技術協力に関する日本国政府とコロンビア共和国政府との間の協定
AGREEMENT ON TECHNICAL CO-OPERATION BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF COLOMBIA
日本国政府及びコロンビア共和国政府は、技術協力の促進により両国間に存在する友好関係を一層強化することを希望し、また、両国の経済及び社会発展を促進することがもたらす相互の利益を考慮して、
The Government of Japan and the Government of the Republic of Colombia,
次のとおり協定した。
Desiring to strengthen further the friendly relations existing between the two countries by the promotion of technical co-operation and,
Considering mutual benefits derived from promoting the economic and social progress of their respective countries,
Have agreed as follows:
第一条 両政府は、両国間の技術協力を促進するよう努力する。
Article I The two Governments will endeavour to promote technical co-operation between the two countries.
第二条 日本国政府は、この協定の目的を達成するため、日本国の現行法令に従い、かつ、第三条にいう取極により、自己の負担で次の形態による技術協力を行う。
Article II In order to achieve the objectives of this Agreement, the Government of Japan will, in accordance with the laws and regulations in force in Japan and through arrangements referred to in Article III, carry out at its own expense the following forms of technical co-operation:
(a) 日本国における技術訓練のためにコロンビア国民を受け入れること
(a) receiving Colombian nationals for technical training in Japan;
(b) 日本人専門家をコロンビア共和国に派遣すること
(b) dispatching Japanese experts to the Republic of Colombia;
(c) 設備、機械及び資材をコロンビア共和国政府に供与すること
(c) providing the Government of the Republic of Colombia with equipment, machinery and materials;
(d) コロンビア共和国の経済及び社会開発計画の調査を行うための調査団をコロンビア共和国に派遺すること
(d) sending missions to the Republic of Colombia to conduct surveys of economic and social development projects of the Republic of Colombia; and
(e) 相互に合意することのあるその他の形態の技術協力
(e) any other form of technical cooperation which may be mutually agreed upon.
第三条 両政府は、第二条にいう技術協力を行うため、両政府の間で合意する個別の技術協力計画を実施するための別途の取極を文書により行う。
Article III For the purpose of implementing the technical co-operation referred to in Article II, the two Governments will enter into separate arrangements in written form to carry out specific technical co-operation programmes to be agreed upon between the two Governments.
第四条 コロンビア共和国政府は、第二条に規定する日本の技術協力の結果としてコロンビア国民が取得した技術及び知識がコロンビア共和国の経済及び社会発展に寄与することを確保する。
Article IV The Government of the Republic of Colombia will ensure that the techniques and knowledge acquired by Colombian nationals as a result of the Japanese co-operation as provided for in Article II will contribute to the economic and social development of the Republic of Colombia.
第五条 1 日本国政府が専門家を派遣する場合(このような専門家を以下「専門家」という。)には、コロビア共和国政府は、自己の負担で次の措置をとる。
Article V 1. In case the Government of Japan dispatches experts (hereinafter referred to as "the Experts"), the Government of the Republic of Colombia will take at its own expense the following measures:
(a) 専門家の任務遂行に必要な事務所その他の施設を提供し、かつ、その維持費を負担すること
(a) to provide offices and other facilities required for the performance of the duties of the Experts and to bear the expenses for the maintenance thereof;
(b) 専門家の任務遂行に必要な現地要員(専門家の相手方となるコロンビア人要員及び、必要な場合には、適当な通訳を含む。)を提供すること
(b) to provide the local staff (including the Colombian counterparts to the Experts and, if necessary, adequate interpreters) necessary for the performance of the duties of the Experts; and
(c) 次の諸経費を負担すること
(c) to bear expenses:
(i) 通勤費
(i) for daily transportation to and from their place of work;
(ii) コロンビア共和国内の公用出張旅費
(ii) for their official travels in the Republic of Colombia; and
(iii) 公用通信費
(iii) for their official correspondence.
2 コロンビア共和国は、専門家及びその家族に対し次のものを提供する。
2. The Government of the Republic of Colombia will grant the Experts and their families:
(a) 適当な家具付き住宅
(a) appropriate furnished accommodation; and
(b) 職務又は現地の環境条件から生ずる事故又は疾病に対する無料の医療便宜
(b) free medical service and facilities in case of accident or illness resulting from the work or from the conditions of the local environment.
第六条 1 専門家は、海外から送金される給与に対し又はこれに関連して課される所得税その他の課徴金を免除される。
Article VI 1. The Experts will be exempt from income tax and charges of any kind imposed on or in connection with the allowances remitted from a broad.
2 専門家及びその家族は、その到着後六箇月の間に行り次のものの輸入に関し、輸入許可書及び為替証明書の取得要件並びに領事手数料、関税その他の課徴金を免除される。ただし、特定の役務の提供の対価である料金は、この限りでない。
2. The Experts and their families will be exempt from the requirement of obtaining import licenses and certificates of foreign exchange coverage, consular fees, customs duties and any other charges, except those which represent payment for specific services rendered, in respect of the importation, during six months after their arrival, of:
(a) 専門家及びその家族の携帯荷物
(a) the Experts' and their families' baggage;
(b) 専門家及びその家族用としてコロンビア共和国に持ち込まれる身回品、家財及び消費財
(b) personal and household goods and consumer goods brought into the Republic of Colombia for the Experts. and their families' use; and
(c) 専門家用として専門家又はその配偶者名義でコロンビア共和国に輸入される自動車一台(ただし、専門家がコロンビアに一年以上滞在する場合に限る。)。自動車の輸入許可は、日本国大使館の事前の申請があり次第コロンビア共和国外務省により発給される。専門家は、前記に従い自動車一台を輸入する代わりに、コロンビアで生産された自動車一台をコロンビア共和国において自動車に課される内国税その他の課徴金なしに購入することができる。コロンビア共和国において輸入若しくは購入された自動車は、コロンビア共和国の現行法令に従つて売却又は譲渡することができる。
(c) one motor vehicle for the Experts, personal use brought into the Republic of Colombia in their own name or in the name of their spouses, provided that the Experts remain in the country for at least one year. The authorization to import a motor vehicle will be granted by the Ministry of External Relations of the Republic of Colombia upon prior application of the Embassy of Japan. Instead of importing one motor vehicle in accordance with the above, the Experts may buy one Colombian produced motor vehicle without internal taxes and other charges imposed on the motor vehicle in the Republic of Colombia. The motor vehicle imported or bought in the Republic of Colombia may be sold or transferred in accordance with the laws and regulations in force in the Republic of Colombia.
3 専門家及びその家族は、2にいう携帯荷物、物品及び自動車の輸出について、輸出許可書の取得要件及び関税その他の課徴金を免除される。
3. The Experts and their families will be exempt from the requirement of obtaining export licenses customs duties and any other charges for the exportation of the baggage, goods and the motor vehicle mentioned in paragraph 2 above.
4 コロンビア共和国政府は、また、次の措置をとる。
4. The Government of the Republic of Colombia will also take the following measures:
(a) 申請があり次第、専門家及びその家族に対し入国及び出国査証を無料で発給すること
(a) to issue, upon application, entry and exit visas for the Experts and their families free of charge; and
(b) 専門家の任務遂行に必要なすべての政府機関の協力を確保するために専門家及びその家族に対し身分証明書を交付すること
(b) to issue identification cards to the Experts and their families to secure the co-operation of all governmental organizations necessary for the performance of the duties of the Experts.
5 専門家及びその家族は、コロンビア共和国において同様の任務を遂行している第三国又は国際機関の専門家に与えられているものより不利でないその他の特権、免除及び便宜を与えられる。
5. The Experts and their families will be granted such other privileges, exemptions and benefits as are no less favourable than those granted to experts of any Third country or of any international organization performing similar mission in the Republic of Colombia.
第七条 コロンビア共和国政府は、専門家の任務の遂行に基因し、その遂行中に発生し、又はその他その遂行に関連する専門家に対する請求が生じた場合には、その請求に関する責任を負う。ただし、両政府がその請求が専門家の重大なる過失又は故意から生じたことを合意した場合は、この限りでない。
Article VII The Government of the Republic of Colombia will bear claims, if any arises, against the Experts resulting from, occurring in the course of, or otherwise connected with, the discharge of their duties, except when the two Governments agree that such claims arise from gross negligence or willful misconduct on the part of the Experts.
第八条 専門家は、コロンビア共和国政府が指定する機関を通じ、同政府と緊密に連絡を保つものとする。
Article VIII The Experts will maintain close contact with the Government of the Republic of Colombia through organizations designated by it.
第九条 1 日本国政府がコロンビア共和国政府に設備、機械及び資材を供与する場合、これらは陸揚港においてc・i・f建てでコロンビア共和国政府の関係当局に引き渡された時にコロンビア共和国政府の財産となる。これらの設備、機械及び資材は、供与された目的のために使用される。
Article IX 1. In case the Government of Japan provides the Government of the Republic o Colombia with equipment, machinery and materials, they will become the property of the Government of the Republic of Colombia upon being delivered c.i.f. at the port of disembarkation to the authorities concerned of the Government of the Republic of Colombia. Such equipment, machinery and materials will be utilized for the purpose for which they will be provided.
2 コロンビア共和国政府は、1にいう設備、機械及び資材につき輸入許可書及び為替証明書の取得要件並びに領事手数料関税その他の課徴金を免除する。
2. The Government of the Republic of Colombia will exempt the equipment, machinery and materials referred to in paragraph 1 above from the requirement for import licenses and certificates of foreign exchange coverage, consular fees, customs duties and any other charges.
3 1にいう設備、機械及び資材のコロンビア国内における輪送のための費用並びにその補充のための費用は、コロンビア共和国政府が負担する。
3. The expenses for the transportation within the country of the equipment, machinery and materials referred to in paragraph 1 above, as well as the expenses for their replacement will be borne by the Government of the Republic of Colombia.
4 専門家及び第二条(d)にいう調査団がそれらの任務を遂行するために携行する設備、機械及び資材は、別段の合意がある場合を除き日本国政府の財産である。
4. The equipment, machinery and materials which the Experts and the missions referred to in (d) of Article II will carry with them for the performance of their duties will remain the property of the Government of Japan unless otherwise agreed.
前記の専門家及び調査団は、コロンビア共和国において設備、機械及び資材に課される内国税その他の課徴金を免除され、かつ、設備、機械及び資材の輸入に際し、輸入許可書及び為替証明書の取得要件並びに領事手数料、関税その他の課徴金を免除される。
The Experts and the missions mentioned above will be exempt from internal taxes and other charges to be imposed on the equipment, machine and materials in the Republic of Colombia, as well as from the requirement of obtaining import licenses and certificates of foreign exchange coverage, consular fees, customs duties and any other charges at the time of importation of the equipment, machinery and materials.
専門家及び調査団は、設備、機械及び資材の再輸出に際し、輸出許可書の取得要件及び関税その他の課徴金を免除される。
The Experts and the missions will be exempt from the requirement of obtaining export licenses, customs duties and any other charges at the time of the re-exportation of the equipment, machinery and materials.
5 4にいう設備、機械及び資材のコロンビア国内にかける輸送のための費用は、コロンビア共和国政府が負担する。
5. The expenses for the transportation within the country of the equipment, machinery and materials referred to in paragraph 4 above will be borne by the Government of the Republic
第十条 両政府は、この協定から、又はそれに関連して生ずることがあるいかなる事項についても相互に協議する。
Article X The two Governments will consult with each other in respect of any matter that may arise from or in connection with this Agreement.
第十一条 1 この協定は、日本国政府がコロンビア共和国政府からこの協定の効力発生のために必要な手続を終了した旨の文書による通告を受領した日に効力を生ずる。
Article XI 1. This Agreement will enter into force on the date of the receipt by the Government of Japan of the written notification from the Government of the Republic of Colombia stating that necessary formalities for the entry into force of the Agreement have been completed.
2 この協定は、一年間効力を有するものとし、いずれか一方の政府が他方の政府に対し少なくとも六箇月の予告をもつて協定を終了させる意思を書面により通告しない限り、毎年自動的に一年ずつ更新される。
2. This Agreement will remain in force for a period of one year, and will be automatically renewed every year for another period of one year each, unless either Government has given to the other Government at least six months' written advance notice of its intention to terminate the Agreement.
以上の証拠として、下名は、正当に委任を受けて、この協定に署名した。
IN WITNESS WHEREOF the under signed, duly authorized thereto, have signed this Agreement.
