日本国産米の売買に関する契約に関連する日本国政府とタンザニア連合共和国政府との間の交換公文

書簡をもつて啓上いたします。本官は、タンザニア連合共和国政府がタンザニア連合共和国の食糧需給事情を緩和するため日本国の協力を要請したことに基づき千九百八十一年三月十日に東京においてタンザニア連合共和国政府と日本国農林水産省食糧庁との間で締結された「日本国食糧庁とタンザニア連合共和国政府との間の日本国産米の売買に関する契約」(以下「契約」という。)に言及する光栄を有します。契約には、なかんずく次の事項が定められています。
Excellency, I have the honour to refer to the "Con-tract for Sale and Purchase of Japanese Rice between the Food Agency of Japan and the Government of the United Republic of Tanzania" (hereinafter referred to as "the Contract") concluded between the Government of the United Republic of Tanzania and the Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan on March 10, 1981 in Tokyo at the request of my Government for Japanese cooperation in meeting the food requirements in the United Republic of Tanzania. The Contract provides, inter alia, for the following
(a) 日本国農林水産省食糧庁は、タンザニア連合共和国に対し、日本国産水稲うるち精米二万五千メトリック･トンを延払によつて、売り渡す。
(a) The Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan shall supply on a deferred payment basis to the Government of the United Republic of Tanzania a total of Twenty-five thousand (25,000) metric tons of Japanese milled non-glutinous rice;
(b) その米穀の船積みは、千九百八十一年内にできる限り速やかに完了する。
(b) The shipment of the said rice shall be completed as early as possible in 1981;
(c) その米穀の引渡しは、日本国の港における本船積込み渡しによる。
(c) The said rice shall be delivered on the basis of f. o. b. stowed at Japanese ports;
(d) その米穀の価格は、本船積込渡しにより、一メトリック･トンにつき、九万九千円とする。
(d) The price of the said rice shall be ninety-nine thousand (99, OOO) yen per metric ton on the basis of f.o.b. stowed;
(e) タンザニア連合共和国政府は、その米穀を、タンザニア連合共和国の国内消費に使用するものとする。
(e) The Government of the United Republic of Tanzania shall use the said rice for domestic consumption in the United Republic of Tanzania;
(f) 延払の条件は次のとおりとする。
(f) The t orn1s and conditions of the deferred payment shall be as follows:
(i) 元本の支払は、十年の据置期間の後二十年の期間にわたり、均等年賦によつて行う。
(i) The payment of the principal shall be made in equal annual instalments over a period of twenty years after a ten years' grace period;
(ii) 利子率は、据置期間においては年二パーセント、及び据置期間の後二十年の期間においては年三パーセントとし、かつ、その利子は、毎年支払う。
(ii) The rate of interest shall be two per cent (2%) per annum during the grace period and three per cent (3%) per annum during the period of twenty years after the grace period, and such interest shall be paid annually;
(g) 契約から生ずるすべての債務及び義務は日本国通貨で表示され、かつ、タンザニア連合共和国政府から日本国農林水産省食糧庁への支払は日本円で行われる。
(g) A11 liabilities and obligations accruing from the Contract shall be quoted in Japanese yen and the payment from the Government of the United Republic of Tanzania to the Food Agency, ministry of Agriculture, Forestry and Fisheries of Japan shall be made in Japanese yen.
本官は、タンザニア連合共和国政府が契約の締結について極めて満足している旨を閣下に通報するとともに、契約に関連する次の了解を本国政府に代わつて確認します。
I wish to inform Your Excellency that the Government of the United Republic of Tanzania is highly satisfied with the conclusion of the Contract and to confirm on behalf of my Government the following understanding relating to the Contract:
1 両政府は、それぞれの国の現行法令に従い、契約の円滑な及び適時の実施を容易にするものとし、このため必要な措置をとる。
1. The two Governments will, in accordance with the laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.
2 両政府は、生産及び国際通商貿易の通常の形態に有害な影響を与えることを避けるという原則が、契約による日本国産米の供給を規律すべきであることを認める。したがつて、タンザニア連合共和国政府は、日本国政府と必要な協議を行いつつ、前記の日本国産米の購入との関連でこの原則を遵守するためのすべての妥当な措置をとる。
2. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production and international commercial trade should govern the supply of Japanese rice under the Contract. The Government of the United Republic of Tanzania will, therefore, in due consultation with the Government of Japan I take a11 appropriate measures for the observance of the said principle in connection with the purchase of the said Japanese rice.
3 両政府は、この了解から又はそれに関連して生ずることのあるいかなる問題についても、相互に協議する。
3. The two Government will consult with each other on any problems that may arise out of this understanding or in connection therewith.
本官は、閣下が、前記のことが日本国政府の了解でもあることを日本国政府に代わつて確認されれば幸いであります。
I shou1d be grateful if Your Excellency would confirm, on behalf or the Government of Japan I that this is also the understanding of the Government of Japan.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
