青年海外協力隊の派遣に関する日本国政府とパプア・ニューギニア政府との間の交換公文

Port Moresby, 24 August, 1979
書簡をもつて啓上いたします。本使は、日本国とパプア・ニューギニアとの間の技術協力を促進するため青年海外協力隊計画(以下「計画」という。)に基づき協力隊員をパプア・ニュ―ギニア派遣することに関し、日本国政府の代表者とパプア・ニューギニア政府の代表者との間でポート・モレスビーにおいて行われた最近の討議に言及するとともい、これらの代表者の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Excellency: I have the honour to refer to the recent discussions held in Port Moresby between the representatives of the Government of Japan and the Government of Papua New Guinea concerning the dispatch of volunteers to Papua New Guinea under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as "the Programme" ) with a view to promoting technical co-operation between the two countries and to confirm on behalf of the Government of Japan the following understandings reached between them:
1 日本国体府は、パプア・ニューギニア政府の要請に基づき、日本国の現行法令従い、パプア・ニューギニアの社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される計画に従い、協力隊員をパプア・ニューギニアに派遣するために必要な措置をとる。
1. At the request of the Government of Papua New Guinea and in accordance with the laws and regulations in force in Japan, the Government of Japan will take necessary measures to dispatch the volunteers to Papua New Guinea for the purpose of contributing to the social and economic development of Papua New Guinea according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とパプア・ニューギニアの間の渡航費及びパプア・ニューギニアにおける生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、材料及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and Papua New Guinea and living allowances in Papua New Guinea for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3 パプア・ニューギニア政府は、協力隊員に対し、次の特権、免除及び利益を与える。
3. The Government of Papua New Guinea will grant the volunteers the following privileges, exemptions and benefits:
(1) 2に掲げる装備、機械、材料及び医薬品に関連して課される関税、内国税その他すべての種類の課徴金の免除
(1) Exemption from customs duties, taxes and charges of any kind in respect of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
(2) 協力隊員の最初の着任後六箇月以内輸入される身回品及び家庭用品に関連して課される関税、内国税その他すべての種類の課徴金(ただし、保管、運送及び類似の役務に関する課徴金を除く。)の免除
(2) Exemption from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of their personal and household effects imported within six months of their first arrival.
(3) 2に掲げる生活手当等協力隊員に海外から送付される給与に関連して課される所得税その他すべての種類の課徴金の免除
(3) Exemption from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas such as the living allowances mentioned in paragraph 2 above.
(4) パプア・ニューギニア政府の公務員に与えられるものと同様の条件に基づく協力隊員の任期中の医療便宜
(4) Medical treatment and facilities under the same conditions as those provided for officers of the Government of Papua New Guinea during the term of their assignment.
(5) 協力隊員がパプア・ニューギニア政府より与えられた任務を遂行する場所における無料の住居施設
(5) Rent-free housing accommodations at places where they are to perform their duties to be assigned to them by the Government of Papua New Guinea.
4(1) パプア・ニューギニア政府は、パプア・ニューギニアにおける計画の活動に関連して日本国政府が行う技術協力の実施機関である日本国際協力事業団が与える任務を遂行する駐在員一人及び調整員を受け入れる。
4.(1) The Government of Papua New Guinea will accept a Representative and Co-ordinators who will discharge the duties to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical co-operation extended by the Government of Japan, relative to the activities of the Programme in Papua New Guinea.
(2) 駐在員及び調整員の事務所は、駐在員及び調整員の任務の遂行に必要な公用車を含む装備及び材料に関連して課される関税、内国税その他すべての種類の課徴金(ただし、保管、運送及び類似の役務に関する課徴金を除く。)を免除される。
(2) The office of the Representative and the Co-ordinators will be exempted from customs duties, taxes and charges of any kind other than those for storage, cartage and similar services in respect of equipment including official motor vehicles and of materials necessary for the performance of their function..
(3) 駐在員及び調整員は、身回品及び家庭用品に関連して課される関税を免除され、また、最初の着任後六箇月以内に一人につき一台の個人用自動車を無税で輸入すること(又は、パプア・ニューギニアにおける保税倉庫から購入すること)を認められる。
(3) The Representative and the Co-ordinators will be exempted from duties in respect of their personal and household effects and will be allowed duty-free importation (or purchase from bond in Papua New Guinea) of one personal motor vehicle each within six months from their first arrival.
(4) 駐在員及び調整員は、海外から送付される給与に関連して課される所得税その他すべての種類の課徴金を免除される。
(4) The Representative and the Co-ordinators will be exempted from income tax and charges of any kind in respect of any allowances to be remitted for them from overseas.
5 パプア・ニューギニア政府は、パプア・ニューギニアにおける協力隊員の公務に起因し、その遂行中に発生し、又は、その他その遂行中における作為又は不作為に関連する請求が生じた場合には、その請求に関する責任を負う。ただし、これらの請求が協力隊員の故意又は重大な過失から生ずる場合には、この限りでない。
5. The Government of Papua New Guinea under- takes to bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in Papua New Guinea, except when such claims arise from the wilful mis conduct or gross negligence on the part of the volunteers.
6 両政府は、パプア・ニューギニアにおける協力隊員の計画の実施を成功させるため随時協議する。
6. The two Governments will hold consultations from time to time, for the successful implementation of the Programme of the volunteers in Papua New Guinea.
7 前記の了解は、両政府間の書簡の交換によつて修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によつて通告することにより終了させることができる。
7. The understandings set out above may be amended by an exchange of letters between the two Governments and terminated by either Government by giving to the other six months' written notice of its intention to terminate them.
本使は、前記の了解を閣下がパプア・ニューギニア政府に代わつて確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understandings on behalf of the Government of Papua New Guinea.
