青年海外協力隊の派遣に関する日本国政府とモルディヴ共和国政府との間の交換公文

Colombo, December 6, 1981
書簡をもつて啓上いたします。本使は、日本国とモルディヴ共和国との間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をモルディヴ共和国に派遣することに関し、日本国政府の代表者とモルディヴ共和国政府の代表者との間で行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Sir, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Maldives concerning the dispatch of volunteers to the Republic of Maldives under the Japan Overseas Co-operation Volunteers Programme (hereinafter referred to as "the Programme") with a view to promoting technical co-operation between the two countries, and to confirm on behalf of the Government of Japan the following understandings reached between them:
1 日本国政府は、モルディヴ共和国政府の要請に基づき、日本国の現行法令に従い、モルディヴ共和国の社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される細目に従い、協力隊員をモルディヴ共和国に派遣するために必要な措置をとる。
1. At the request of the Government of the Republic of Maldives and in accordance with the laws and regulations in force in Japan, the Government of Japan will take necessary measures to dispatch the volunteers to the Republic of Maldives for the purpose of contributing to the social and economic development of the Republic of Maldives, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とモルディヴ共和国との間の渡航費及びモルディヴ共和国における生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budge take appropriations, take necessary measures to bear the cost of international travel between Japan and the Republic of Maldives and living allowances in the Republic of Maldives for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 モルディヴ共和国政府は、協力隊員に対し、次の特権、免除及び利益を与える。
3. The Government of the Republic of Maldives will grant the volunteers the following privileges, exemptions and benefits:
(1) 2に掲げる装備、機械、材料及び医薬品に関連して課される関税、内国税その他すべての種類の課徴金の免除
(1) Exemption from customs duties, taxes and charges of any kind in respect of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
(2) 協力隊員の身回品及び家庭用品に関連して課される関税、内国税その他すべての種類の課徴金(ただし、保管、運送及び類似の役務に関する課徴金を除く。)の免除
(2) Exemption from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of their personal and household effects.
(3) 2に掲げる生活手当等協力隊員に海外から送付される給与に関連して課される所得税その他すべての種類の課徴金の免除
(3) Exemption from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas such as the living allowances mentioned in paragraph 2 above.
(4) モルディヴ共和国における協力隊員の任期中における無料診療
(4) Free medical care during the term of their assignment in the Republic of Maldives.
(5) 協力隊員がモルディヴ共和国政府より与えられた任務を遂行する場所における無料の住居施設
(5) Rent-free housing accommodations at places where they are to perform their duties to be assigned to them by the Government of the Republic of Maldives.
4(1) モルディヴ共和国政府は、モルディヴ共和国における計画の活動に関連して日本国政府が行う技術協力の実施機関である日本国際協力事業団が与える任務を遂行する駐在員一人及び調整員を受け入れる。
4. (1) The Government of the Republic of Maldives will accept a Representative and Co-ordinators who will discharge the duties to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical co-operation extended by the Government of Japan, relative to the activities of the Programme in the Republic of Maldives.
(2) 駐在員及び調整員は、その任務の遂行に必要な装備及び材料並びにその身回品及び家庭用品に関連して課される関税、内国税その他すべての種類の課徴金(ただし、保管、運送及び類似の役務に関する課徴金を除く。)を免除される。
(2) The Representative and the Co-ordinators will be exempted from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of equipment and materials necessary for the performance of their functions as well as of their personal and household effects.
駐在員及び調整員は、また、一人につき一台の自動車を無税で輸入すること(又はモルディヴ共和国における保税倉庫から購入すること)を認められる。
The Representative and the Coordinators will also be allowed duty-free importation (or purchase from bond in the Republic of Maldives ) of one motorcar each.
(3) 駐在員及び調整員、海外から送付される給与に関連して課される所得税その他すべての種類の課徴金を免除される。
(3) The Representative and the Co-ordinators will be exempted from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas.
5 モルディヴ共和国政府は、モルディヴ共和国における協力隊員の公務に起因し、その遂行中に発生し、又は、その他その遂行中における作為又は不作為に関連する請求が生じた場合には、その請求に関する責任を負う。ただし、これらの請求が協力隊員の故意又は重大な過失から生ずる場合には、この限りでない。
5. The Government of the Republic of Maldives undertakes to bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in the Republic of Maldives, except when such claims arise from the wilfull misconduct or gross negligence on the part of the volunteers.
6 両政府は、モルディヴ共和国における計画の実施を成功させるため随時協議する。
6. The two Governments will hold consultations, from time to time, for the successful implementation of the Programme in the Republic of Maldives.
7 この了解は、両政府間の書簡交換によつて修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によつて通告することにより終了させることができる。
7. The present under standings may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months' written notice of its intention to terminate them.
本使は、更に、この書簡及び前記の了解をモルディヴ共和国政府に代わつて確認される貴官の返簡が両政府間の合意を構成し、その合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and your Note in reply confirming the foregoing understandings on behalf of the Government of the Republic of Maldives will constitute an agreement between the two Governments, which will enter into force on the date of your reply.

書簡をもつて啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本官は、前記の了解をモルディヴ共和国政府に代わつて確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm the foregoing understandings on behalf of the Government of the Republic of Maldives and to agree that Your Excellency's Note and this reply will constitute an agreement between the two Governments, which will enter into force on the date of this reply.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
