　書簡をもつて啓上いたします。本使は、トルコの債務者が負う商業上の債務についての債務救済措置に関し千九百八十年六月十七日、十八日及び十九日並びに七月二十二日及び二十三日にパリで開催されたトルコ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した了解に従つて日本国政府の代表者とトルコ共和国政府の代表者との間で行われた最近の交渉に関し、当該交渉において到達した次の了解を確認する光栄を有します。


							

						

						

							

								
　Sir,With reference to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Turkey that were held pursuant to the understanding reached during the consultations between the representatives of the Government of the Republic of Turkey and of the governments of the creditor countries concerned held in Paris on 17, 18 and 19 June and 22 and 23 July, 1980, concerning debt relief measures in respect of commercial debts owed by Turkish debtors, I have the honour to confirm the following understanding reached in the course of the said negotiations:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
1(a)　この取極は、一方においてトルコ共和国政府及びトルコ共和国政府企業並びにトルコの民間企業及び個人(以下「債務者」という。)と他方において日本国の居住者である関係債権者(以下「債権者」という。)との間で契約され、かつ、日本国政府が保険を引き受けた次の商業上の債務の元本及び利子の総額に適用される。


							

						

						

							

								
1.(a) The present arrangements will apply to the total amount of the principal of and interest on the following commercial debts, contracted on or before 1 January, 1980, between the Government and governmental corporations of the Republic of Turkey and Turkish private enterprises and persons (hereinafter referred to as "the Debtors") on the one hand and the creditors concerned resident in Japan (hereinafter referred to as "the Creditors") on the other and insured by the Government of Japan:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(i)　千九百七十八年十二月二十二日及び千九百八十年六月二十三日に日本国政府とトルコ共和国政府との間で交換された書簡により行われる商業上の債務についての債務救済措置に関する取極に関連を有しない商業上の債務のうち、千九百八十年六月三十日以前に弁済期限の到来したもの

(iv) with regard to the commercial debts referred to in sub-paragraph (a)(iv) above:thirty-nine million six hundred and eighteen thousand two hundred and fifty-nine United States dollars and twenty-nine cents (U.S.$39,618,259.29) for the commercial debts contracted in United States dollars, two billion three hundred and thirty-nine million, and four hundred and seventy-six thousand three hundred and ninety-nine yen (2,339,476,399) for the commercial debts contracted in Japanese yen, four hundred and sixty-seven thousand eight hundred and six German marks and eleven pfennigs (DM 467,806.11) for the commercial debts contracted in German marks.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(c)　(b)にいう商業上の債務の元本及び利子の額には、日本国政府及びトルコ共和国政府の関係当局が行う最終的照合の後に両政府の関係当局間の合意により修正を行うことができる。


							

						

						

							

								
(c) Modifications may be made to the amount of the principal of and interest on the commercial debts referred to in sub-paragraph (b) above by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Turkey, after the final verification to be made by the authorities concerned of the two Governments.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
2(a)　トルコ共和国政府は、(d)に掲げる支払計画であつて債務者が債権者に対し1(a)にいう商業上の債務の弁済期間をそれに従つて延長するよう要請すべきもの(以下「支払計画」という。)をトルコ共和国中央銀行を通じて債権者に通告する。


							

						

						

							

								
2.(a) The Government of the Republic of Turkey will notify the Creditors, through the Central Bank of the Republic of Turkey, of the payment scheme as set out in sub-paragraph (d) below (hereinafter referred to as "the Payment Scheme") in accordance with which the Debtors should request the Creditors to extend the repayment periods of the commercial debts referred to in paragraph 1(a).


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(b)　トルコ共和国政府は、1(a)にいう商業上の債務の総額を支払計画に従いトルコ共和国中央銀行を通じ関係契約によつて指定された通貨により債権者に支払い、また、その他の債務者が支払うことを確保する。


							

						

						

							

								
(b) The Government of the Republic of Turkey will pay, or will ensure that the other Debtors pay, the total amount of the commercial debts referred to in paragraph 1(a) to the Creditors in the currency designated in the contracts concerned through the Central Bank of the Republic of Turkey in accordance with the Payment Scheme.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(c)　日本国政府は、商業上の関係債務が、支払計画に従つて行われる支払によつて決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。

3　支払計画が適用される債務に対する利子率は、合衆国ドルによつて契約された商業上の債務については年八・七五パーセント、日本円によつて契約された商業上の債務については年八・五パーセント、また、ドイツ・マルクによつて契約された商業上の債務については年八・五パーセントとする。ただし、支払が支払計画に比し十五日を超えて遅延している債務に関しては、当該利子率は、合衆国ドルによつて契約された商業上の債務については年九・七五パーセント、日本円によつて契約された商業上の債務については年九・五パーセント、また、ドイツ・マルクによつて契約された商業上の債務については年九・五パーセントにそれぞれ引き上げられる。この利子は、1(a)(i)及び(ii)にいう商業上の債務については、当初の弁済期日から生じ、また1(a)(iii)及び(iv)にいう商業上の債務については、千九百八十一年十二月十四日から生じる。この利子については、トルコ共和国のすべての租税及び課徴金が免除される。トルコ共和国政府は、弁済期限の到来している商業上のいかなる債務についても、その債務が決済されていない限り、債権者に対し前記の利子を2(d)に定める各支払日に支払う。


							

						

						

							

								
3. The rate of interest on the debts applied for the Payment Scheme will be eight and three quarters per cent (8.75%) per annum for the commercial debts contracted in United States dollars, eight and a half per cent (8.5%) per annum for the commercial debts contracted in Japanese ye, and eight and a half per cent (8.5%) per annum for the commercial debts contracted in German marks; however, in respect of the debts the payment of which is more than fifteen (15) days in arrears as against the Payment Scheme, this rate will be increased to nine and three quarters per cent (9.75%) per annum for the commercial debts contracted in United States dollars, to nine and a half per cent (9.5%) per annum for the commercial debts contracted in Japanese yen, and to nine and a half per cent (9.5%) per annum for the commercial debts contracted in German marks. Such interest will begin to accrue from the original due dates for the commercial debts referred to in paragraph 1(a)(i) and (ii) and from 14 December, 1981 for the commercial debts referred to in paragraphs 1(a)(iii) and (iv). Such interest will be exempted from all taxes and duties of the Republic of Turkey. The Government of the Republic of Turkey will pay to the Creditors, on each date of payment referred to in paragraph 2(d), such interest on any of the commercial debts concerned due to the extent that they have not been settled.

5　債務者が支払計画に従つて商業上の関係債務を決済するためトルコ共和国において必要とされる措置をとらなかつた場合には、トルコ共和国政府は、当該債務が関係契約に従つて債務者と債権者との間で決済されることをトルコ共和国において施行されている関係法令の範囲内で容易にする。トルコ共和国政府は、また、関係契約によつて指定された通貨による債務の支払金の送金の自由を保証する。


							

						

						

							

								
5. If the Debtors fail to take such measures as are required in the republic of Turkey for the settlement of the commercial debts concerned in accordance with the Payment Scheme, the Government of the Republic of Turkey will facilitate, within the scope of the relevant laws and regulations in force in the Republic of Turkey, the settlement between the Debtors and the Creditors of such commercial debts in accordance with the contracts concerned. The Government of the Republic of Turkey will also guarantee the free transfer of payments of the debts in any currency or currencies designated in the contracts concerned.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
6　関係契約の条件のうちこの書簡において特に言及されていないものは、関係契約当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。


							

						

						

							

								
6. It is confirmed that the terms and conditions of the contracts concerned not specifically referred to in this Note will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
7　トルコ共和国政府は、いずれかの第三国の居住者である債権者に対し債務救済措置について2(d)にいう条件より有利な条件を与えた場合には、当該第三国の居住者である債権者に与えられる条件より不利でない条件を、日本国の居住者である債権者に直ちに与える。


							

						

						

							

								
7. If the Government of the Republic of Turkey accords to creditors resident in any third country terms and conditions more favourable than those referred to in paragraph 2 (d) with regard to debt relief measures, the Government of the Republic of Turkey will forthwith accord to the Creditors the terms and conditions not less favourable than those accorded to creditors resident in such third country.
