯨に従事し、かつ、当該政府が条約の締約政府であり又は締約政府となつた場合には、この取極は、終了する。

ARTICLE 4
　If a factory ship under the jurisdiction of a Government which is not a Party to the present Arrangement should engage in pelagic whaling for minke whales the Southern Hemisphere and that Government is or becomes a party to the Convention,the
present Arrangement shall be terminated.

第五条
　この取極は、前文に掲げる政府によつて署名された日に効力を生ずる。

ARTICLE 5
　The present arrangement shall enter into force on the day referred to in the preamble.

第六条
　この取極は、千九百八十三年・千九百八十四年解禁期の終了まで実施する。

ARTICLE 6
　The present Arrangement shall be operative until the end of the 1983/84 season.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの取極に署名した。

　In witness whereof the undersigned being duly authorized thereto by their respective Governments, have signed the present Arrange-ment.

　千九百八十三年十月十九日にモスクワで、英語により本書二通を作成した。

　Done in duplicate at Moscow, the nineteenth day of October 1983, in the English language.
