青年海外協力隊の派遣に関する日本国政府とフィジー政府との間の交換公文

Suva, August 5, 1982
書簡をもって啓上いたします。本使は、日本国とフィジーとの間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をフィジーに派遣することに関し、日本国政府の代表者とフィジー政府の代表者との間でスヴァにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
Excellency , I have the honour to refer to the recent discussions held in Suva between the representatives of the Government of Japan and the Government of Fiji concerning the dispatch of volunteers to Fiji under the Japan Overseas Co-operation Volunteers Programme (hereinafter referred to as "the Programme") with a view to promoting technical co-operation between the two countries and to confirm on behalf of the Government of Japan the following understandings reached between them:
1 日本国政府は、フィジー政府の要請に基づき、かつ、日本国の現行法令に従い、フィジーの社会的及び経済的開発に寄与するため、両国の関係政府機関間で別個に合意される計画に従い協力隊員をフィジーに派遣するために必要な措置をとる。
l. At the request of the Government of Fiji and in accordance with the laws and regulations in force in Japan, the Government of Japan will take necessary measures to dispatch the volunteers to Fiji for the purpose of contributing to the social and economic development of Fiji, accord-ing to the schedules to be separately agreed upon between the agencies concerned of the two countries .
2 日本国政府は、協力隊員の日本国とフィジーとの間の渡航費及びフィジーにおける生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will take necessary measures to bear the cost of international travel between Japan and Fiji and living allowances in Fiji for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their duties.
3 フィジー政府は、協力隊員に対し、次の特権、免除及び利益を与える｡
3. The Government of Fiji will grant the volunteers the following privileges, exemptions and benefits :
(1) 協力隊員が自己の任務の遂行に当たり使用するため、2の規定に基づいてフィジーに持ち込まれるすべての装備、機械、材料及び医薬品に課される関税、内国税その他の政府の課徴金の免除
(1) Exemption from customs duties, taxes and other governmental charges on all the equipment, machinery, materials and medical supplies introduced into Fiji in accordance with paragraph 2 above for use in the performance of their duties.
(2) 協力隊員がその到着後六箇月以内に自ら使用するため、フィジーに持ち込まれる身回品及び家財に課される関税、内国税その他の政府の課徴金の免除
(2) Exemption from customs duties, taxes and other governmental charges on their personal and household effects introduced into Fiji for their own use within six months of their arrival.
(3) 計画に基づいて行われる協力隊員の活動に関連して、海外から支払われる給与及び手当であつて協力隊員がフィジーにおいて受け取るものに関連して課される所得税その他の政府の課徴金の免除
(3) Exemption from income tax and other governmental charges in respect of any remuneration or allowances received by the volunteers in Fiji from overseas in connection with their activities under the Programme.
(4) 協力隊員のフィジーでの任期中におけるフィジー政府の医療機関における無料診療
(4) Free medical care in Government medical institutions during the term of their assignment in Fiji.
(5) 協力隊員がフィジー政府により与えられる任務を遂行する場所における無料の住居施設
(5) Rent-free housing accommodations at places where they are to perform their duties to be assigned to them by the Government of Fi j i .
4(1) フィジー政府は、フィジーにおける計画の活動に関連して日本国政府による技術協力の実施機関である国際協力事業団が与える任務を遂行する駐在員一名又は調整員一名を受け入れる。
4.(1) The Government of Fiji will accept either one Representative or one Co-ordinator who will discharge the duties to be assigned to him by the Japan International Co-operation Agency, the executing agency for technical co-operation extended by the Government of Japan, relative to the activities of the Programme in Fiji.
(2) フィジー政府は、駐在員又は調整員に対し、次の特権、免除及び利益を与える。
(2) The Government of Fiji will grant the Representative or the Co-ordinator the following privileges, exemptions and benefits:
(a) 駐在員又は調整員が任務の遂行に当たり使用するため、フィジーに持ち込まれるすべての装備、機械、材料及び医薬品に課される関税、内国税その他の政府の課徴金の免除
(a) Exemption from customs duties, taxes and other governmental charges on all the equipment, machinery, materials and medical supplies introduced into Fiji for use in the performance of his duties .
(b) 駐在員叉は調整員がその到着後六箇月以内に自ら使用するため、フィジーに持ち込まれる見回り品及び家財に課される関税、内国税そのほかの政府の課徴金の免除
(b) Exemption from customs duties, taxes and other governmental charges on his personal and household effects introduced into Fiji for his own use within six months of his arrival.
(c) 駐在員または調整員がその到着後六箇月以内に公用及び私用のための自動車一台を無税で輸入すること又はフィジーにおける保税倉庫から購入すること
(c) Importation free of duties (or purchase from bond in Fiji) of one motorcar for official and private use within six months of his arrival.
(d) 計画に基づいて行われる駐在員又は調整員の活動に関連し、海外から支払われる給与又は手当であつてこれらの者がフィジーにおいて受け取るものに関連して課される所得税そのほかの政府の課徴金の免除
(d) Exemption from income tax and other governmental charges in respect of any remuneration or allowances received by the Representative or the Co-ordinator in Fiji from overseas in connection with ~is activities under the Programme.
5 フィジー政府は、フィジーにおける協力隊員の公務に起因し、当該公務の遂行中に発生し、又は、当該公務の遂行中における作為又は不作為に関連する請求が生じた場合には、その請求に関する責任を負う。ただし、これらの請求が協力隊員の故意又は重大な過失から生ずる場合には、この限りでない。
5. The Government of Fiji undertakes t. o bear claims , if any arises, resulting from, occurring in the course oft or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in Fiji, except when such claims arise from the wilful misconduct or gross negligence on the part of the volunteers.
6 両政府は、フィジーにおける計画の実施を成功させるため随時協議する。
6. The two Governments will hold consultations, from time to time, for the successful implementation of the Programme in Fiji.
7 この了解は、両政府間の書簡の交換によつて修正することができ、かつ、いづれかの政府が他方の政府に対しこの了解を終了させる意志を六箇月以内に書面によつて通告することにより終了させることができる。
7. The present understandings may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months' written notice of its intention to terminate them.
本使は、更に、この書簡及び前記の了解をフィジー政府に代わつて確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming the foregoing understandings on behalf of the Government of Fiji shall be regarded as constituting an agreement between the two Governments, which will take effect on the date of Your Excellency's Note in reply.
本使は、以下を申し進めるに際し、ここに閣下に向かつて敬意を表します。

書簡をもつて啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency,I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

本大臣は、更に、前記の了解をフィジー政府に代わつて確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm the foregoing understandings on behalf of the Government of Fiji and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments, which will take effect on the date of this reply.
本大臣は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。
