CONVENTION BETWEEN JAPAN AND THE SOCIALIST REPUBLIC OF ROMANIA FOR THE AVOIDANCE OF DOUBLE TAXATION WITH RESPECT TO TAXES ON INCOME

　日本国政府及びルーマニア社会主義共和国政府の代表者は、本日署名された所得に対する租税に関する二重課税の回避のための日本国とルーマニア社会主義共和国との間の条約を締結するための交渉において到達した両政府間の次の了解をここに記録する。

　The representatives of the Government of Japan and of the Government of the Socialist Republic of Romania hereby record the following understandings which have been reached between the two Governments during the course of the negotiations for the conclusion of the Convention between Japan and the Socialist Republic of Romania for the Avoidance of Double Taxation with respect to Taxes on Income, signed today:


1　第三条1(f)に関し、「法人」には、ルーマニアについては、ルーマニアの法令に基づいて組織された混合法人を含む。

1. With reference to paragraph 1(f) of Article 3, the term "company" includes, in relation to Romania, any mixed company organized under the Romania laws.


2　第五条及び第七条に関し、一方の締約国の企業は、他方の締約国の政府が後援する他方の締約国内における貿易に係る一時的な見本市又は展示会の終了の際に当該企業が当該見本市又は展示会に展示した物品又は商品を売却するという理由のみでは、他方の締約国内において恒久的施設を通じて事業を行うものとはみなされない。

2. With reference to Articles 5 and 7, an enterprise of a Contracting State shall not be deemed to carry on business through a permanent establishment in the other Contracting State merely because such enterprise sells at the termination of the a temporary trade fair or exhibition in that other Contracting State, sponsored by the Government of that other Contracting State, goods or merchandise which such enterprise displayed at such trade fair or exhibition.


3　第七条に関し、「企業の利得」には、手数料及び役務の提供から生ずる所得を含む。

3. With reference to Article 7, the term "profits of an enterprise" includes commissions and income derived from furnishing of services.


4　第十条3に関し、「配当」には、ルーマニアについては、混合法人が分配する利得を含む。

4. With reference to paragraph 3 of Article 10, the term "dividends" includes, in relation to Romania, the profits distributed by a mixed company.
