静止気象衛星二号システム計画のための協力に関する日本国政府とオーストラリア政府との間の交換公文

Canberra, Sept ember 22, 1981
書簡をもつて啓上いたします。本使は、気象衛星技術の開発及び日本国の気象業務の改善に寄与するため並びに世界気象機関の推進している世界気象監視計画に引き続き参加するため、千九百八十一年八月に打ち上げられた静止気象衛星二号(東経百四十度の静止軌道に乗る予定である。)を用いて日本国政府が実施する静止気象衛星二号システム(以下「システム」という。)のための計画についての協力に関し、日本国政府の代表者とオーストラリア政府の代表者との間で最近行なわれた交渉に言及するとともに、この協力のために次の取極を提案する光栄を有します。
Sir, I have the honour to refer to the recent negotiations held between the representatives of the Government of Japan and of the Government of Australia concerning co-operation on the project for the Geostationary Meteorological Satellite-2 System (hereinafter referred to as "the System") which the Government of Japan will bring into operation, through the Geostationary Meteorological Satellite-2 which was launched in August, 1981 and which will be eventually placed in the geostationary orbit at 140 degrees E, with a view to contributing to the development of meteorological satellite technology and the improvement of meteorological services of Japan as well as with a view to continuing its participation in the ongoing world weather watch program of the World Meteorological Organization. I therefore propose the following arrangements for this cooperation:
1 日本国政府は、オーストラリア政府の要請により、日本国の法令の範囲内で、かつ、システムの技術上及び日本国気象庁の業務上の能力が許容する限り、システムが正常な運行を続けている間、システムによる特別気象観測を行い、並びにオーストラリア政府に対しこの観測から取得される情報及び資料を提供する。
1. At the request of the Government of Australia, the Government of Japan shall make, within the scope of the laws and regulations of Japan, special meteorological observation through the System and provide the Government of Australia with the information and data derived from such observations, as far as the technical capacity of the System arid service capacity of the Japan Meteorological Agency allow, and as long as the System continues to operate in a normal condition.
2 日本国政府は、オーストラリア政府がシステムによる気象観測から取得される情報及び資料について研究のために要請を行う場合には、当該要請に対し妥当な考慮を払う。
2. When the Government of Australia makes a request for the information and data derived from meteorological observations through the System for its research purposes, the Government of Japan shall give due consideration to such request.
3 オーストラリア政府は、自己の費用で、両政府間の合意を構成する千九百七十七年七月七日付けの交換公文3の規定により設置された測距局について静止気象衛星二号の三点測距のために必要な拡充を完了する。オーストラリア政府は、また、自己の費用で、システムが正常な運行を続けている間、その測距局を運用し及び保守する。
3. The Government of Australia shall, at its own expense, complete such augmentation of the Turnaround Ranging Station which was installed pursuant to Paragraph 3 of the Exchange of Notes of July 7, 1977 constituting an agreement between the two Governments as is required for the trilateration of the Geostationary Meteorological Satellite-2. The Government of Australia shall also, at its own expense, operate and maintain the Station as long as the System continues to operate in a normal condition.
4 この計画についての協力のための細目及び手続は、日本国気象庁とオーストラリア科学技術省との間で締結される実施取極に定める。
4. The details and procedures for co-peration in the present project shall be provided for in the implementing arrangement to be entered into between the Japan Meteorological Agency and the Department of Science and Technology of Australia.
5 この取極のいかなる規定も、3にいう交換公文に定める取極を害するものと解してはならない。
5. Nothing in the present arrangements shall be construed to prejudice the arrangements contained in the Exchange of Notes mentioned in Paragraph 3.
6 両政府は、この計画についての協力から又はこれに関連して生ずることのあるいかなる問題についても相互に協議する。
6. The two Governments shall consult with each other on any problem that may arise from or in connection with co-operation in the present project.
本使は、更に、この書簡及びオーストラリア政府に代わつて前記の取極を確認する貴官の返簡が両政府間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that the present Note and your Note in reply confirming the foregoing arrangement s on behalf of the Government of Australia shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of your reply.
本使は、以上を申し進めるに際し、ここに重ねて貴官に向かつて敬意を表します。

本官は、更に、オーストラリア政府に代わつて前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずるものとすることに同意する光栄を有します。
I have further the honour to confirm the foregoing arrangements on behalf of my Government and to agree that Your Excellency's Note and this Note in reply shall together be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of this reply.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
