日本国産米の売買に関する契約に関連する日本国政府とバングラデシュ人民共和国政府との間の交換公文

書簡をもつて啓上いたします。本使は、バングラデシュ人民共和国政府がバングラデシュ人民共和国の食糧需給事情を緩和するため日本国の協力を要請したことに基づき千九百八十二年七月十四日に東京においてバングラデシュ人民共和国政府と日本国農林水産省食糧庁との間で締結された「日本国食糧庁とバングラデシュ人民共和国政府との間の日本国産米の売買に関する契約」(以下「契約」という。)に言及する光栄を有します。契約には、なかんずく次の事項が定められています。
Excellency,I have the honour to refer to the "Contract for Sale and Purchase of Japanese Rice between the Food Agency of Japan and the Government of the People's Republic of Bangladesh" (hereinafter referred to as "the Contract") concluded between the Government of the People's Republic of Bangladesh and the Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan on July 14, 1982 in Tokyo at the request of my Government for Japanese cooperation in meeting the food requirements in the People's Republic of Bangladesh. The Contract provides, inter alia, for the following:
(a) 日本国農林水産省食糧庁は、バングラデシュ人民共和国政府に対し、日本国産水稲うるち精米十万メトリック・トンを、延払によつて、売り渡す。
(a) The Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan shall supply on a deferred payment basis to the Government of the People's Republic of Bangladesh a total of one hundred thousand (100,000) metric tons of Japanese milled non-glutinous rice;
(b) その米穀の船積みは、千九百八十二年七月に開始し、十五日の猶予期間付きで千九百八十二年十月末までに完了する。
(b) The shipment of the said rice shall start in July, 1982 and be completed by the end of October, 1982 with an allowance of fifteen (15) days;
(c) その米穀の引胤渡しは、日本国の港における本船積込み渡しによる。
(c) The said rice shall be delivered on the basis of f.o.b. stowed at Japanese ports;
(d) その米穀の価格は、本船積込み渡しにより、一メトリック・トンにつき、七万九千円とする。
(d) The price of the said rice shall be seventy-nine thousand (79,000) yen per metric ton on the basis of f.o.b. stowed;
(e) バングラデシュ人民共和国政府は、その米穀を、輸出のためではなく、バングラデシュ人民共和国の国内消費にのみ使用し、バングラデシュ人民共和国からの米穀の輸出を防止するためのすべての妥当な措置をとる。
(e) The Government of the People's Republic of Bangladesh shall use the said rice not for export but only for domestic consumption in the People's Republic of Bangladesh, and take all appropriate measures to prevent rice export from the People's Republic of Bangladesh;
(f) 延払の条件は、次のとおりとする。
(f) The terms and conditions of the deferred payment shall be as follows:
(i) 元本の支払は、十年の据置期間の後二十年の期間にわたり、均等年賦によつて行う。
(i) The payment of the principal shall be made in equal annual instalments over a period of twenty years after a ten years' grace period;
(ii) 利子率は、据置期間においては年二パーセント、及び据置期間の後二十年の期間においては年三パーセントとし、かつ、その利子は、毎年支払う。
(ii) The rate of interest shall be two per cent (2%) per annum during the grace period and three per cent (3%) per annum during the period of twenty years after the grace period, and such interest shall be paid annually;
(g) 契約から生ずるすべての債務及び義務は日本国通貨で表示され、かつ、バングラデシュ人民共和国政府から日本国農林水産省食糧庁への支払は日本円で行われる。
(g) All liabilities and obligations accruing from the Contract shall be quoted in Japanese yen and the payment from the Government of the People's Republic of Bangladesh to the Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan shall be made in Japanese yen.
本使は、バングラデシュ人民共和国政府が契約の締結について極めて満足している旨を閣下に通報するとともに、契約に関連する次の了解を本国政府に代わつて確認します。
I wish to inform Your Excellency that the Government of the People's Republic of Bangladesh is highly satisfied with the conclusion of the Contract and to confirm on behalf of my Government the following understanding relating to the Contract:
1 両政府は、それぞれの国の現行法令の範囲内で、契約の円滑な及び適時の実施を容易にするものとし、このため必要な措置をとる。
1. The two Governments will, within the laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.
2 両政府は、生産及び国際通商貿易の通常の形態に有害な影響を与えることを避けるという原則が、契約による日本国産米の供給を規律すべきであることを認める。したがつて、バングラデシュ人民共和国政府は、日本国政府と必要な協議を行いつつ、前記の日本国産米の購入との関連でこの原則を遵守するためのすべての妥当な措置をとる。
2. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production an international commercial trade should govern the supply of Japanese rice under the Contract. The government of the People's Republic of Bangladesh will, therefore, in due consultation with the Government of Japan, take all appropriate measures for the observance of the said principle in connection with the purchase of the said Japanese rice.
3 両政府は、この了解から又はそれに関連して生ずることがあるいかなる問題についても、相互に協議する。
3. The two Governments will consult with each other on any problems that may arise out of this understanding or in connection therewith.
本使は、閣下が前記のことが日本国政府の了解でもあることを貴国政府に代わつて確認されれば幸いであります。
I should be grateful if Your Excellency would confirm, on behalf of Your Excellency's Government, that this is also the understanding of the Government of Japan.
本使は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。
