Agreement on Fisheries between the Government of Japan the Government of Portugal
日本国政府及びポルトガル政府は、
The Government of Japan and the Government of Portugal,
海洋生物資源の合理的な管理、保存及び最適利用、両国の漁業地域社会の福祉並びにこれらの地域社会が依存する接続水域の生物資源に関する両政府の共通の関心を考慮し、
Having regard to their common concern for the rational management, conservation and optimum utilization of the living resources of the sea, for the welfare of their fishing communities and for the living resources of the adjacent waters upon which these communities depend;
ポルトガルが、同国に接続する二百海里水域の生物資源に対してこの資源の探査及び開発、保存並びに管理の目的のために排他的管轄権を行使していることを認め、
Recognizing that Portugal exercises exclusive jurisdiction over the living resources of its adjacent waters within a zone of 200 nautical miles, for the purposes of exploring and exploiting, conserving and managing these resources;
日本国の国民及び漁船が当該水域の生物資源の開発及び利用に当たりその伝統的な利益を引き続き追求するという日本国政府の希望を考慮し、
Considering the desire of the Government of Japan that nationals and fishing vessels of japan continue to pursue their traditional interest in the development and utilization of the living resources of that zone;
海洋生物資源の保存及び最適利用に関する事項につき両政府間の互恵的協力を維持しかつ円滑にし、並びに共通の漁業目的を達成するために国際場裡において相互の協議及び協力を継続するという希望を再確認し、
Reaffirming their desire to maintain and facilitate mutually beneficial cooperation between them in matters pertaining to the conservation and optimum utilization of the living resources of the sea, and to continue to consult and cooperate with each other in international for a with a view to achieving common fisheries objectives;
国家の慣行及び第三次国際連合海洋法会議における作業を考慮し、
Taking into account state practice and the work of the Third United Nations Conference on the Law of the Sea;
相互に関心を有する漁業が行われる枠組を定める条件を確立することを希望して、
Desirous of establishing the terms and conditions which define the framework within which fisheries of mutual concern shall be conducted;
次のとおり協定した。
Have agreed as follows:
第一条 1 ポルトガル政府は、本条の2及び3の規定に従い、日本国の漁船がポルトガルの領海の限界の外側であってポルトガルの排他的漁業管轄権の下にある水域(以下「水域」という。)において総漁獲可能量のうちポルトガルの収獲能力の余剰部分の適当な割当量を漁獲することを許可することを約束する。
Article I 1. The Government of Portugal undertakes to permit Japanese vessels to fish, within the zone under the exclusive fisheries jurisdiction of Portugal beyond the limits of its territorial sea, hereinafter referred to as “the Zone", for allotments, as appropriate, of parts of total allowable catch surplus to Portuguese harvesting capacity, in accordance with the provisions of paragraphs 2 and 3 of this Article.
2 ポルトガル政府は、水域における生物資源に対する排他的管轄権の行使に当たり、予見されない事態に対処するため必要な場合には調整することを条件として、毎年次のことを決定する。
2. In the exercise of its exclusive jurisdiction over the living resources in the Zone, the Government of Portugal shall determine annually, subject to adjustment when necessary to meet unforeseen circumstances:
a) 入手可能な最良の科学的証拠を基礎とし、かつ、魚種の相互依存関係、国際的に受け入れられている基準その他のすべての関連要素を考慮しての個別魚種又は複合魚種についての総漁獲可能量
a) the total allowable catch for individual stocks or complexes of stocks, on the basis of the best available scientific evidence, taking into account the interdependence of stocks, internationally accepted criteria, and all other relevant factors;
b) 当該魚種に関するポルトガルの収獲可能量
b) the Protuguese harvesting capacity in respect of such stocks; and
c) 適当な協議の後、魚種又は複合魚種の余剰部分につき日本国に対し適当に定められる割当量
c) after appropriate consultations, a quota or quotas allocation, as appropriately regulated, for Japan, of parts of surpluses of stocks or complexes of stocks.
3 ポルトガル政府は、2のa)及びb)にいう決定並びにのc)にいう割当量を両政府間で合意する最も適当な経路を通じ時宜を失することなく日本国政府に伝達することを約束する。
3. The Government of Portugal undertakes to transmit to the Government of Japan through the most appropriate channel, as agreed upon between the two Governments, the determinations referred to in sub-paragraphs a) and b) of paragraph 2, and the allocation referred to in subparagraph c) of paragraph 2, on a timely basis.
第二条 ポルトガル政府は、前条の2のc)の規定に従い日本国の漁船による収獲に供される割当量を決定するに当たり、最適利用の目的に従い、特に、ポルトガルの利益、日本国の国民及び船舶による伝統的漁業、相互に関心を有する生物資源の保存に関する日本国の従来からの協力並びに日本国による漁業調査及び魚種の識別に特別の考慮を払った上でのこの協定の規定に基づく両政府間の協力の発展を含むすべての関連要素を考慮する。
Article II In determining the quota or quotas allocation that may be made available to fishing vessels of Japan in accordance with sub-paragraph c) of paragraph 2 of Article I, the Government of Portugal, in pursuance of the objective of optimum utilization, shall take into account all relevant factors, including, inter alia, Portuguese interests, traditional fishing by nationals and vessels of Japan, previous cooperation by Japan with respect to conservation of living resources of mutual concern and the development of cooperation between the two Governments pursuant to the provisions of this Agreement with special regard to fishery research and identification of stocks by Japan.
第三条 日本国政府は、次のことを確保するため、すべての必要な措置をとる。
Article III The Government of Japan shall take all necessary measures to ensure:
a) 日本国の国民及び船舶が、この協定に従って認められる場合を除くほか、水域において生物資源の漁獲を差し控えること。
a) that nationals and vessels of Japan refrain from fishing for living resources within the zone, except as authorized pursuant to this Agreement;
b) この協定に基づき漁獲に従事するすべての日本国の漁船が、この協定に基づいて定められる条件に従うこと。
b) that all such fishing vessels engaging in fishing under this Agreement comply with the terms and conditions established under this Agreement; and
c) いかなる漁業についても、第一の2のc)にいう割当量を超えないこと
c) that the quota or quotas allocation referred to in sub-paragraph c) of paragraph 2 of Article I is not exceeded for any fishery.
第四条 1 日本国政府は、ポルトガル政府に対し、ポルトガル政府が定める手続に従い水域において漁獲に従事することを希望する日本国の各漁船の識別及び操業に関する情報を提供する。
Article IV 1. The Government of Japan shall provide the Government of Portugal with information concerning the identity and operation of each fishing vessel of Japan that wishes to engage in fishing within the Zone, in accordance with the procedures established by the Government of Portugal.
2 ポルトガル政府は、1の情報を受領したときは、日本国の漁船が水域において漁獲に従事することをこの協定の規定に従って可能にするため、ポルトガルの関係法律に基づく許可証の発給を含む必要な行政上の措置をとる。この措置は、この協定の実施を容易にし並びに生物資源の保存及び管理を確保するための妥当な料金の支払の要求を含むことができる。
2. On receipt of the information referred to in paragraph 1, the Government of Portugal shall take the necessary administrative measures, including the issuance of permits pursuant to applicable laws of Portugal, to enable fishing vessels of Japan, in accordance with the provisions of this Agreement, to engage in fishing within the Zone. Such measures may include requirement of the payment of reasonable fees to facilitate the implementation of this Agreement and to ensure the conservation and management of the living resources.
第五条 1 日本国政府は、日本国の漁船が、この協定に基づき水域において漁業を行うに当たり、漁業に関するポルトガルの法令及びポルトガル政府の規則によって定められるその他の条件(特に、前条の2に従ってとられる行政上の措置)に従うことを確保する。
Article V 1. The government of Japan shall ensure that, in the conduct of fisheries within the Zone under this Agreement, fishing vessels of Japan comply with the laws and regulations of Portugal in respect of fisheries and with other terms and conditions established in the regulations of the government of Portugal, in particular the administrative measures taken in accordance with paragraph 2 of Article IV.
2 ポルトガル政府は、日本国政府に対し、1にいうすべての条件につき適切な通報を行う。
2. The Government of Portugal shall give the government of Japan due notice of all the terms and conditions referred to in paragraph 1.
第六条 1 日本国政府は、この協定に従い水域において生物資源を漁獲する日本国の各漁船が、正当に権限を有するポルトガルの取締官による当該漁船への乗船及び当該漁船の検査を許容し及び助けること並びに取締行為が行われる場合にはこれに協力することを確保するため、適当な措置をとる。
Article VI 1. The Government of Japan shall take appropriate measures to ensure that each fishing vessel of Japan fishing pursuant to this Agreement for living resources within the Zone, allow and assist the boarding and inspection of such vessel by any duly authorized enforcement official of Portugal, and cooperate in such enforcement action as may be undertaken.
2 ポルトガル政府の当局によって日本国の漁船が拿捕され又は日本国の漁船の乗組員が逮捕されたときは、日本国政府に対し、その旨が外交上の経路を通じて速やかに通報される。
2. In cases of seizure of a fishing vessel of Japan and of arrest of its crew by the authorities of the government of Portugal, notification shall be given promptly through diplomatic channels informing the government of Japan of the action taken.
3 拿捕された漁船及び逮捕された乗組員は裁判所決定する妥当な供託金又はその他の保証を条件として、速やかに釈放される。
3. Seized fishing vessels and arrested crews shall be promptly released, subject to such reasonable bond or other security as may be determined by the court.
第七条 1 日本国政府は、この協定の規定に基づく両国間の漁業関係の発展に照らして適当な場合には、水域の生物資源の保存のための科学的調査並びにこの資源の最適利用及び管理のためのその他の適当な措置に関し、ポルトガル政府と協力することを約束する。
Article VII 1. The Government of Japan undertakes to cooperate with the government of Portugal, as appropriate in light of the development of fisheries relations between the two countries pursuant to the provisions of this Agreement, in scientific research for purposes of conservation and in other appropriate measures for the optimum utilization and management of the living resources of the Zone.
2 日本国政府及びポルトガル政府は、自国の漁業管轄権の限界の外側における公海(それぞれの漁業管轄権の下にある水域の外側における公海水域でこれに隣接するものを含む。)の生物資源の適正な管理及び保存を確保するため、当該資源についての両政府の関心を考慮に入れ直接に又は適当な国際機関を通じて協力することを約束する。
2. The Government of Japan and the Government of Portugal undertake to cooperate directly or through appropriate international organizations to ensure proper management and conservation of the living resources of the high seas beyond the limits of national fisheries jurisdiction, including areas of the high seas beyond and immediately adjacent to the areas under their respective fisheries jurisdiction, taking into account their interests in such resources.
3 日本国政府及びポルトガル政府は、水域における高度回遊性魚種の保存を確保するため、直接に又は適当な国際機関を通じて協力することを約束する。
3. The Government of Japan and the Government of Portugal undertake to cooperate directly or through appropriate international organizations with a view to ensuring conservation of highly migratory species within the Zone.
第八条 1 日本国政府及びポルトガル政府は、この協定の実施に関し、定期的に両政府間で協議を行う。
Article VIII 1. The Government of Japan and the Government of Portugal shall carry out periodic bilateral consultations regarding the implementations of this Agreement.
2 日本国政府及びポルトガル政府は、この協定の規定に基づく両国間の漁業関係の発展に照らして適当な場合には、技術的情報及び人員の交換、漁獲物の利用及び加工の改善等の問題に関する将来の協力を含む二国間の協力の拡大の可能性を共同して検討する。
2. The Government of Japan and the Government of Portugal shall jointly examine, as appropriate in light of the development of fisheries relations between the two countries pursuant to the provisions of this Agreement, the possibility of expanded bilateral cooperation, including future cooperation on such matters as exchanges of technical information and personnel and improvement of utilization and processing of catches.
3 日本国政府及びポルトガル政府は、また、乗組員又はその他の者を乗船せしめ又は下船せしめるために及び合意されるその他の目的のために日本国の漁船によりポルトガルの港が使用されるための措置の可能性を共同して検討する。
3. The government of Japan and the government of Portugal shall also examine jointly the possibility of arrangements for the use of Portuguese ports by Japanese fishing vessels to ship or discharge crew members or other persons and for such other purposes as may be agreed upon.
第九条 この協定のいかなる規定も、日本国及びポルトガルが締約国である漁業問題に関する国際協定にどのようにも影響を与え又はこれらを害するものとみなしてはならず、また、海洋法に関するいかなる問題に関してもいずれの政府の見解又は立場を害するものとみなしてはならない。
Article IX Nothing in this Agreement shall be deemed to affect or prejudice in any manner international agreements on fishery matters to which Japan and Portugal are parties or to prejudice the views or positions of either Government in regard to any questions pertaining to the law of the sea.
第十条 1 この協定は、両国がこの協定の効力発生のための自国の法律上の手続が完了した旨を相互に通報する公文のうち第二の公文が受領された日に効力を生ずる。
Article X 1. This Agreement shall enter into force on the date of receipt of the second of the notes by which the two Governments inform each other that their legal procedures for the entry into force of the Agreement have been completed.
2 この協定は、一年間効力を有し、その後はいずれか一方の政府がこの協定を終了させる意思を通告する日から六箇月の期間が満了するまで効力を存続する。
2. This Agreement shall remain in force for a period of one year and shall continue in force thereafter until the expiration of six months from the day on which either Government shall give notice of its intention to terminate this Agreement .
以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。
IN WITNESS WHEREOF , the undersigned, being duly authorized by their respective Governments, have signed this Agreement.
