AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF INDONESIA ON SCIENTIFIC AND TECHNOLOGICAL CO-OPERATION

　日本国政府及びインドネシア共和国政府は、

　The Government of Japan and the Government of the Republic of Indonesia,


　日本国とインドネシア共和国との間に存在する緊密かつ友好的な閑係を一層促進することを希望し、

　Desiring to further promote the close and friendly relations existing between Japan and the Republic of Indonesia


　千九百六十一年七月一日に東京で署名された日本国とインドネシア共和国との間の友好通商条約第七条が、両国は科学及び技術の分野において協力することを定めていることを想起し、

　Recalling that Article VII of the Treaty of Amity and Commerce between Japan and the Republic of Indonesia signed at Tokyo on July 1 1961 envisages that the two countries shall co-operate in scientific and technological field,


　そのような協力から利益が得られることを認め、

　Recognizing the benefits to be derived from such co-operation,


　平和的目的のため及び相互の利益のため両政府間の科学技術協力を一層促進することにつき共通の関心を有することを考慮し、

　Considering their common interest in further promoting scientific and technological co-operation between the two Governments for peaceful purposes and for their mutual benefit and


　そのような協力を一層強化することを目的として、

　Aiming at further strengthening such co-operation


　次のとおり協定した。

　Have agreed as follows:


第一条
1　両政府は、平等及び相互利益の原則の下に、両政府間の科学技術協力を促進する。

Article 1
1. The two Governments shall, on the principle of equality and mutual benefit promote scientific and technological co-operation between them.


2　1の協力は、次の分野において行うことができる。

2. Such co-operation may be undertaken in the following areas:


(a)　海洋科学

(a) Marine sciences;


(b)　エネルギー

(b) Energy;


(c)　医療

(c) Medicine;


(d)　農業

(d) Agriculture;


(e)　地球科学

(e) Geosciences;


(f)　建築及び土木

(f) Architecture and Civil Engineering;


(g)　宇宙

(g) Space;


(h)　気象学

(h) Meteorology;


(i)　電気通信

(i) Telecommunication;


(j)　産業開発の基礎として適当な科学技術

(j) Science and technology suitable to provide a basis for industrial development;


(k)　科学情報の処理システム

(k) Processing system of scientific information; and


(l)　相互に合意されるその他の分野

(l) Other areas as may be mutually agreed,


第二条
　この協定に基づく協力活動の形態には、次のものを含めることができる。

Article II
　Forms of the co-operative activities under this Agreement may include:


(a)　情報の交換

(a) Exchange of information;


(b)　科学者及びその他の専門家又は技術者の訪間及び交流

(b) Visits and exchanges of scientists and other experts or technical personne1;


(c)　専門家の会合その他の各種形態の会合

(c) Meetings of various forms, such as those of experts;


(d)　共同計画又は協調計画の実施

(d) Execution of Joint or coordinated projects and programmes;


(e)　必要な資機材の供与

(e) Provision of necessary materials and equipment; and


(f)　相互に合意されるその他の協力形態

(f) Other forms of co-operation as may be mutually agreed.


第三条
1　この協定に基づく特定の協力活動の細目及び手続を定める実施取極は、両政府又は両政府の機関のいずれか適当なものを当事者として行うことができる。

Article III
1. Implementing arrangements setting forth the details and procedures of the specific co-operative activities under this Agreement may be made between the two Governments or their agencies whichever is appropriate.


2　実施取極には、次のものに関する規定を含めることができる。

2. The implementing arrangements may include provisions with respect to:


(a)　協力活動のための費用の分担

(a) sharing of the costs of the co-operative activities;


(b)　協力活動から生ずる工業所有権の取扱い

(b) handling of industrial property arising from the co-operative activities;


(c)　協力活動から生ずる情報の入手及び伝達

(c) access to and transmittal of the information arising from the co-operative activities;


(d)　第三者から取得した商業的価値を有する情報の入手及び伝達

(d) access too and transmittal of commercially valuable information obtained from third parties; and


(e)　協力活動において生じた損害に関する責任

(e) liability for damages brought about in the course of the co-operative activities.


第四条
　両政府は、この協定の目的を達成するため、

Article IV
　For the achievement of the aim of this Agreement, the two Governments shall have meetings at mutually agreed times and at places in Japan or Indonesia in order to:


(a)　この協定の実施に関連する主要な政策事項の討議並びに

(a) discuss major policy issues relating to the implementation of this Agreement; and


(b)　この協定に基づく活動及び成果の検討

(b) review activities and accomplishments under this Agreement.


　を行うことを目的として、相互に合意する時期に日本国内又はインドネシア内の場所で、会合を開催する。

　


第五条
　この協定は、日本国及びインドネシアにおいて施行されている法令に従つて適用される。

Article V
　The provisions of this Agreement shall be applied in accordance with the laws and regulations in force in Japan and Indonesia


第六条
　この協定のいかなる規定も、両政府間の協力に関する他の取極でこの協定の署名の日に存在するもの又はその後締結されるものに影響を及ぼすものと解してはならない。

Article VI
　Nothing in this Agreement shall be construed to prejudice other arrangements for co-operation between the two Governments, existing at the date of signature of this Agreement or concluded thereafter.


第七条
1　この協定の適用上、「インドネシア」とは、インドネシア共和国の法令において定義する同国の領域並びに大陸棚及び隣接水域の一部であつて、国際法に従つて同国が主権、主権的権利又は他の権利を有するものをいう。

Article VII
1. For the purposes of this Agreement the term "Indonesia" comprises the territory of the Republic of Indonesia as defined in its laws and parts of the continental shelf and adjacent seas, over which the Republic of Indonesia has sovereignty, sovereign rights or other rights in accordance with inter-national law.


2　この協定の適用上、「日本国」とは、日本国の領域並びに国際法に従つて同国が管轄権を有する大陸棚及び隣接水域をいう。

2. For the purposes of this Agreement, the term "Japan" means the territory of Japan, and the continental shelf and adjacent seas over which Japan has jurisdiction in accordance with international law.


第八条
1　この協定は、その効力発生のために必要な憲法上の手続を完了した旨のインドネシア共和国政府からの文書による通告を日本国政府が受領した日に効力を生ずる。この協定は、二年間効力を有するものとし、その後は、2の規定に定めるところによつて終了するまで効力を存続する。

Article VIII
1. This Agreement shall enter into force on the date of receipt by the Government of Japan of a written notice from the Government of the Republic of Indonesia stating that necessary constitutional procedures for the entry into force of this Agreement have been completed. It shall remain in force for two years and shall continue in force thereafter until terminated in accordance with the provisions of paragraph 2 below.


2　いずれの一方の政府も、三箇月前に他方の政府に対して文書による予告を与えることにより、最初の二年の期間の満了の際又はその後いつでもこの協定を終了させることができる。

2. Either Government may, by giving a written notice of three months to the other Government terminate this Agreement at the end of the initial period of two years or at any time thereafter.
