オランダ汽船オプテンノール号問題の解決に関する日本国政府とオランダ王国政府との間の交換公文

Tokyo, October 3O, 1978
書簡をもつて啓上いたします。本大臣は、オランダ汽船オプテンノール号(以下オプテンノール号という。)の沈没の問題に言及するとともに、この問題に関して両政府間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Excellency: I have the honour to refer to the question of the sinking of the Netherlands steamship Op ten Noort (hereinafter referred to as the s.s.Op ten Noort), and to confirm, on behalf of my Government, the following understanding reached between the two Governments concerning the said question:
1 日本国政府は、オプテンノール号の沈没に対する遺憾の意を表明するため、一億円(一〇〇、〇〇〇、〇〇〇円)の金額を見舞金としてオランダ王国政府に自発的に提供する。
1. The Government of Japan shall voluntarily tender as a solatium to the Government of the Kingdom of the Netherlands the amount of one hundred million yen (lOO,OOO,OOO) for the purpose of expressing regret for the sinking of the s. s. Op ten Noort.
2 日本国政府は、1に掲げる金額を、この取極の効力発生の時から三箇月を超えない実行可能な最も短い期間内に、オランダ王国政府が指定する銀行に開設される同国政府名義の非居住者自由円勘定に貸記することによりオランダ王国政府に対し支払う。
2. The Government of Japan shall pay to the Government of the Kingdom of the Netherlands the amount referred to in paragraph 1 above by crediting the said amount to a non-resident free Yen account, established in the name of the Government of the Kingdom of the Netherlands at a bank to be designated thereby, within the shortest practicable time not to exceed three months from the coming into force of the present arrangement.
3 オランダ王国政府は、1にいう日本国政府による支払を、オプテンノール号に関連する請求の完全かつ最終的な解決として、受諾する。したがつて、オランダ王国政府は、同国政府が、オプテンノール号に関連する日本国政府に対するこれ以上のいかなる請求をも提起していこと及び支持しないことを確認する。オランダ王国政府は、更に、オプテンノール号の船骸及びオプンノール号のすべての部品(同国政府が所有していたすべての積荷を含む。)が、日本国政府の所有物となることを宣言する。
3. The Government of the Kingdom of the Netherlands accepts the payment by the Government of Japan referred to in paragraph 1 as full and final settlement of claims related to the s.s. Op ten Noort. The Government of the Kingdom of the Netherlands accordingly confirms that it will neither raise nor support any further claim related to the s.s. Op ten Noort against the Government of Japan. The Government of the Kingdom of the Netherlands further declares that the wreck of the s.s. Op ten Noort or any part thereof, including any cargo of which it held the ownership, belong to the Government of Japan.
本大臣は、更に、この書簡及び貴国政府に代わつて前記のことを確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がオランダ王国側において必要な国内手続が完了した旨の同国政府からの書面による通告を日本国政府が受領した時に効力を生ずることを提案する光栄を有した。
I have further the honour to propose that this note and Your Excellency's reply confirming the foregoing on behalf of your Government shall be considered as constituting an agreement between the two Governments, which will become effective upon the receipt by the Government of Japan of the written notification from the Government of the Kingdom. of the Netherlands of the completion of necessary domestic procedures on the side of the Kingdom of the Netherlands.
本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

Excellency: I have the honour to confirm the receipt of your note of today's date which reads as follows:

本使は、本国政府が閣下の書簡の内容に同意することを通報し、かつ、この書簡及び閣下の書簡が日本国政府とオランダ王国政府との間の合意を構成するものとみなし、その合意がオランダ王国側において必要な国内手続が完了した旨の同国政府からの書面による通告を日本国政府が受領した時に効力を生ずることを確認する光栄を有します。
I have the honour to inform you that my Government agrees with the contents of your note and to confirm that this note and your note shall be considered as constituting an agreement between the Government of Japan and the Government of the Kingdom of the Netherlands which will become effective upon the receipt by the Government of Japan of the written notification from the Government of the Kingdom of the Netherlands of the completion of necessary domestic procedures on the side of the Kingdom of the Netherlands.
