光合性による太陽エネルギー転換の分野における研究のための協力に関する日本国政府とアメリカ合衆国政府との間の交換公文

書簡をもつて啓上いたします。本使は、千九百七十九年五月二日にワシントンで署名されたエネルギー及びこれに関連する分野における研究開発のための協力に関する日本国政府とアメリカ合衆国政府との間の協定(以下「基本協定」という。)第四条が、基本協定第二条にいう分野における協力活動の細目及び手続を定める実施取極が両政府又は両政府の機関のいずれか適当な方を当事者として行われることを定めていることに言及するとともに、日本国政府に代わつて次の取極を提案する光栄を有します。
Excellency, I have the honor to refer to Article Ⅳ of the Agreement between the Government of Japan and the Government of the United States of America on Cooperation In Research and Development In Energy and Related Fields, signed at Washington on May 2, 1979 (hereinafter referred to as "the Basic Agreement"), which provides that implementing arrangements specifying the details and procedures of cooperative activities in the areas referred to In Article Ⅱ of the Basic Agreement will be made between the two Governments or their agencies, whichever is appropriate, and to propose, on behalf of the Government of Japan, the following arrangements:
1 両政府は、平等及び相互利益の原則に基づき、光合成による太陽エネルギー転換の分野における生物学的並びに物理学的及び化学的な研究のための協力(以下「光転換及び光合成研究協力計画」という。)を維持し、かつ、強化する。
1. The two Governments will maintain and intensify their cooperation in research, both biological as well as physical and chemical, In the area of solar energy conversion by means of photosynthesis (hereinafter referred to as "the Cooperative Photo-conversion and Photosynthesis Research Program") on the basis of equality and mutual benefit.
2 光転換及び光合成研究協力計画は、日本国側は文部省及び科学技術庁、合衆国側は国立科学財団及びエネルギー省(以下一括して「実施機関」という。)が実施する。
2. The Cooperative Photo-conversion and Photo-synthesis Research Program will be conducted by the Monbusho and the Science and Technology Agency on the Japanese side and the National Science Foundation and the Department of Energy on the United States side (hereinafter Jointly referred to as "the Implementing Agencies").
3 光転換及び光合成研究協力計画から生ずる工業所有権及びその実施権の公正な配分は、各国の関係法令の範囲内において、実施機関の間の取決めの定めるところによつて行われる。
3. The equitable distribution of industrial property resulting from the Cooperative Photoconversion and Photosynthesis Research program and of licenses thereof will be achieved as set forth in arrangements between the Implementing Agencies within the scope of the applicable laws and regulations in force in each country.
4 この取極に基づく活動は、各国の予算及び関係法令に従うことを条件とする。
4. Activities under the present arrangements shall be subject to budgetary appropriations and to the applicable laws and regulations in each country.
5 この取極に定めのない具体的な実施の手続及び細目(助言者的性格を有する運営委員会の設置を含む。)は、実施機関の間の協議により決定することができ、また、実施機関の間の取決めに定めることができる。
5. Specific implementing procedures and details not prescribed in the present arrangements including the establishment of a steering committee of an advisory nature, may be determined through consultation among the Implementing Agencies, and may be set forth in arrangements between them.
6 この取極に関するいかなる問題も、両政府間の相互の協議により解決する。
6. All questions related to the present arrangements will be settled by mutual consultation of the two Governments.
7 この取極は、基本協定が有効である限り効力を有する。もつとも、いずれの政府も、他方の政府に対し、いつでもこの取極を終了させる意思を書面により通告することができるものとし、その場合には、この取極は、当該通告が行われた後六箇月で終了する。
7. The present arrangements shall continue in force so long as the Basic Agreement remains in force. However, either Government may at any time give written notice to the other Government of its intention to terminate the present arrangements, in which case the present arrangement s shall terminate six months after such notice has been given.
本使は、更に、前記の取極がアメリカ合衆国政府にとつて受諾し得るものであるときは、この書簡及び閣下のその旨の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
If the foregoing arrangements are acceptable to the Government of the United States of America, I have further the honor to propose that this Not. and Your Excellency's reply to that effect shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

本長官は、更に、前記の取極がアメリカ合衆国政府にとつて受諾し得るものであることを確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honor to confirm that the foregoing arrangements are acceptable to the Government of the United States of America and to agree that Your Excellency's Note and this Note in reply shall be regarded as constituting an agreement between the two Governments, which will inter into force on the date of this reply.
