航空業務に関する日本国政府と大韓民国政府との間の協定の付表等の修正に関する交換公文

(韓国側書簡)

(Korean Note)

　Tokyo, September 12, 1979

　書簡をもつて啓上いたします。本使は、千九百六十七年五月十六日に署名された航空業務に関する大韓民国政府と日本国政府との間の協定第十二条及び第十四条の規定につて千九百七十九年七月三十日から二十一日までの間ソウルにおいて行われた協議に言及する光栄を有します。

　Excellency, I have the honour to refer to the consultations which took place in Seoul from July 3O to July 31, 1979, in accordance with Articles 12 and 14 of the Agreement between the Government of the Republic of Korea and the Government of Japan for Air Services, signed on May 16, 1967.

　本使は、前記の協議において到達した合意に従い、この書簡に同封する修正された付表が同協定の付表に代わるべきこと及び両国政府間において交換された同協定に関する千九百六十七年五月十六日付けの書簡の1が次のとおり修正されるべきことを大韓民国政府代わつて提案する光栄を有します。

　Pursuant to an agreement reached at the said consultations, I have the honour to propose, on beha1f of the Government of the Repub1ic of Korea, that the Schedule of the Agreement be rep1aced by the revised Schedule set out in the enc1osure to this Note, and paragraph 1 of the Letters of May 16, 1967 re1ative to the said Agreement, which were exchanged between the two Governments be revised as follows:

「1　大韓民国の指定航空企業及び日本国の指定航空企業は、同一の飛行により自国内の一又は二以上の地点を経由して航空業務を運営することができる。もつとも、大韓民国の指定航空企業ついては、大韓民国における出入地点の総数は、ソウル及び釜山を含む四地点を超えてはならず、また、日本国の指定航空企業ついては、日本国における出入地点の総数は、東京、大阪及び福岡を含む六地点を超えてはならない。」

l. The designated airlines of the Republic of Korea and the designated airlines of Japan may operate air services through any point or points in their respective countries by the same flight. However, for the designated airlines of the Repub1ic of Korea, the tota1 number of gateway points in the Repub1ic of Korea shall not exceed four (4) including Seoul and Pusan, and for the designated airlines of Japan, the total number of gateway points in Japan shall not exceed six (6) including Tokyo, Osaka and Fukuoka."

　本使は、前記の提案が日本国政府にとつて受諾し得るものであるときは、この書簡(同封物を含む。)及びその旨の閣下の返簡をこの問題に関する両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　If the above proposal is acceptable to the Government of Japan, I have further the honour to suggest that this Note with its enclosure and Your Excellency's reply in that sense shall be regarded as constituting an agreement between the two Governments in this matter, which will enter into force on the date of Your Excellency's reply.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

SCHEDULE

1　日本国の一又二以上の指定航空企業が両方向に運営する路線

1. Routes to be operated in both directions by the designated airline or airlines of Japan:

(a)　日本国内の地点―釜山―ソウル及び以遠の地点

(a) Points in Japan - Pusan - Seoul and points beyond

(b)　日本国内の地点―釜山―済州

(b) Points in Japan - Pusan - Cheju

注(1)　日本国の一又は二以上の指定航空企業は、路線(a)において六を超える異なる以遠の地点に運航することができない。

Notes(1) The designated airline or airlines of Japan cannot operate to more than six (6) different points beyond on Route (a).

(2)　日本国の一又は二以上の指定航空企業は、釜山及びソウル又は釜山及び済州のうちいずれか一方の二地点に運営することができる。

(2) The designated airline or airlines of Japan can operate to either both Susan and Seoul or both Pusan and Cheju.

2　大韓民国の一又は二以上の指定航空企業が両方向に運営する路線

2. Routes to be operated in both directions by the designated airline or airlines of the Republic of Korea:

(a)　大韓民国内の地点―東京―ホノルル―ロス・アンジェルス

(a) Points in the Republic of Korea - Tokyo - Honolulu - Los Angeles

(b)　大韓民国内の地点―大阪―台北―香港―サイゴン―バンコック

(b) Points in the Republic of Korea - Osaka - Taipei - Hong Kong - Saigon - Bangkok

(c)　大韓民国内の地点―福岡

(c) Points in the Republic of Korea - Fukuoka

(d)　ソウル一名古屋

(d) Seoul - Nagoya

(e)　大韓民国内の地点―熊本又は鹿児島のうちの一地点

(e) Points in the Republic of Korea - one point either Kumamoto or Kagoshima

(f)　大韓民国内の地点一新潟又は小松のうちの一地点

(f) Points in the Republic of Korea - one point either Niigata or Komatsu

注　大韓民国の一又は二以上の指定航空企業は、日本国の一又は二以上の指定航空企業が大韓民国以遠の一地点に運航するまでの間、バンコックに運航することができない。

Note: The designated airline or airlines of the Republic of Korea cannot operate to Bangkok until the designated airline or airlines of Japan operate to a point beyond the Republic of Korea.

3　いずか一方の締約国の一又はニ以上の指定空港企業が行う協定業務は、その締約国の両域内び一地点を起点とするものでなければならない。ただし、いずれの路線上の他の地点も、いずれかの又はすべての飛行機に当たつて、その指定航空企業の選択により省略することができる。

3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on any of the routes may at the option of the designated airline be omitted on any or all flights.

　書簡をもつて啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,I have the honour to acknowledge the
receipt of Your Excellency's Note of today's
date which reads as follows:

　本大臣は、日本国政府が大韓民国との前記の提案を受諾する旨を閣下に通報するととも、閣下の書簡及びこの返簡をこの間題に関する両国政府間の合意を構成するものとみなし、その合意が本日効力を生ずることを確認する光栄を有します。

　I have the honour to inform Your Excellency that the Government of Japan accepts the above proposal of the Government of the Republic of Korea and to confirm that Your Excellency's Note and this reply are regarded as constituting this matter, which enters into force on this date.

　本大臣は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.
