青年海外協力隊の派遣に関する日本国政府とスリ・ランカ民主社会主義共和国政府との間の交換公文

Colombo, May 15, 1980
書簡をもつて啓上いたします。本使は、日本国とスリ・ランカ民主社会主義共和国との間の技術協力を促進するため、青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をスリ・ランカ民主社会主義共和国に派遣することに関し、日本国政府の代表者とスリ・ランカ民主社会主義共和国政府の代表者との間でコロンボにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Sir, I have the honour to refer to the recent discussions held in Colombo between the representatives of the Government of Japan and the Government of the Democratic Socialist Republic of Sri Lanka concerning the dispatch of volunteers to the Democratic Socialist Republic of Sri Lanka under the Japan Overseas Co-operation Volunteers Programme (hereinafter referred to as “the Programme”) with a view to promoting technical co-operation between the two countries and to confirm on behalf of the Government of Japan the following under-standings reached between them:
1 日本国政府は、スリ・ランカ民主社会主義共和国政府の要請に基づき、かつ、日本国の現行法令に従い、スリ・ランカ民主社会主義共和国の社会的及び経済的開発に寄与するため、両国の関係機関間で別個に合意される計画に従い協力隊員をスリ・ランカ民主社会主義共和国に派遣ずるために必要な措置をとる。
1. At the request of the Government of the Democratic Socialist Republic of Sri Lanka and in accordance with the laws and regulations in force in Japan, the government of Japan will take necessary measures to dispatch the volunteers to the Democratic Socialist Republic of Sri Lanka for the purpose of contributing to the social and economic development of the Democratic Socialist Republic of Sri Lanka, according to the schedules to be separately agreed upon between the agencies concerned of the two countries.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とスリ・ランカ民主社会主義共和国との間の渡航費及びスリ・ランカ民主社会主義共和国における生活手当を負担し、並びに協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Democratic Socialist Republic of Sri Lanka and living allowances in the Democratic Socialist Republic of Sri Lanka for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 スリ・ランカ民主社会主義共和国政府は、協力隊員に対し、次の特権、免除及び利益を与える。
3. The Government of the Democratic Socialist Republic of Sri Lanka will grant the volunteers the following privileges, exemptions and benefits:
(1) 2に掲げる装備、機械、材料及び医薬品に関連して課される関税、内国税その他すべての種類の課徴金は、支払う必要がある場合には、協力隊員の役務を取得する機関が負担する。
(1) Customs duties, taxes and charges of any kind in respect of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above, in case payable, will be borne by the agencies obtaining the services of the volunteers.
(2) 協力隊員の着任後六箇月以内に輸入される身回品及び家庭用品に関連して課される関税、内国税その他すべての種類の課徴金(ただし、保管、運送及び類似の役務に関する課徴金を除く。)は、支払う必要がある場合には、協力隊員の役務を取得する機関が負担する。
(2) Customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of their personal and household effects imported within six months of their first arrival, in case payable, will be borne by the agencies obtaining the services of the volunteers.
(3) 2に掲げる生活手当等協力隊員に海外から送付される給与に関連して課される所得税その他すぺての種類の課徴金の免除。
(3) Exemption from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas such as the living allowances mentioned in paragraph 2 above.
(4) スリ・ランカ民主社会主義共和国における協力隊員の任期中の医療費は、協力隊員の役務を取得ずる機関が負担ずる。
(4) Medical expenses of the volunteers during the term of their assignment in the Democratic Socialist Republic of Sri Lanka will be borne by the agencies obtaining the services of the volunteers.
(5) 協力隊員の役務を取得する機関は、可能な場合には協力隊員に無料の住居施設を提供し、また、協力隊員がその勤務地に近接する適当な住居施設を確保できるよう援助する。
(5) The agencies obtaining the services of the volunteers will, where possible, provide rent-free housing accommodation to the volunteers, or will assist the volunteers to find suitable housing accommodation close to there place of work.
4(1) スリ・ランカ民主社会主義共和国政府は、スリ・ランカ民主社会主義共和国における計画の活動に関連して日本国政府の技術協力の実施機関である国際協力事業団が与える任務を遂行する駐在員一人及び調整員を受け入れる。
4.(1) The Government of the Democratic Socialist Republic of Sri Lanka will accept a Representative and Co-ordinators who will discharge the duties to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical co-operation extended by the Government of Japan, relative to the activities of the Programme in the Democratic Socialist Republic of Sri Lanka.
(2) 駐在員及び調整員は、所得税を免除される。
(2) The Representative and the Co-ordinators will be exempted from income tax.
(3) 駐在員、調整員及びその家族(雇い人も含む。)は、その滞在期間中、かつ、着任後六箇月以内に、担保の提供なしに次のものを含む個人用の物品を無税で輸入することができる。(a)一家族につき自動車一台、冷蔵庫一合、冷凍庫一台、ラジオー台、レコード・プレーヤー一台、テープレコーダー一台、テレビ受像機一台及び小型電気器具並びに(b)一人につき冷房機一台、写真撮影器具一式及び映画撮影器具一式。これらの物品は、一般に再輸出されねばならない。無税で輸入された自動車及び耐久家財は、これらの物品の売却に関するスリ・ランカ民主社会主義共和国の現行法令による場合を除き、スリ・ランカ民主社会主義共和国内で売却してはならない。駐在員及び調整員は、その任期が更に一年継続することが判明している場合には、スリ・ランカ民主社会主義共和国における自動車の所有及び使用の開始後二年の期間が終了するのに先立ちタイヤ及びチユーブ一組を無税で輸入することができる。
(3) On first arrival, the Representative and the Co-ordinatiors and their families and other members of their households will be permitted to import for the duration of their stay and within six months of their arrival, free of customs duties and taxes and without providing security, articles for their personal use. Such article should include (q) for each household one motor vehicle, one refrigerator, one deep freezer, one radio, one record player, one tape recorder, one television set and minor electrical appliances and (b) for each person one air-conditioner and one set of photographic equipment and cine equipment. These articles should normally be re-exported. Motor vehicles and durable household goods so imported should not be sold within the Democratic Socialist Republic of Sri Lanka except in accordance with the laws and regulations in force in the Democratic socialist Republic of Sri Lanka relating to the sale of such articles. The Representative and the Co-ordinators will be allowed to import free of customs duties one set of tyres and tubes towards the end of the second year of ownership and used of the motor vehicle in the Democratic Socialist Republic of Sri Lanka when it is known that the term of their assignment will be extended for another year.
(4) 駐在員及び調整員は、スリ・ランカ民主社会主義共和国における任期に関係なく、既婚者であつて家族を同伴する場合には一箇月一、五〇〇ルピー(船積港渡し)を限度として、また、未婚者の場合又は既婚者であつて家族を同伴しない場合には一箇月一、〇〇〇ルピー(船積港渡し)を限度として、食料品、アルコール飲料及びたばこを自己の使用のため無税で輸入ずることができる。
(4) The Representative and the Co-ordinators, irrespective of the term of their assignment in the Democratic Socialist Republic of Sri Lanka, will be entitled to import free of customs duties for their use, foodstuffs, liquor and cigarettes to the value of Rs. 1,500/- per month (fob) if married and accompanied by family, and Rs. 1,000/- per month (fob) if unmarried or married and not accompanied by family.
(5) 公用のため輸入される装備及び材料は、関税及び内国税を免除される。
(5) the equipment and materials imported for the official use will be exempted from customs duties and taxes.
5 スリ・ランカ民主社会主義共和国政府は、協力隊員の任務の遂行に起因する責任に関連して提起されるいかなる請求についても、協力隊員に対しその責任を免かれさせる。ただし、両政府がその請求が協力隊員の重大な過失又は故意から生じたことを合意した場合には、この限りでない。
5. The Government of the Democratic Socialist Republic of Sri Lanka will indemnify the volunteers against any claims brought in respect of liabilities resulting from the performance of their functions, except where it is agreed between the two Governments that such claims arise from the gross negligence or willful misconduct of the volunteers.
6 両政府は、スリ・ランカ民主社会主義共和国における計画の実施を成功させるため随時協議する。
6. The two Governments will hold consultations, from time to time, for the successful implementation of the Programme in the Democratic Socialist Republic of Sri Lanka.
7 この了解は、両政府間の書簡交換によつて修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面にょつて通告することにより終了させることができる。
7. The present understandings may be amended by an exchange of notes between the two governments and terminated by either Government by giving to the other six months’ written notice of its intention to terminate them.
本使は、更に、この書簡及び前記の了解をスリ・ランカ民主社会主義共和国政府に代わつて確認される貴官の返簡が両政府間の合意を構成し、その合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and your Note in reply confirming the foregoing understandings on behalf of the government of the Government of the Democratic Socialist Republic of Sri Lanka will constituting an agreement between the two Government, which will take effect on the date of your Note in reply.

I have further the honour to confirm the foregoing understanding on behalf of the Government of the Democratic Socialist Republic of Sri Lanka and to agree that Your Excellency’s Note and this reply will constitute an agreement between the two Governments, which will take effect on the date of this reply.
