青年海外協力隊の派遣に関する日本国政府とタイ王国政府との間の交換公文

(Japanese Note)


　

　Bangkok, January 19, 1981


　　書簡をもつて啓上いたします。本大臣は、日本国とタイ王国との間の技術協力を促進するため青年海外協力隊計画（以下「計画」という。)に基づき協力隊員をタイ王国に派遣することに関し、日本国政府の代表者とタイ王国政府の代表者との間でバンコッタにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。

　Exce11ency,
   I have the honour to refer to the recent discussions held in Bangkok between the represe11tatives of the Government of Japan and the Government of the Kingdom of Thailand concerning the dispatch of volunteers to the Kingdom of Thailand under the Japan Overseas Co-operation Volunteers Programme (herein-after referred to as "the Programme") with a view to promoting technical cooperation between the two confirms and to confirm on behalf of the Government of Japan the following understandings reached between them:


1　日本国政府は、タイ王国政府の要請に基づき、両国の関係当局間で別個に合意される計画に従い、タイ王国の社会的及び経済的開発に寄与するため、日本国の現行法令に従い、協力隊員をタイ王国に派遣するために必要な措置をとる。

1. At the request of the Government of the Kingdom of Thailand, the Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to the Kingdom of Thailand for the purpose of contributing to the social and economic development of the Kingdom of Thailand according to the schedules to be separately agreed upon between the authorities concerned of the two countries.


2　日本国政府は、協力隊員の日本国とタイ王国との間の渡航費、タイ王国における生活手当、生命保険料及び医療費を負担し、並びに協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要か措置をとる。

2. The Government of Japan will take necessary measures to bear the cost of international travel between Japan and the Kingdom of Thailand, living allowances in the Kingdom of Thailand, life insurance and medical care for the volunteers and make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their duties.


3　タイ王国政府は、次のことを行う。

3. The Government of the Kingdom of Thailand will:


(1)　2に掲げる装備、機械、材料及び医薬品に関連して課される関税及び租税を免除すること。

(1) Grant exempt ion from customs duties and taxes in respect of the equipment, machinery, materials a1ld medical supplies mentioned in paragraph 2 above;


(2)　協力隊員につき、最初の到着後六箇月以内にタイ王国に持ち込まれる身回品に関連して課される関税及び租税を免除すること。

(2) Exempt the volunteers from customs duties and taxes in respect of their persona1 effect s brought into the Kingdom of Thailand within six months of their first arrival;


(3)　協力隊員につき、2に掲げる生活手当等海外から送付される給与に関連して課される所得税その他類似の課徴金を免除すること。

(3) Exempt the volunteers from income tax and other charges of a similar nature in respect of any allowances to be remitted to them from overseas such as the living allowances me11tioried in paragraph 2 above;


(4)　協力隊員に対し、タイ王国における任期中、タイ王国政府の医療役務及び便宜を供与すること。

(4) Make available to the volunteers during the term of their assignment in the Kingdom of Thailand by medical services and facilities of the Government of the Kingdom of Thailand;


(5)　協力隊員に対し、タイ王国政府により与えられる任務を遂行する場所における事情が許す限りの適当た住居施設を供与すること。

(5) Provide the volunteers with such appropriate accommodation as the circumstances permit at places where they are to perform their duties to be assigned to them by the Government of the Kingdom of Thai1and;


(6)　各協力隊員に対し、協力隊員に与えられる任務の遂行に際して十分な援助を関係当局に要請する身分証明書を発給すること。

(6) Issue identification to each volunteer, asking the appropriate authorities for full support in the accomplishment of the duties assigned to the volunteers;


(7)　協力隊員に対し、タイ王国において同様の任務を遂行している第三国の協力隊員に与えられているものより不利でないその他の待遇を与えること。

(7) Accord the volunteers such other treatment as is no less favourable than that accorded to the volunteer s of ally third country performing similar missions i11 the Kingdom of Thailand.


4(1)　タイ王国政府は、タイ王国における計画の活動に関連して日本国政府による技術協力の実施機関である日本国際協力事業団が与える任務を遂行する駐在員一人及び調整員が配置されることに同意する。

4. (1) The Government of the Kingdom of Thailand agrees that there will be a Representative and Coordinators who will discharge the duties to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical cooperation by the Government of Japan, relative to the activities of the Programme in the Kingdom of Thailand.


(2)　駐在員及び調整員は、その任務の遂行に必要な公的な装備及び材料並びに最初の到着後六箇月以内にタイ王国の持ち込まれるその身回品及び家庭用品(駐在員及び調査員各一人につき一台の自動車を含む。)に関連して課される関税及び租税を免除される。これらの物品については、その後タイ王国内において、現地の関税及び租税の免除を受ける権利を有しない個人又は団体に売却又は譲渡される場合には、当該関税及び租税が支払われなければならない。

(2) The Representative and Coordinators will be exempted from customs duties and taxes in respect of official equipment and materials necessary for the performance of their functions, and of their personal and household effects including one motor vehicle each for the Representative and Coordinators brought into the Kingdom of Thailand within six months of their first arrival. Such goods will be subject to the payment of local customs duties and taxes if they are subsequently sold or transferred within the kingdom of Thailand to individual s or organizations not entitled to exemption from such duties and taxes.


(3)　駐在員及び調整員は、海外から送付される給与に関連して課される所得税その他類似の課徴金を免除される。

(3) The Repre5entestive and Coordinators will be exempted from income tax and other charges of a simi1ar nature in respect of any allowances to be remitted from overseas.


5　両政府の代表者は、タイ王国における計画の実施を成功させるため随時協議する。

5. The representatives of the two Governments will hold consultations, from time to time for the successfu1 implementation of the Programme in the Kingdom of Thailand.


6　前記の了解は、両政府間の書簡の交換によつて修正することができ、かつ、いずれかの政府が他方の政府に対し当該了解を終了させる意思を六箇月前に書面によつて通告することにより終了させることができる。

6. The understandings set out above may be amended by an exchange of letters between the two Government and terminated by either Government by giving to the other six months' prior written notice of its intention to terminate them.


　本大臣は、更に、この書簡及び前記の了解をタイ王国政府に代わつて確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。

　I have further the honour to propose that this Note and Your Excellency's Note in reply confirming the foregoing understandings on behalf of the Government of the Kingdom of Thailand will constitute sin agreement between the two Governments, which will enter into force on the date of Your Excellency fsrep1y.

　本大臣は、更に、前記の了解をタイ王国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。

　I have further the honour to confirm on behalf of the Government of the Kingdom of Thailand the foregoing understandings and to agree that Your Excellency's Note and this Note w111 constitute are agreement between the two Government, which will enter into force on the date of this rep1y.
