漁業調査船の供与のための贈与に関する日本国政府とガーナ共和国政府との間の交換公文

(Japanese Note)
Accra, September 4, 1978
書簡をもつて啓上いたします。本使は、日本国とガーナ共和国との間の友好協力関係を強化することを目的としてガーナ共和国に対し行われる日本国の経済協力に関して日本国政府の代表者とガーナ共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わつて提案する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and the Government of the Republic of Ghana concerning Japanese economic cooperation to be extended to the Republic of Ghana with a view to strengthening friendly and cooperative relations between the two countries and to propose on behalf of the Government of Japan the following arrangements:
1 日本国政府は、ガーナ共和国政府が漁業調査計画(以下「計画」という。)を実施することに寄与するため、日本国の関係法令に従い、ガーナ共和国政府に対し、五億円(五○○、○○○、○○○円)を限度とする額の贈与(以下「贈与」という。)を行う。
1. For the purpose of contributing to the execution of the fisheries research project (hereinafter referred to as "the Project") by the Government of the Republic of Ghana, the Government of Japan will extend to the Government of the Republic of Ghana, in accordance with the relevant laws and regulations of Japan, a grant up to five hundred million yen (500,000,000)(hereinafter referred to as "the Grant").
2 贈与は、両政府の関係当局間の合意によつて延長されない限り、この取極の効力発生の日から千九百七十九年三月三十一日までの期間に使用に供される。
2. The Grant will be made available during the period between the date of coming into force of the present arrangements and March 31,1979, unless the period is extended by mutual agreement between the authorities concerned of the two Governments.
3 贈与は、ガーナ共和国政府が計画の実施のために必要な次に掲げる日本国の生産物及び日本国民の役務を購入するために使用される。(日本国民という語は、この取極の中で用いる時はいつでも、日本国の自然人又はその支配する日本国の法人を意味する。)
3. The Grant will be used by the Government of the Republic of Ghana for the purchase of product of Japan and service s of Japanese nationals listed below necessary for the execution of the Project: (The term Japanese nationals whenever used in the present arrangements means Japanese physical persons or Japanese juridical persons controlled by Japanese physical persons.)
(a) 漁業調査船一隻(以下「船舶」という。)
(a) a fisheries research vessel (hereinafter referred to as "the Vessel");and
(b) 船舶のガーナ共和国の港までの輸送のために必要な役務
(b) services necessary for the transportation of the Vessel to a port in the Republic of Ghana.
4 ガーナ共和国政府又はその指定する当局は、船舶及び3にいう役務を購入するため、日本国民と円貨建ての契約を締結する。この契約は、贈与の対象として適格であることが日本国政府により認証されなければならない。
4. The Government of the Republic of Ghana or its designated authority will enter into contracts in Japanese yen with Japanese nationals for the purchase of the Vessel singed the services referred to in paragraph 3 since contracts shall be verified by the Government of Japan to be eligible for the grant.
5(1) 日本国政府は、4の規定に従つて認証された契約(以下「認証された契約」という。)に基づいてガーナ共和国政府又はその指定する当局が負う債務の弁済に充てるための資金を、ガーナ共和国政府又はその指定する当局によつて指定される日本国の外国為替公認銀行(以下「銀行」という。)
5.(1) The Government of Japan will execute the Grant by making payments in Japanese yen to cover the obligations incurred by the Government of the Republic of Ghana or its designated authority under the contracts verified in accordance with the provisions of paragraph 4 (hereinafter referred to as "the Verified Contracts") to an account to be opened in the name of the Government of the Republic of Ghana in the authorized foreign exchange bank of Japan designated by the Government of the Republic of Ghana or its designated authority (hereinafter referred to as "the Bank").
に開設されるガーナ共和国政府名義の勘定に日本円で払い込むことにより、贈与を実施する。
(2) The proposes referred to in sub-paragraph (1) above will be made when payment requests are presented by the Banks to the Government of Japan under an authorization to pay issued by the Government of the Republic of Ghana or its designated authority.
(2) (1)にいう払込みは、ガーナ共和国政府又はその指定する当局が発行する支払授権書に基づいて銀行が支払請求書を日本国政府に提出した時に行われる。
(3) The sole purpose of the account referred to in sub-paragraph (1) above is to receive the payments in Japanese yen by the Government of Japan and to pay to the Japanese
(3) (1)にいう勘定の目的は、日本国政府が払い込む日本円を受領すること及び認証された契約の当事者たる日本国民に対する支払を行うことに限られる。勘定の貸記及び借記に関する手続細目は、銀行とガーナ共和国政府又はその指定する当局との間の協議により合意される。
Nationals who are parties to the Verified Contacts. The procedural details concerning the credit to and debit from account will be agreed upon through consultation between the Bank and the Government of the Republic of Ghana or its designated authority.
6(1) ガーナ共和国政府は、次のことのために必要な措置をとる。
6.(1) the government of the Republic of Ghana will take necessary of measures;
(a) 船舶のガーナ共和国における速やかな通関を確保するこご。
(a) to ensure prompt customs clearance of the Vessel in the Republic of Ghana;
(b) 日本国民につき、認証された契約に基づく船舶及び役務の供与に関してガーナ共和国において課される関税、内国税その他の財政課徴金を免除すること。
(b) to exempt Japanese nationals from customs duties, internal taxes and other fiscal levies which may be imposed it the Republic of Ghana with respect to the supply of the Vessel and the services under the Verified Contracts;
(c) 船舶が計画の実施のために適正かつ効果的に維持され及び使用されることを確保すること。
(c) to ensure that the Vessel be maintained and used properly and effectively for the execution of the Project; and
(d) 計画の実施のために必要なすべての経費(贈与によつて負担されるものを除く。)を負担すること。
(d) to bear all the expenses, other than those to be borne by the Grant, necessary for the execution of the Project.
(2) 船舶は、ガーナ共和国から再輸出されてはならかい。
(2) the Vessel shall not be re-exported from the Republic of Ghana.
7 両政府は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。
7. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.
本使は、更に、この書簡及びガーナ共和国政府に代わつて前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Republic of Ghana the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
本使は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。

書簡をもつて啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

本大臣は、更に、ガーナ共和国政府に代わつて前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Republic of Ghana the foregoing arrangements and to agree that Your Excellency' s Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
