　Ottawa, May 15, 1979


　書簡をもつて啓上いたします。本使は、両国間の繊維製品の貿易ついて、日本国政府の代表者とカナダ政府の代表者との間で最近東京で行われた討議に言及する光栄を有します。

　Excellency,I have the honour to refer to recent discussions held in Tokyo between representatives of the Government of Japan and of the Government of Canada on trade in textiles between our two countries. 


　本使は、更に、千九百七十三年十二月二十日ジュネーヴで作成され、千九百七十七年十二月十四日にジュネーヴで作成された議定書によつて延長された繊維製品の国際貿易にする取極の規定に基づく前記の討議の結果到達した次の了解を日本国政府に代わつて確認する光栄を有します。

　I have further the honour to confirm, on behalf of the Government of Japan, the following understanding reached as a result of the above-mentioned discussions in accordance with the provisions of the Arrangement regarding Internationa1 Trade in Textiles done in Geneva on December 20, 1973 and extended by the Protocol done in Geneva on December 14, 1977:


1　千九百七十八年一月一日から始まり千九百七十九年十二月三十一日まで続く期間、

1. For the period beginning January 1, 1978 and extending through December 31, 1979,


(1)　付表Aに掲げる繊維製品の日本国からカナダへの輸出は、同付表に定める数量枠を超えないものとする。

(1) exports from Japan to Canada of the textiles listed in Annex A shall not exceed the quantitative limits set forth in this Annex, and


(2)　付表Bに掲げる繊維製品の日本国からカナダへの輸出は、3の規定に基づいて課されることのある数量制限以外の数量制限の対象とならない。

(2) exports from Japan to Canada of the textiles listed in Annex B shall not be subject to numerical limitation other than those which may arise out of paragraph 3.


2　両政府は、1(1)の実施に関するいかなる間題についても、いずれか一方の政府の要請に基づき協議を行う。

2. The two Governments will consult with each other at the request of either Government in respect of any problemconcerning the implementation of paragraph 1 (1).


3(1)　カナダ政府は、1に規定する期間中はいつでも、付表B掲げる繊維製品の一又は二以上のものの日本国からの輸入が増加し、カナダにおける市場撹乱の真の危険をひき起こしていると認める場合には、影響を受けた当該繊維製品に関し、日本国政府との協議を要請することができる。

3. (1) If at any time during the Period referred to in paragraph 1 the Government of Canada considers that imports from Japan of one or more of the textiles listed in Annex B are increasing so as to cause a real risk of market disruption in Canada, the Government of Canada may request consultations with the Government of Japan regarding the textile or textiles affected.


(2)　(1)の規定に基づく協議は、カナダ政府が付表Bに掲げる当該繊維製品の日本国からカナダへの輸出が付表Bに定める水準を超えるおそれがあると認める場合を除くほか要請されない。

(2) Consultations under sub-paragraph (1) above shall not be requested, unless, in the opinion of the Government of Canada, exports of the textile or textiles listed in Annex B from Japan to Canada are likely to exceed the levels set forth in Annex B.


(3)　日本国政府は、(1)の規定基づく要請が行われた場合には、影響を受けた当該繊維製品に開して存在することのある間題にいて双方とつて満足な解決を図るため、カナダ政府と速やかに会合する。協議は、両政府が別段の合意をしない限り、協議の要請の日から三十日以内に終了するものとする。

(3) the Government of Japan will meet promptly with the Government of Canada when requested under sub-paragraph (I) above to work out a mutually satisfactory solution to such problem as may exist with the textile or textiles affected. The consultation shall be concluded within thirty days from the date of the request the such consultations, unless the two Governments agree otherwise.


(4)　そのような協議の結果双方とつて満足な解決が得られないときは、カナダ政府は、影響を受けた当該繊維製品のカナダへの輸出を制限することを日本国政府に要請することができる。その場合、日本国政府は、協議が要請された日から始まる十二箇月の期間の当該繊維製品の輸出を、付表Bに定める水準より高くない水準に制限する。

(4) In the event that such consultations do not result in a mutually satisfactory solution, the Government of Canada may request the Government of Japan to limit the exports to Canada of the textile or textiles affected. In that case, the Government of Japan shall limit exports of such textile or textiles at levels not greater than the levels set forth in Annex B for the twelve-month period beginning from the date on which the consultations were requested.


4　日本国政府は、付表A及びBに掲げる繊維製品の１にいう期間中の日本国からカナダヘの輸出に関する統計を、各四半期後できる限り速やかに提案すること同意する。

4. The Government of Japan agrees to provide as soon as possible, after each quarter, statistics on exports from Japan to Canada of the textiles listed in Annex A and B for the period referred to in paragraph 1.


5　前記の諸規定は、両政府より、それぞれ自国の関係法令に従つて実施される。

5. The foregoing provisions will be implemented by the two Governments in accordance with the laws and regulations applicable in their respective countries.


6　両政府は、いずれか一方の政府の要請があつた場合には、この書簡の対象となつている繊維製品関し両国間において生じている貿易形態の変化を考慮し、千九百七十九年十二月三十一日までに前記の諸規定の再検討を行うことに合意する。

6. Upon request of either Government, the two Governments agree to review the foregoing provisions Prior to December 31, 1979, taking into account the changing patterns of trade that are developing between the two countries in the textiles covered by this note.


　本使は、更に、この書簡(附表を含む。)及びカナダ政府に代わつて前記の了解を確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。

　I have further the honour to propose that this Note,together with the Annexes hereto, and Your Excellency's Note in reply confirming on behalf of the Government of Canada the foregoing understanding shall constitute an agreement between our two Governments, which shall enter into force on the date of Your Excellency's rep1y.

(注)(一)　この数量枠に従つた船積みは、ナイロン織物の輸出において対応する平方ヤード分の未達があることを条件として、同じ暦年中のナイロン織物の数量枠の七パーセントを超えない数量まで増加することができる。


							

						

						

							

								
NOTE:(1) Shipments under this quantitative limit may be increased by an amount not to exceed seven percent of the quantitative limit of nylon fabrics in the same calendar year provided that there is a corresponding square yard shortfall in export of nylon fabrics.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(二)　各暦年におけるこの数量枠のほか、フィラメントポリエステル・シャー織(ボイル、バチスト及びシホン等)及びポンジー織物を九〇〇、〇〇〇平方ヤードまでカナダへ輸出することができる。この合計の範囲内で、二品目のうちいずれの一方も、六〇〇、〇〇〇平方ヤードの水準を超えてはならない。


							

						

						

							

								
(2) 900,000 square yards of filament polyester sheer fabric(such as voile, batiste,chiffon) and pongee fabrics may be exported to Canada in addition to this quantitative limit in each calendar year. within this total, either of the two items shall not exceed the level of 600,000 square yards.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(三)　これらの数量枠((ニ)に定める追加数量を除く。)は、当該繊維製品の前年の数量枠のうち使用されなかつた部分を繰り越すことにより、当該繊維製品の前年の数量枠の五パーセントの範囲内で超過することができる。
