ギルバート諸島の地先沖合における漁業に関する日本国政府とギルバート諸島政府との間の協定

　日本国政府及び、グレート・ブリテン及び北部アイルランド連合王国政府の授権と同意により、ギルバート諸島政府は、

　Agreement between

　ギルバート諸島の地先沖合における漁業資源の合理的な管理、保存及び最適利用に関する両政府の共通の関心を考慮し、

　the Government of Japan and

　ギルバート諸島が同諸島領域の周辺海域における漁業資源を主要資源とする開発途上国であること及び漁業の分野における開発がギルバート諸島にとつて極めて必要であることを認め、

　the Government of the Gilbert Islands

　ギルバート諸島政府が、千九百七十八年三月十日付けのギルバート諸島総督による宣言により定められた漁業水域(以下「漁業水域」という。)の内側の漁業資源に関して管轄権を有することを認め、

　concerning Fisheries off the Coasts

　相互に関心を有する漁業に関する妥当な条件を確立することを希望し、

　of the Gilbert Islands

　漁業の分野における互恵的協力を確立し、もつて日本国とギルバート諸島との間の友好関係に貢献するとの双方の希望を確認して、

　The Government of Japan and the Government of the Gilbert Islands with the authority and consent of the Government of the United Kingdom of Great Britain and Northern Ireland,

　次のとおり協定した。

　Considering their common concern for the rational management, conservation and optimum utilisation of fishery resources off the coasts of the Gilbert Islands,

　Recognising that the Gilbert Islands is a developing country whose major re sources are the fishery resources in the sea around its territories, and that development in the field of fisheries is of vital necessity for the Gilbert Islands,

　Recognising that the Government of the Gilbert Islands has jurisdiction in respect of fishery resources within the Fishery Limits as defined by the Proclamation by the Governor of the Gilbert Islands dated 10 March 1978 (hereinafter referred to as "the Fishery Limits"),

　Desirous of establishing reasonable terms and conditions pertaining to fisheries of mutual concern, and

　Affirming their wish to establish mutually beneficial cooperation in the field of fisheries and in this way to contribute to friendly relations between Japan and the Gilbert Islands,

　Have agreed as follows:

第一条
　漁業水域内の日本国の国民及び漁船による漁獲は、漁業水域に関するギルバート諸島の関係法令及びこの協定に従つて行われる。

ARTICLE I
　Fishing by nationals and fishing vessels of Japan within the Fishery Limits shall be conducted in accordance with the relevant laws and regulations of the Gilbert Islands with regard to the Fishery Limits and with this Agreement.

第二条
　日本国政府及びギルバート諸島政府は、この協定の実施及びこの協定の第三条に従つてギルバート諸島政府により行われる決定に関して協議を行う。

ARTICLE II
　The Government of Japan and the Government of the Gilbert Islands shall hold consultations regarding the implementation of this Agreement and the determinations to be made by the Government of the Gilbert Islands in accordance with Article III of this Agreement.

第三条
1　ギルバート諸島政府は、毎年、この協定の第二条にいう日本国政府との協議を考慮に入れ、かつ、入手可能な最良の科学的証拠を基礎として、漁業水域内の日本国の国民及び漁船の漁獲を行うことに関する規制措置を決定する。

ARTICLE III
1. The Government of the Gilbert Islands shall determine each year, taking into account the consultations with the Government of Japan referred to in Article II of this Agreement, and on the basis of the best available scientific evidence, regulatory measures with respect to the conduct of fishing by nationals and fishing vessels of Japan within the Fishery Limits.

2　ギルバート諸島政府は、本条1にいう決定を日本国政府に対して時宣を失することなく通報する。

2. The Government of the Gilbert Islands shall notify the Government of Japan of the determinations referred to in paragraph 1 of this Article on a timely basis.

第四条
　ギルバート諸島政府は、日本国の漁船が漁業水域において漁獲に従事することを可能とするため、日本国政府との間で合意される妥当な率の料金を受領したときは、漁業水域に関するギルバート諸島の関係法令に従つて許可証を発給する。

ARTICLE IV
　The Government of the Gilbert Islands shall issue, in accordance with the relevant laws and regulations of the Gilbert Islands with regard to the Fishery Limits, licences upon receipt of fees at such reasonable rates as may be agreed upon with the Government of Japan, to enable fishing vessels of Japan to engage in fishing in the Fishery Limits.

第五条
　　日本国政府は、日本国の関係法令に従つて、日本国の漁船がこの協定に基づいて許可されない限り漁業水域内で漁獲に従事しないこと並びにこの協定に基づいて漁獲に従事する日本国の国民及び漁船がこの協定の規定に従うことを確保する。

ARTICLE V
　The Government of Japan shall ensure, in accordance with the relevant laws and regulations of Japan, that fishing vessels of Japan unless licensed under this Agreement shall not engage in fishing within the Fishery Limits and that nationals and fishing vessels of Japan engaging in fishing under this Agreement comply with the provisions of this Agreement.

第六条
1　この協定の規定に従わない日本国の国民又は漁船がギルバート諸島の当局によつて逮捕され又は拿捕されたときは、日本国政府に対し、その旨が速やかに通報される。

ARTICLE VI
1. In cases of arrest or seizure by the authorities of the Gilbert Islands of nationals or fishing vessels of Japan which do not comply with the provi5ions of this Agreement, notification shall be given promptly informing the Government of Japan of the action taken.

2　逮捕された日本国の国民及び拿捕された日本国の漁船は、妥当な供託金又はその他の保証を条件として、速やかに釈放される。

2. Arrested nationals of Japan and seized fishing vessels of Japan shall be promptly released, subject to reasonable bond or other security.

第七条
　ギルバート諸島政府は、この協定の規定に従わない日本国の国民及び漁船に対して、妥当な罸金を課すことができる。

ARTICLE VII
　The Government of the Gilbert Islands may impose reasonable fines on nationals and fishing vessels of Japan which do not comply with the

第八条
　日本国政府及びギルバート諸島政府は、ギルバート諸島の地先沖合水域を含む太平洋のまぐろ及びまぐろに類似した魚種の資源の保存及び最適利用の目的を推進する。

ARTICLE VIII 
　The Government of Japan and the Government of the Gilbert islands shall promote the objective of conservation and optimum utilisation of the resources of tuna and tuna-like fishes of the Pacific Ocean including the waters off the coasts of the Gilbert Islands.

第九条
　ギルバート諸島政府は、施設の利用可能性及びギルバート諸島の船舶の必要性を留保して、日本国の漁船がギルバート諸島の関係法令及び行政上の要求に従つてギルバート諸島の港に入港することを認可することを約束する。

ARTICLE IX
　Subject to the availability of facilities and the needs of Gilbert Islands vessels, the Government of the Gilbert Islands undertakes to authorize Japanese vessels to enter Gilbert Islands ports in accordance with the relevant laws, regulations and administrative requirements of the Gilbert Islands.

第十条
　この協定のいかなる規定も、日本国及びギルバート諸島が締約国である漁業資源の保存に関する国際協定に影響を与え又は第三次国際連合海洋法会議において交渉中のいかなる問題に関するいずれの政府の立場をも害するものとみなしてはならない。

ARTICLE X
　Nothing in this Agreement shall be deemed to affect international agreements on the conservation of fishery resources to which Japan and the Gilbert Islands are parties or to prejudice the position of either Government in regard to any question under negotiation at the Third United Nations Conference on the Law of the Sea.

第十一条
1　この協定は、署名の日に効力を生ずる。

ATICLE XI
1. This Agreement shall enter into force on the date of signature.

2　この協定は、千九百八十年六月二十五日まで効力を有し、その後はいずれか一方の政府がこの協定を終了させる意思を通告する日から六箇月の期間が満了するまで効力を存続する。

2. This Agreement shall remain in force until 25 June 1980 and shall continue in force thereafter until the expiration of six months from the day on which either Governmnent shall give notice of its intention to terminate this Agreement.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。

　IN WITNESS WEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.
