AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE MARSHALL ISLANDS CONCERNING FISHERIES OFF THE COASTS OF THE MARSHALL ISLANDS

　日本国政府及びマーシャル諸島政府は、

　The Government of Japan and the Government of the Marshall Islands,

　マーシャル諸島の地先沖合における漁業資源の合理的な管理、保存及び最適利用に関する両政府の共通の関心を考慮し、

　Considering their common concern for the rational management, conservation and optimum utilization of fishery resources off the coasts of the Marshall Islands,

　マーシャル諸島政府が、千九百七十八年のマーシャル諸島海洋資源管轄法により定められた排他的漁業水域及び拡大漁業水域(以下「漁業水域」という。)の内側の漁業資源に関して管轄権を有することを認め、

　Recognizing that the Government of the Marshall Islands has jurisdiction in respect of fishery resources within the Exclusive Fishery Zone and the Extended Fishery Zone as defined by the Marshall Islands Marine Resource Jurisdiction Act of 1978 (hereinafter referred to as "the Fishery Zone"),

　相互に関心を有する漁業に関する妥当な条件を確立することを希望し、

　Desirous of establishing reasonable terms and con' d it ions pertaining to fisheries of mutual concern, and,

　漁業の分野における互恵的協力を確立し、もつて日本国とマーシャル諸島との間の友好関係に貢献するとの双方の希望を確認して、

　Affirming their wish to establish mutually beneficial cooperation in the field of fisheries and in this way to contribute to friendly relations between Japan and the Marshall Islands,

　次のとおり協定した。

　Have agreed as follows:

第一条
　漁業水域内の日本国の国民及び漁船による漁獲は、この協定の規定に従つて行われる。

ARTICLE I
　Fishing by national s and fishing vessels of Japan within the Fishery Zone shall be conducted in accordance with the provisions of this Agreement.

第二条
　日本国政府及びマーシャル諸島政府は、漁業水域内における日本国の国民及び漁船による漁獲並びにこの協定の実施に関して協議を行う。

ARTICLE II
　The Government of Japan and the Government of the Marshall Islands shall hold consultations concerning fishing by nationals and fishing vessels of Japan within the Fishery Zone and regarding the implementation of this Agreement.

第三条
1　マーシャル諸島政府は、毎年、この協定の第二条にいう日本国政府との協議を考慮に入れ、かつ、適当な場合には、入手可能な最良の科学的証拠を基礎として、漁業水域内で日本国の国民及び漁船が漁獲を行うことに関する規制措置を決定する。

ARTICLE III
1. The Government of the Marshall Islands shall determine each year, taking into account the consultation with the Government of Japan referred to in Article II of this Agreement and, where, appropriate, on the basis of the best available scientific evidence, regulatory measures with respect to the conduct of fishing by nationals and fishing vessels of Japan within the Fishery Zone.

2　マーシャル諸島政府は、1にいう決定を日本国政府に対して時宜を失することなく通報する。

2. The Government of the Marshall Islands shall notify the Government of Japan of the determinations referred to in paragraph 1 of this Article on a timely basis.

第四条
　マーシャル諸島政府は、日本国の漁船が漁業水域内において漁獲に従事することを可能とするため、漁業水域に関するマーシャル諸島の関係法令に従つて許可証を発給する。

ARTICLE IV
　The Government of the Marshall Islands shall issue licenses, in accordance with the relevant laws and regulations of the Marshall Islands with regard to the Fishery Zone, to enable fishing vessels of Japan to engage in fishing within the Fishery Zone.

第五条
1　日本国政府は、日本国の関係法令に従つて、日本国の漁船がこの協定に基づいて許可されない限り漁業水域内で漁獲に従事したいこと並びにこの協定に基づいて漁獲に従事する日本国の国民及び漁船がこの協定の規定及びマーシャル諸島政府によつて発給される許可証の条件に従うことを確保するため必要な措置をとる。

ARTICLE V
1. The Government of Japan shall take necessary measures to ensure, in accordance with the relevant laws and regulations of Japan, that fishing vessels of Japan unless licensed under this Agreement shall not engage in fishing within the Fishery Zone and that nationals and fishing vessels of Japan engaging in fishing under this Agreement comply with the provisions of this Agreement and with the terms and conditions of licenses issued by the Government of the Marshall Islands.

2　マーシャル諸島政府は、1にいう許可証の条件を日本国政府に対して時宜を失することなく通報する。

2. The Government of the Marshall Islands shall notify the Government of Japan of the terms and conditions of licenses referred to in paragraph 1 of this Article on a timely basis.

第六条
1　日本国の国民又は漁船がマーシャル諸島の当局によつて逮捕され又は拿捕されたときは、日本国政府に対し、その旨が速やかに通報される。

ARTICLE VI
1. in cases of arrest or seizure by the authorities of the Marshall islands of nationals or fishing vessels of Japan, notification shall be given promptly informing the Government of Japan of the action taken.

2　逮捕された日本国の国民及び拿捕された日本国の漁船は、妥当な供託金又はその他の保証を条件として、マーシャル諸島の関係法令に従つて速やかに釈放される。

2. Arrested nationals of Japan and seized fishing vessels of Japan shall be promptly released in accordance with the relevant laws of the Marshall Islands, subject to reasonable bond or other security.

第七条
　マーシャル諸島政府は、この協定の規定に従わない日本国の国民及び漁船に対して、妥当な罰金を課すことができる。

ARTICLE VII
　The Government of the Marshall Islands may impose reasonable fines on nationals and fishing vessels of Japan which do not comply with the provisions of this Agreement.

第八条
　日本国政府及びマーシャル諸島政府は、マーシャル諸島の地先沖合水域を含む太平洋の高度回遊性魚種(例えば、まぐろ類)の資源の保存及び最適利用の目的を推進する。

ARTICLE VIII
　The Government of Japan and the Government of the Marshall Islands shall promote the objective of conservation and optimum utilization of the resources of the highly migratory species, like species of tuna, of the Pacific Ocean including the waters off the coasts of the Marshall Islands.

第九条
　マーシャル諸島政府は、施設の利用可能性及びマーシャル諸島の船舶の必要性を留保して、この協定に基づいて許可された日本国の漁船がマーシャル諸島の関係法令及び行政上の要求に従つてマーシャル諸島の港に入港することを許可することを約束する。マーシャル諸島政府は、その他の日本国の漁船がマーシャル諸島の港に入港することを許可される条件を日本国政府に対して通報する。

ARTICLE IX
　Subject to the availability of facilities and the needs of Marshall Islands vessels, the Government of the Marshall Islands undertakes to permit fishing vessels of Japan licensed under this Agreement to enter Marshall Islands ports in accordance with the relevant laws, regulation and administrative requirements of the Marshall Islands. The Government of the Marshall Islands shall notify the Government of Japan of the terms and conditions under which other fishing vessels of Japan will be permitted to enter Marshall Islands ports.

第十条
　この協定のいかなる規定も、第三次国際連合海洋法会議において交渉中のいかなる問題に関するいずれの政府の立場をも害するものとみなしてはならない。

ARTICLE X
　Nothing in this Agreement shall be deemed to prejudice the position of either Government in regard to any question under negotiation at the Third United Nations Conference on the Law of the Sea.

第十一条
1　この協定は、千九百八十一年四月一日に効力を生ずる。

ARTICLE XI
1. This Agreement shall enter into force on the first day of April, 1981.

2　この協定は、二年間効力を有し、その後はいずれか一方の政府がこの協定を終了させる意思を通告する日から六箇月の期間が満了するまで効力を存続する。

2. This Agreement shall remain in force for a period of two years and shall continue in force thereafter until the expiration of six months from the day on which either Government shall give notice of its intention to terminate this Agreement.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。

　IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.

　千九百八十一年三月二十五日に東京で、英語により本書二通を作成した。
